BRIER CITY COUNCIL MINUTES

December 11, 2007



Mayor Colinas called the regular Brier City Council Meeting to order at 7:39 PM and the flag salute was given. Meeting began late due to technical difficulties.

 

7:40:35 PM

PRESENT:        Mayor Colinas, Councilmember Corpron-Smith, Councilmember Gipson, Councilmember Kaemingk, Councilmember Morgan, Councilmember Nick and Councilmember Gem. Councilmember Krienke arrived at 8:25 PM

STAFF:             City Clerk-Treasurer Swisher and Police Chief Lane.

 

Public Requests & Oral Communications:

Fred Price 3408 214th St SW, wanted to bring forth to the Council that our 100 year storm has hit 214th again and the street was closed down for a full day.

 

Al Ross 3309 214th St SW, wanted to say some positive remarks about our Public Works staff for their efforts the day of the storm. He also wanted to thank Councilman Martin Krienke for his efforts in getting sandbags out right away. The tree on the north side of the street suffered from erosion due to the water being diverted onto it during the storm. He asked that a stash of sandbags be left out in case of another storm.

 

Reports of Committees & City Officials:

Councilmember Nick attended the South Counties dinner on Thursday. The hot topics were communication between the cities and county and annexations.

 

Councilmember Corpron-Smith attended the annual tree lighting along with several other members, the Park Board did a great job pulling it together.

 

Councilmember Kaemingk attended a South Snohomish Cities meeting on Nov. 29th to plan the meeting for Dec 6th dinner. He attended the dinner on the 6th as well. He reviewed the warrants on Dec. 9th.

 

Councilmember Gipson attended a Dec 5th Community Transit/City of Everett joint meeting. He attended the tree lighting and the snow was a great addition to the occasion.

 

Approval of Minutes:

Mayor Colinas opened for consideration approval of the Brier City Council Workshop Minutes of December 4, 2007. Councilmember Kaemingk moved and Councilmember Gem seconded to approve the Brier City Council Workshop Minutes of December 4, 2007. Motion Carried with Councilman Morgan abstained.

 

 

Consent Agenda:

Mayor Colinas opened for consideration approval of the Consent Agenda which includes Brier City Council Minutes of November 27, 2007 and release of Assignment of funds for Jim Campbell in the amount of $3,000.00, account #199-600400-7. Councilmember Gipson moved and Councilmember Nick seconded to approve the Consent Agenda which includes Brier City Council Minutes of November 27, 2007 and release of Assignment of funds for Jim Campbell in the amount of $3,000.00, account #199-600400-7. Motion Carried.

 

Hearings:

Mayor Colinas opened the Administrative Appeal Hearing for Robert Harris of 2705 234th St SW, Brier, regarding final determination of public nuisance.

 

Chief Lane gave a brief description of the facts regarding this appeal and the public nuisance determination.

 

Robert Harris of 2705 234th St. SW, took the oath. His concern for the determination is that some of the instances were reported at times when his dog was not let outside yet, and that there is another dog in the area that barks and he is concerned that these allegations are untrue.

 

Councilmember Corpron-Smith asked what changes Mr. Harris has made since the complaints. Mr. Harris answered that he has been putting the dog out later in the morning and trying to bring him in early when able. Councilmember Nick asked when he moved the dog into Brier. Mr. Harris answered July of this year. There was council discussion.

Councilmember Corpron-Smith moved and Councilmember Morgan seconded to deny Mr. Harris’ Administrative Appeal. Councilmember Gipson stated that he would have to vote against the motion but there have not been any further complaints since mid-September and believes they should ride this out longer to see if the issue has been abated. Councilmember Nick agrees with Councilmember Gipson and he feels that we should continue the appeal. 8:58:29 PM Motion carried.

 

Ordinances

Mayor Colinas opened for consideration approval of Ordinance 341.A amending the 2007 Budget. Councilmember Krienke moved, seconded by Councilmember Kaemingk, to approve Ordinance 341.A amending the 2007 Budget. Motion carried.

 

Miscellaneous Business by Call of Councilmembers & City Officials

Mayor Colinas opened for reconsideration the contract for Prosecution Services with Darrel Johnson to increase the amount to $2,250.00 per month. Councilmember Kaemingk moved, seconded by Councilmember Nick, to approve the contract with Darrel Johnson for Prosecution Services in the amount of $2,250.00 per month. Motion carried.

 

The Council thanked Councilmember Morgan for his work and help on the Council, as well as the history he brought to the group and the effort to his community.

 

Auditing of Accounts

Mayor Colinas opened for consideration approval of the November 2007 Payroll Warrants. Councilmember Kaemingk moved and Councilmember Gipson seconded to approve the November 2007 Payroll Warrants No. 14458 through No. 14515 in the amount of $111,641.86. Motion Carried.

 

Mayor Colinas opened for consideration approval of the November 2007 Claim Warrants.  Councilmember Kaemingk moved and Councilmember Corpron-Smith seconded to approve the November 2007 Claim Warrants No. 19390 through No. 19442 in the amount of $139,419.82. There was Council discussion. Motion Carried.

 

Adjournment

Councilmember Nick moved and Councilmember  Kaemingk seconded to adjourn. Mayor Colinas declared the meeting adjourned at 9:04 PM.
