BRIER CITY COUNCIL MINUTES

December 27, 2005

Mayor Colinas called the regular Brier City Council Meeting to order at 7:30PM and the flag salute was given.

 

Roll Call:

Present:         Councilmembers McClenny, Gipson, Corpron-Smith, Krienke and Morgan. Councilmember Doolittle (Reinke) arrived at 7:37PM.

Absent:          Councilmember Kaemingk.

 

Public Requests & Oral Communications:

Al Ross – 3309 214th St SW – Several discussions about issues related to water. He took some pictures of the water pooling in front of his driveway on 214th. A car drives through the puddles and then causes waves that carry to his garage. He would like to inform the city council of this occurrence and see some kind of drainage action happen.

 

Ed Walker – 21206 Poplar Way – He understands that McClenny Meadows reissued a new MDNS. He was promised a meeting, but due to different circumstances, it never happened. He is not seeing any new information in the file related to his appeal or the new MDNS. He is looking for a new lot potential map, but it is not there. Are there any revisions, and where are they? In the SEPA process, the comment period is to close to appeal date therefore making it difficult to determine if action should be taken.

 

Fred Price - 3408 214th St SW – The council has heard the issue on water drainage, and its importance should be at the top of list. Cars are entering opposite lane on blind corner to avoid the water puddle/pool and it is becoming a traffic hazard. There was a time when they repaved the road on 214th they did increase the pipe from 8 inches to 12 inches. Dick Russell knew at that time it would not be adequate, but nothing was done about it.

 

Ed Walker – 21206 Poplar Way – The water pool issue on 214th is a mitigation issue that the city let slip through. The drainage was part of the concomitant agreement of Timbervale, and it was never done.

 

Reports of Committees & City Officials:

Councilmember Gipson attended the Community Transit meeting on December 15th, 2005.

Mayor Colinas attended the Parks Board meeting and the Police Department staff meeting.

Councilmember Corpron-Smith attended the Parks Board meeting.

Councilmember Morgan attended the South Snohomish Cities meeting where there was a Sound Transit presentation and a light-rail simulation. Brian Sullivan aides attended, and there was discussion about REET funds with emphasis on allowing maintenance with REET funds.

 

Approval of Minutes:

Mayor Colinas opened for consideration approval of the Brier City Council Minutes of December 13, 2005. Councilmember Gipson moved and Councilmember Reinke seconded to approve the Brier City Council Minutes of December 13, 2005. Motion Carried.

 

Mayor Colinas opened for consideration of approval of the Brier City Council Workshop Minutes of December 20, 2005. Councilmember McClenny moved and Councilmember Reinke seconded to approve the Brier City Council Workshop Minutes of December 20, 2005 with noted changes. Councilmember Krienke abstaining. Motion Carried.

 

Consent Agenda:

Mayor Colinas opened approval of the consent agenda which includes: the appointment of Fred Steele to the Parks Board, Mark Johnson to the Library Board, and the approval of the Thyssen-Krup elevator maintenance contract. Councilmember Reinke moved and Councilmember McClenny seconded to approve the consent agenda. Motion Carried.

 

Unfinished Business:

Mayor Colinas pulled consent agenda item A – the sewer disconnect for C.A. Strouss due to lack of information.

 

Mayor Colinas asked to move item 10A approving Ordinance 316.B forward. Mayor Colinas opened for consideration the approval of Ordinance #316.B addressing the budget amendment for 2005. There was council discussion correcting the name of the acting City Clerk-Treasurer. Councilmember McClenny moved and Councilmember Reinke seconded to approve ordinance 316.B addressing the budget amendment for 2005. Motion Carried.

 

Mayor Colinas opened for consideration the authorization to disperse funds in the amount of $102,192.08 for Colcurcio Construction retainage. Councilmember Reinke moved and Councilmember McClenny seconded to approve authorization for Mayor to disperse funds in the amount of $102,192.08 for Colcurcio Construction retainage. Motion Carried.

 

Councilmember Krienke stepped down from the table for the next item on the agenda.

There was council consensus for a ten minute recess to review supplemental information handed out at the council meeting at 8:00PM. The Council meeting resumed at 8:11PM.

Mayor Colinas opened for consideration the continuation of Preliminary Plat Hearing on Brier Glen III – Resolution No. 476 Subdivision #01-001 and Variance #V01-005, by MIR Enterprises, LLC, @ 214th and 34th Avenue W, by Vladan Milosavljevic. There was discussion. Councilmember McClenny moved and Councilmember Reinke seconded to continue Preliminary Plat Hearing on Brier Glen III – Resolution No. 476 Subdivision #01-001 and Variance #V01-005, by MIR Enterprises, LLC, @ 214th and 34th Avenue W, by Vladan Milosavljevic to the January 10, 2006 regular City Council meeting. Motion Carried. Councilmember Krienke returned to the council table.

 

Hearings:

Mayor Colinas opened the Public Hearing on business license #BR05-079 by Mr. Wally Kempe at 23631 Brier Road. Vladan Milosavlejevic – 23503 Brier Road - Supports the business license as the city needs extra revenue. Mayor Colinas closed the public hearing. There was council discussion. Councilmember Reinke moved and Councilmember McClenny seconded to approve business license #BR05-079 by Mr. Wally Kempe. Motion Carried.

 

New Business, Petitions, Communications, Applications & Appeals:

Mayor Colinas opened for discussion the community transit board appointment. Councilmember McClenny moved and Councilmember Reinke seconded to approve Councilmember Gipson as the Brier representative to the community transit board appointment. Motion Carried.

 

Miscellaneous Business By Call of Councilmembers & City Officials.

Councilmember Reinke thanked the council for all their help during her time on the council. Councilmember Gipson thanked Sasha and Ed for their years of service. He wishes both the best in their next endeavor. Councilmember Morgan thanked Sasha and Ed. Councilmember Morgan did have a question about Mike Bailey turning in his resignation with the effective date through January 6th, and what the plan for a City Clerk was. He also asked the capacity in which Paula Swisher was working for the City of Brier. Mayor Colinas responded she is working under the temporary salary ordinance. Councilmember McClenny thanked everyone and looks forward to seeing them around town.

 

Adjournment:

Councilmember Reinke moved and Councilmember McClenny seconded to adjourn. Mayor Colinas declared the meeting adjourned at 8:30PM.
