BRIER CITY COUNCIL MINUTES
March 11, 2008
Mayor Pro-Tem Krienke called the regular Brier City
Council Meeting to order at 7:30:22 PM and
the flag salute was given.
Roll Call: 7:31:26 PM
PRESENT: Councilmember Corpron-Smith, Gem,
Kaemingk, Krienke, Nick and Steele.
ABSENT: Mayor Colinas; Councilmember Gipson.
STAFF: Dir. Comm. Dev. & Planning Cutts;
Clerk-Treasurer Swisher.

Councilman Nick reviewed the Claim warrants on
March 10, 2008.
Approval
of Minutes:
Mayor Pro-Tem Krienke opened for consideration approval of the Brier
City Council Workshop Minutes of March 4, 2008. Councilmember
Corpron-Smith made a MOTION to approve
the Brier City Council Workshop Minutes of March 4, 2008. Councilmember Steele SECONDED.
Motion Carried.
Consent
Agenda:
Mayor Pro-Tem Krienke opened for consideration approval of the Consent
Agenda which includes Brier City Council Minutes of February 26, 2008, approval
of Fuel Purchase from Snyder Oil. Co. up to $25,000.00, and approval for
release of the $3,000.00 Assignment of funds for Vern Deboo. Councilmember
Nick made a MOTION to approve the Consent Agenda which
includes Brier City Council Minutes of February 26, 2008; approval of Fuel
Purchase from Snyder Oil Co. up to $25,000.00; and approval for release of the
$3,000.00 Assignment of funds for Vern Deboo. Councilmember
Corpron-Smith SECONDED. Motion Carried.
Hearings:
Director of Community Development & Planning
Jim Cutts gave a brief overview of the application and the criteria associated
with the request.
Mayor Pro-Tem Krienke opened the Public Hearing at 7:45:01 PM on Business License #BR08-012 for 786 Towing,
by Mohammed Yusuf located at 23107 Brier Road, Brier.
Tim Irvine 23406 29th Ave W, he has two
properties right next to him that could bring in a business like this so he is
concerned. Criteria F. states there can be no outside appearance of a home
occupation. He believes this is not the type of business for our community.
Michael Atchison 23300 Brier Rd, he questions the
hours of operation, how many vehicles are allowed on the property, where are
the vehicles going to be parked, and who regulates the business.
Cheryl Wopperer 23022 Brier Rd, the tow truck is a safety hazard for neighbors crossing
the street to get their mail, 7:50:38 PM he has many cars parked in the back yard.
Keith Maw 2925 232nd St. SW, he lives on
the downhill side where they could be affected by run off from vehicles leaking
fluids.
Chuck Perry 23026 Brier Rd, he would like them to
consider that it is going to be difficult to do neighborhood watch with all the
traffic coming and going from this location.
John Engstrom 23101 Brier Rd, where is point A to B
for the business. What vehicles are allowed on the premises for the business?
He is concerned about the leaking of fluids from vehicles stored on the site as
well as people coming and going for their vehicles that have been towed.
Mrs. Engstorm 23101 Brier Rd, she is concerned
about the property values being affected by the condition his lot is kept in.
She handed out some pictures to the council.
Mahvash Nassiri 23108 Brier Rd, she has a hard time
getting out of her driveway from the crowding by the vehicles that he has
parked on the street around their homes, and the traffic that it will create is
a concern for her as well as property values.
Jeff Wigington 2955 232nd, stated he is
not a big proponent for what they are doing, but he believes that this City has
always allowed home businesses and we should keep that in perspective on this
issue. He doesn’t like the idea of a tow truck company next to his house but he
believes people have the right to make a living. 8:00:28 PM
Councilmember
Steele made a MOTION to close the Public Hearing at 8:03:42 PM. Councilmember
Gem SECONDED. There was council discussion.
Councilmember
Corpron-Smith made a MOTION to deny the business license #BR08-012 for
786 Towing, by
Mohammed Yusuf located at 23107 Brier Road, Brier. Councilmember Nick SECONDED. 8:10:56 PM Motion Carried 6-0, None abstained.
Miscellaneous
Business by Call of Councilmembers & City Officials
Councilmember Corpron-Smith reminded everyone of
the Easter Egg Hunt on March 22, 2008 at 10:00 AM.
Councilmember Kaemingk attended the South Snohomish
Cities meeting on Feb 28, they discussed land use issues and the potential of
creating a group like King County has to present their issues. This would be
staffed the Cities would share in the cost.
Auditing
of Accounts
Mayor Pro-Tem Krienke opened for consideration approval of the February
2008 Payroll Warrants. Councilmember Nick
made a MOTION to approve the February 2008 Payroll Warrants No. 14634
through No. 14690 in the amount of $107,925.57. Councilmember Corpron-Smith SECONDED. Motion Carried.
Mayor Pro-Tem Krienke opened for consideration approval of the February
2008 Claim Warrants. Councilmember
Nick made a MOTION to approve
the February 2008 Claim Warrants No. 19566 through No. 19625 in the amount of
$137,571.33. Councilmember
Kaemingk SECONDED. Motion
Carried.
Mayor Pro-Tem Krienke opened for consideration approval of January 2008
Checks No. 9566 through No. 9572 in the amount of $6,139.90. Councilmember
Nick made a MOTION to approve the
January 2008 Checks No. 9566 through No. 9572 in the amount of $6,139.90. Councilmember
Steele SECONDED. Motion
Carried.

Checks No. 9573 through No. 9576 in the amount of $272.00. Councilmember Nick made a MOTION to approve the February 2008 Checks
