BRIER CITY COUNCIL MINUTES

January 27, 2009

Mayor Colinas called the regular Brier City Council Meeting to order at 7:30:17 PM and the flag salute was given.

Roll Call:

PRESENT: Mayor Colinas; Councilmember Corpron-Smith, Gem, Gipson, Kaemingk, Krienke, Nick and Steele.

STAFF: Clerk-Treasurer Swisher.

Public Requests & Oral Communications:

Troy Metcalf 2604 228th, lives in the proposed annexation area and was curious to know if there would be a position for a liaison appointment for that area once annexed.

Ken Nilson 23826 28th Pl W, came to listen, he has been talking with Nicole Gaudette lately and was interested in what we do.

Reports of Committees & City Officials:

Councilmember Gem on January 14th attended the Police Department meeting. Councilmember Gipson will attend a CT executive meeting on Thursday, January 29th. Councilmember Steele on January 14th attended the Library Board meeting. On January 20th she met with Lyn Gross, Director of ESCA and attended the ESCA Board meeting on January 22nd. Councilmember Kaemingk will attend the South Snohomish Cities meeting Thursday, January 29th. Councilmember Nick came in on the 25th to view the claim warrants. Mayor Pro-Tem Krienke discussed his liaison appointments for the coming year and thanked the other Councilmembers for their hard work and effort.

Approval of Minutes:

Mayor Colinas opened for consideration approval of the Brier City Council Minutes of January 13, 2009. Councilmember Gipson made a MOTION to approve the Brier City Council Workshop Minutes of January 13, 2009. Councilmember Gem SECONDED. 7:46:38 PM Motion carried.

Mayor Colinas opened for consideration approval of the Brier City Council Workshop Minutes of January 20, 2009. Councilmember Corpron-Smith made a MOTION to approve Brier City Council Minutes of January 20, 2009 with the amendment to item #2. Councilmember Steele SECONDED. Motion Carried.

Consent Agenda:

Mayor Colinas opened for consideration authorization of the Mayor's signature on the In Kind Services Agreement with MTYAA. Councilmember Nick made a MOTION to approve authorization of the Mayor's signature on the In Kind Services Agreement with MTYAA. Councilmember Corpron-Smith SECONDED. Motion Carried.

New Business, Petitions, Communications, Applications & Appeals: Mayor Colinas opened for consideration the confirmation of the Mayor's appointment of Mary Anderson to the Library Board Position No. 2 term to expire December 31, 2012. Councilmember Steele made a MOTION to approve the Mayor's appointment of Mary Anderson to the Library Board Position No. 2 term to expire December 31, 2012. Councilmember Gipson SECONDED. Motion Carried.

Auditing of Accounts

Mayor Colinas opened for consideration approval of the January 2009 Claim Warrants. Councilmember Nick made a MOTION to approve the January 2009 Claim Warrants No. 20258 through No. 20271 in the amount of $359,716.50. Councilmember Corpron-Smith SECONDED. There was Council discussion. Motion Carried.

Miscellaneous Business by Call of Councilmembers & City Officials Mayor Colinas needs to get the sign for the skate park started and he wanted to make sure that the Council has an opportunity to discuss the rules and use options.

Execution Session

Mayor Colinas adjourned to Executive Session pursuant to RCW 42.30.110(1)(i) to discuss litigation for 60 minutes. Council returned at 8:47:59 PM.

Councilmember Krienke made a MOTION to approve and authorize the Mayor's signature of the "CR 2A Settlement Agreement" dated January 26th 2009 for Snohomish County Superior Court cause No. 07-2-03894-7 where the City of Brier was plaintiff and the defendant Thomas C. Evans. Councilmember Steele SECONDED. 8:48:49 PM Motion carried.

Adjournment

Councilmember Krienke made a MOTION to adjourn. Councilmember Corpron-Smith SECONDED. Mayor Colinas declared the meeting adjourned at 8:49:06 PM PM.
