BRIER CITY COUNCIL MINUTES
April 3, 2007
Mayor Colinas called the regular Brier City Council
Meeting to order at 7:30 PM and the flag salute was given.
Roll Call:
Present: Councilmembers Krienke, Nick,
Kaemingk, Gipson, Corpron-Smith, Gem, and Morgan.
New
Business, Petitions, Communications, Applications & Appeals:
Mayor Colinas opened for Rod
Kaseguma’s-Presentation on “City Council Executive Sessions.” Kaseguma, the
City Attorney, began by distributing packets to the Council. He then continued
on to make the following notes:
- 42.31.10 lists the categories of topics that the Council can go
into Executive session to discuss.
- Section 42.30.140, shows quasi-judicial matters than can be
discussed in executive session. However, he said it would be better to discuss
many of the issues in an open meeting.
- The Council cannot take final action on anything during an
Executive session. He recommends that no consensus votes be taken unless
it is a matter relating to purchasing land, where it may be a benefit to
not make the availability of that land public.
- The Council and Mayor can invite anyone they want to an executive
session. The only time an attorney must be present is for litigation.
- During an executive session where sensitive documents are handed
out, the Council can decide that the documents need to be returned to the
consultant. However, if the Council trusts that this information will be
held confidential, they do not need to do this.
- He recommends that the Council be more specific at meetings when
announcing executive sessions during an open meeting. Mr. Kaseguma
recommends that the Council shortly state the statutes section and to
state why they are going into executive session.
- He pointed to page 19 of the pamphlet to explain when a Council
should go into executive session under the reason of “potential
litigation.”
- Under RCW 42.23 municipal officers are prohibited from disclosing
information discussed during executive sessions. Any information expressed
by the attorney or to an attorney falls under that attorney-client
privilege.
- City business emails written by officials, even from personal
addresses, are considered subject to open record.
Executive
Session
Mayor Colinas adjourned to executive session at
8:11 PM with legal council pursuant to RCW 42.30.110(1)(i) to discuss potential
litigation & potential litigation. The executive session will last
approximately one hour and fifteen minutes. Council returned at 9:30 PM.
Adjournment
Mayor Colinas adjourned to workshop at 9:30 PM.
