BRIER CITY COUNCIL WORKSHOP MINUTES
April 8, 2008
Mayor Colinas called the regular Brier City Council
Meeting to order at 7:31:52 PM and
the flag salute was given.
Roll Call:
Present: Councilmembers Krienke, Nick,
Kaemingk, Gipson, Gem, and Steele.
Absent: Councilmember Corpron-Smith
Public
Requests & Oral Communications:
Al Ruttage - 7101 Lake Ballinger Way, Edmonds – He
wanted to let the Council know that the District Representative sent him a book
that stated The City of Brier had a City Manager, which is not the case. He
also wanted to let Council know that District 1 was going to make some changes
this year and the City should be aware of those changes and the changes with
Lake Ballinger.
Reports of
Committees & City Officials:
Councilmember Gem attended a Police Department
Meeting on March 26th, 2008. Councilmember Gipson attended a
Community Transit Board Meeting on March 6th, 2008. Mayor Colinas
gave Council a report on Brier’s Passport Services. Councilmember Steele had a
great experience acquiring a passport at City Hall. Councilmember Kaemingk
attended a South Snohomish Cities Meeting where they discussed TBD Tax
Benefiting Districts and were informed that Dinner with Legislators and City
Councilmember’s will be held September 25, 2008. Councilmember Nick reviewed
the warrants on April 4th, 2008.
Approval
of Minutes:
Mayor Colinas opened for consideration approval of
the Brier City Council Workshop Minutes of April 1, 2008. Councilmember Steele moved and Councilmember Gipson seconded to approve the Brier City
Council Workshop Minutes of April 1, 2008. Motion Carried.
Consent
Agenda:
Mayor Colinas opened for consideration approval of
the Consent Agenda which includes Brier City Council Minutes of March 25, 2008
and Brier City Council Workshop Minutes of March 25, 2008. Councilmember Kaemingk moved and Councilmember Steele seconded to
approve the Consent Agenda which includes Brier City Council Minutes of March
25, 2008 and Brier City Council Workshop Minutes of March 25, 2008.
Councilmember Gipson Abstained. Motion Carried.
New
Business, Petitions, Communications, Applications & Appeals:
Mayor Colinas opened for a presentation by Caldie
Rodgers, Military Families Friendly Initiative. Caldie Rodgers gave a brief
presentation on the benefits of hiring military spouse and encouraged the City
of Brier to participate in the Military Families Friendly Initiative. There was
council discussion.
Mayor Colinas opened for consideration approval of
Interlocal Cooperation Agreement with Snohomish County for Skateboard Park
Development. There was Council
Discussion. Councilmember Gipson moved
and Councilmember Nick seconded
to approve Interlocal Cooperation Agreement with Snohomish County for
Skateboard Park Development and authorize the Mayor’s Signature. Motion
Carried.
Miscellaneous
Business by Call of Councilmembers & City Officials
Recess to
Executive Session:
Councilmember
Krienke moved and Councilmember Steele seconded to
adjourned to Executive Session Pursuant to RCW 42.30.110(1) (i) to discuss
litigation. Motion Carried.
The meeting was recessed at 8:29pm to discuss
potential litigation for approximately 30 minutes.
The meeting convened at 9:02pm
Mayor Colinas opened for the Public Employment
Relations Commission Notice regarding Paul Grass to be read into the record.
Malia Zenk read into the record:
“THE WASHINGTON PUBLIC EMPLOYMENT RELATIONS COMMISSION
CONDUCTED A LEGAL PROCEEDING IN WHICH ALL PARTIES HAD THE OPPORTUNITY TO
PRESENT EVIDENCE AND ARGUMENT. THE COMMISSION RULED THAT WE COMMITTED UNFAIR
LABOR PRACTICES IN VIOLATION OF STATE COLLECTIVE BARGAINING LAWS, AND ORDERED
US TO POST NOTICE TO EMPLOYEES:
WE WILL TAKE THE FOLLOWING AFFIRMATIVE ACTION to
effectuate the purposes and policies of Chapter 41.56 RCW:
b.
Read this notice into the record at a regular public meeting of the City
Council of the City of Brier, and permanently append a copy of this notice is
read as required by this paragraph.
WE WILL NOT, in any other manner, interfere with,
restrain, or coerce our employees in the exercise of their collective
bargaining rights under the laws of the State of Washington.”
Councilmember
Krienke moved and Councilmember Gipson seconded to
approve the recommendations of the City’s Attorney on the Paul Grass ULP to
partially appeal the order of the Hearing’s Examiner as to the finding Mr.
Grass was terminated in retaliation for his union activities and his right to
reinstatement. The appeal is to include
the remaining portions of the findings that were not included in the reading of
April 8, 2008. Motion Carried.
Auditing
of Accounts
Mayor Colinas opened for consideration approval of
the March 2008 Payroll Warrants. Councilmember
Nick moved and Councilmember
Gem seconded to approve the March 2008 Payroll Warrants No. 14690
through No. 14745 in the amount of $105,956.98. Motion Carried.
Mayor Colinas opened for consideration approval of
the March 2008 Claim Warrants. Councilmember Nick moved and Councilmember Steele seconded to approve the March 2008
Claim Warrants No. 19626 through No. 19680 in the amount of $110,981.26. There
was Council discussion. Motion Carried.
Mayor Colinas opened for consideration approval of
the March 2008 Checks. Councilmember
Nick moved and Councilmember Krienke seconded
to approve the March 2008 Checks No. 9577 through No. 9590 in the amount of
$17,366.75. Motion Carried.
Councilmember Kaemingk will be absent at the next Brier
City Council Workshop Meeting of April 15, 2008 and will not be attending the
Planning Commission Meeting of April 16, 2008.
Councilmember Krienke volunteered to take his place at the Planning
Commission Meeting.

adjourn. Mayor Colinas declared the meeting adjourned at 9:18:30 PM
