Mayor Colinas called the regular Brier City Council Meeting to order at 7:30 PM and the flag salute was given.

Roll Call:

PRESENT:                    Mayor Colinas, Councilmembers Corpron-Smith, Gipson, Krienke and Nick. Councilmember Morgan arrived at 7:35 PM, Councilmember Kaemingk arrived at 7:47 PM and Councilmember Gem arrived at 7:49 PM.

STAFF:                         Jim Cutts Community Development Director and Paula Swisher City Clerk-Treasurer.

Reports of Committees & City Officials:

Councilmember Krienke attended the May 16^th 2007, Planning Commission meeting.

Councilmember Gipson attended the Community Transit Budget and Finance Committee meeting on May 17^th 2007.

Approval of Minutes:

Mayor Colinas opened for consideration approval of the Brier City Council Workshop Minutes of May 15, 2007. Councilmember Corpron-Smith moved, seconded by Councilmember Krienke, to approve the Brier City Council Workshop Minutes of May 15, 2007. Motion carried unanimously.

Consent Agenda:

Mayor Colinas opened for consideration approval of the Consent Agenda which includes Brier City Council Minutes of May 8, 2007. Councilmember Gipson moved, seconded by Councilmember Corpron-Smith, to approve the Consent Agenda which includes Brier City Council Minutes of May 8, 2007. Motion carried unanimously.

Hearings:

Mayor Colinas opened the Public Hearing on Business License #BR07-029 by Amy Holowaty located at 2231 227^th Pl SW, Brier. Jim Cutts Community Development Director gave a brief overview and recommended approval. Amy Holowaty spoke about her Business License application. Mayor Colinas opened the Public Hearing. Councilmember Gipson moved, seconded by Councilmember Corpron-Smith to close the Public Hearing. Councilmember Corpron-Smith moved, seconded by Councilmember Nick, to approve Business License #BR07-029 by Amy Holowaty located at 2231 227^th Pl SW, Brier, as recommended. There was Council discussion. Motion carried unanimously.

New Business, Petitions, Communications, Applications & Appeals:

Mayor Colinas opened for consideration Planning Commission recommendation on Conditional Use Permit CU07-002 by John and Sue Neal located at 22830 27^th Ave W, Brier, for a secondary dwelling unit. Jim Cutts Community Development Director discussed the main points of the application and recommended approval.

Councilmember Krienke moved, seconded by Councilmember Nick, to accept the Planning Commission recommendation and approve Conditional Use Permit CU07-002 by John and Sue Neal located at 22830 27^th Ave W, Brier, for a secondary dwelling unit. Motion carried unanimously.

Mayor Colinas opened for discussion BMC clean-up work program. Jim Cutts Community Development Director discussed the work program and the discussion with the Planning Commission from last week. There was Council discussion. There was agreement by the Council to have a joint meeting with the Planning Commission on June 5, 2007, to discuss the work program further.

Executive Session Pursuant to RCW 42.30.110(1)(i) to Discuss Litigation

Mayor Colinas adjourned to executive session for 30 minutes. Council returned from executive session at 8:57 PM.

Councilmember Krienke moved, seconded by Councilmember Corpron-Smith to approve the First Amendment to the Retainer Agreement between the City and Oseran, Han, Spring & Watts, P.S., to authorize the Mayor to sign it, and to ratify and confirm all acts and services consistent with the First Amendment. Keeping in place the original stipulations of the original motion by the City Council approving the original retainer agreement.  Motion carried unanimously.

Miscellaneous Business by Call of Councilmembers & City Officials

Councilmember Gem attended the Library Board meeting on May 9^th 2007; they are in need of Board members as well as a Chairman.
