Mayor Colinas called the Brier City Council Meeting to order at 7:31:23 PM  and dispensed with the flag salute.

Roll Call:                 

PRESENT:          Mayor Colinas; Councilmember Corpron-Smith, Gem, Gipson, Kaemingk, Krienke, Nick and Steele.

STAFF:          Clerk-Treasurer Swisher.

Public Requests & Oral Communications: None.

Reports of Committees & City Officials:

Councilmember Nick reviewed the claim warrants on February 8, 2009.

Councilmember Gipson attended the February 5th CT Board meeting, he was elected to Chairman of the Board, February 2^nd & 9^th he and the Mayor met with our local laborers union for contract negotiations.

Councilmember Gem attended the February 5^th Public Works meeting.

Approval of Minutes:

Mayor Colinas opened for consideration approval of the Brier City Council Minutes of January 27, 2009. Councilmember Gipson made a MOTION to approve the Brier City Council Workshop Minutes of January 27, 2009. Councilmember Gem SECONDED. Motion Carried.

Mayor Colinas opened for consideration approval of the Brier City Council Workshop Minutes of February 3, 2009. Councilmember Gem made a MOTION to approve Brier City Council Minutes of February 3, 2009. Councilmember Gipson SECONDED. Councilmember Krienke abstained. Motion Carried.

Ordinances, Resolutions & Orders:

Mayor Colinas opened for consideration approval of Resolution No. 446.A amending condition “R” of Section 13 in Resolution No. 446. Councilmember Gipson made a MOTION to approve of Resolution No. 446.A amending condition “R” of Section 13 of Resolution No. 446. Councilmember Steele SECONDED. Motion Carried.

Councilmember Krienke made a MOTION to amend Resolution 446.A, page 2, item 3 to state “The City has confirmed that the original Assignment of Funds for the subdivision dated June 6, 2006 in the amount of $37,350 will remain in effect until June 6, 2010 or until the City of Brier inspects and approves the final asphalt lift.” Councilmember Nick SECONDED. Motion Carried.

Executive Session

Councilmember Gipson made a MOTION to go into Executive Session for approximately 20 minutes pursuant to RCW 42.30.110(1)(g) to discuss personnel matters. Councilmember Krienke SECONDED. Motion Carried. Council returned at 8:37:08 PM.

Councilmember Gipson made a MOTION to approve and authorize the Mayor’s signature on the Agreement by and between the City of Brier and Laborers, Local 1239 for the years March 1, 2009 through February 28, 2012. Councilmember Corpron-Smith SECONDED. Motion Carried.

Miscellaneous Business by Call of Councilmembers & City Officials

Mayor Colinas was asked by the City of Lynnwood to request a letter of support from the City of Brier to extend Poplar Way up and over the freeway and have it drop into Alderwood Mall. There was Council discussion.

Auditing of Accounts

Mayor Colinas opened for consideration approval of the January 2009 Payroll Warrants. Councilmember Nick made a MOTION to approve the 2009 Payroll Warrants No.15278 through No.15333 in the amount of $119,929.48. Councilmember Kaemingk SECONDED. Motion Carried.

Mayor Colinas opened for consideration approval of the January 2009 Claim Warrants.  Councilmember Nick made a MOTION to approve the 2009 Claim Warrants No. 20272 through No. 20341 in the amount of $113,282.01 and voided Warrant No. 20257. Councilmember Corpron-Smith SECONDED. There was Council discussion. Motion Carried.

Mayor Colinas opened for consideration approval of the January 2009 Checks. Councilmember Nick made a MOTION to approve 2009 checks no. 9670 through no. 9675 in the amount of $9,918.60. Councilmember Corpron-Smith SECONDED. Motion Carried.
