Brier City Council Minutes

July 24, 2001

Mayor Kaske called the regular Brier City Council Meeting to order at 7:31 PM, and the flag salute was given.

Roll Call:

Present: Councilmembers Starks, Jordan, Colinas, Magnuson, Doolittle & Warner.

Absent: Councilmember Moller.

Reports of Committees & City Officials:

Mayor Kaske asked if there were any reports. Councilmember Doolittle requested $250.00 for two infant swings and two youth swings for the empty structure in Brier Park. Councilmember Colinas moved and Councilmember Jordan seconded to approve up to $300.00 to replace four swings. Motion carried. Councilmember Jordan reported they had a very lean Library Board Meeting but they do have a full board if everyone shows up.

Public Requests & Oral Communications: None

Consent Agenda:

Mayor Kaske opened for consideration approval of the Consent Agenda. Councilmember Colinas moved and Councilmember Doolittle seconded to approve the Consent Agenda, which included approval of the Brier City Council Minutes of July 10, 2001; approval of the June 2001 Sewer M. & O. Foreclosure List; and to confirm the appointment of John Szalda to the Brier Civil Service Commission with term to expire October 31, 2005. Motion carried, with Councilmember Starks abstaining since he was not in attendance at the July 10, 2001 meeting.

Ordinances, Resolutions & Orders:

Mayor Kaske opened for consideration of the Resolution of Support for Community Transit Ballot Issue for Sales Tax Increase. There was Mayor and Council discussion regarding this issue possibly coming before the voters in the future. There was Council consensus to not take any action at this time.

Hearings:

Mayor Kaske opened for consideration of the Public Hearing on Plat Modification No. 01-001 for North View Glen Subdivision for J.M. Murphy, Inc. Councilmember Magnuson removed herself from the Council table regarding this issue. Steve Anderson explained the application for the modification of the plat of North View Glen, which had been approved in 1997. Mr. Anderson stated that they seek to use the regional storm water system approved for the Murphy Short Plat. Mayor Kaske opened the Public Hearing on Plat Modification No. 01-001. Kirby Johnson, 22016 Vine Road, asked Council where the existing drainage course for the water coming off of the property was

located, and Steve Anderson responded showing the two areas going into the Locust Creek basin. Councilmember Magnuson left the meeting at 7:58 PM. There was discussion between Council, Mr. Anderson, Mr. Johnson and City Attorney, Tom Evans regarding easements and water diversion. Catie Smith, 21700 Vine Road, stated her property has a creek going through it and wondered if any of the additional water flow would go in that direction and Steve Anderson responded that it would not. There was Council discussion with Steve Anderson and Kirby Johnson. Councilmember Colinas moved and Councilmember Jordan seconded to close the Public Hearing on Plat Modification No. 01-001. Motion carried. There was Council discussion with Steve Anderson and Tom Evans regarding the recommendations in Dick Russell’s memo dated July 19, 2001.Council discussed seeing previous information from the original plat of North View Glen. Steve Anderson asked Council if they would like him to put together responses to all the items, except the first seven as they are not an issue, and there was Council consensus for him to do this. Councilmember Colinas moved for a twenty-five minute Executive Session to discuss legal questions regarding this plat. There was not a second to the Motion. There was Council consensus to get previous information from the original plat, which Mr. Anderson will provide. Councilmember Colinas moved and Councilmember Jordan seconded to continue discussion on Plat Modification No. 01-001 for North View Glen Subdivision for J.M. Murphy, Inc. to the August 14, 2001 Brier City Council meeting. Motion carried.

Miscellaneous Business by Call of Councilmembers & City Officials:

Councilmember Doolittle stated that the Park Board loves Bobcat Park Master Plan.

Councilmember Colinas moved to adjourn. Motion carried and the Brier City Council Meeting of July 24, 2001 adjourned at 8:58 PM.
