BRIER CITY COUNCIL MINUTES

March 10, 2009


Mayor Colinas called the regular Brier City Council Meeting to order at 7:30:11 PM  and the flag salute was given.

 

Roll Call:                 

PRESENT:          Mayor Colinas; Councilmember Corpron-Smith, Kaemingk, Krienke, Nick and Steele. Councilmember Gem arrived at 7:31 PM.

ABSENT:          Councilmember Gipson.

STAFF:          Clerk-Treasurer Swisher.

 

Public Requests & Oral Communications: None.

 

Reports of Committees & City Officials:

Councilmember Steele attended SnoCom/SnoPac joint meeting on February 26th. She will meet with the Library Board tomorrow March 11th.

Councilmember Kaemingk attended South Snohomish Cities meeting on February 26th.

Councilmember Nick reviewed claim warrants on March 8th.

Councilmember Gem attended a Public Works meeting on March 2nd.

 

Approval of Minutes:

Mayor Colinas opened for consideration approval of the Brier City Council Minutes of February 24, 2009. Councilmember Steele made a MOTION to approve the Brier City Council Workshop Minutes of February 24, 2009. Councilmember Gem SECONDED. Motion Carried.

 

Mayor Colinas opened for consideration approval of the Brier City Council Workshop Minutes of March 3, 2009. Councilmember Corpron-Smith made a MOTION to approve Brier City Council Minutes of March 3, 2009. Councilmember Kaemingk SECONDED. Motion Carried.

 

Consent Agenda:

Mayor Colinas opened for consideration approval of the consent agenda which includes the release of Critchlow Homes bond No. 574774S in the amount of $17,805.00. Councilmember Kaemingk made a MOTION to approve the consent agenda which consists of the release of Critchlow Homes bond No. 574774S in the amount of $17,805.00. Councilmember Nick SECONDED. Motion Carried.

 

Hearings

Mayor Colinas opened for discussion the Business License #BR09-003 for Note Works, LLC by Neill Wine located at 21832 Vine Road and read into the record the staff report submitted by Nicole Gaudette, City Planner. The applicant Neill Wine gave a brief overview of his business and what it entails. Mayor Colinas opened the Public Hearing at 7:41:43 PM. Vladan Milosavljevic 23423 Brier Road, supports this business license. Councilmember Kaemingk made a MOTION to close the public hearing at 7:42:57 PM . Councilmember Steele SECONDED. Motion Carried.

 

Councilmember Krienke made a MOTION to approve Business License #BR09-003 for Note Works, LLC by Neill Wine located at 21832 Vine Road. Councilmember Gem SECONDED. Motion Carried.

 

Mayor Colinas opened the Public Hearing at 7:45:15 PM on Ordinance #363 amending Title 3 of the Brier Municipal Code. Vladan Milosavljevic 23423 Brier Road, felt that the public should be informed more thoroughly about changes that are going to be made. Councilmember Corpron-Smith made a MOTION to close the public hearing at 7:51:06 PM . Councilmember Steele SECONDED. Motion Carried.

 

Ordinances, Resolutions & Orders

Mayor Colinas opened for consideration the approval of Ordinance #363 adopting amendments to Title 3 of the Brier Municipal Code. Councilmember Corpron-Smith made a MOTION to approve Ordinance #363 adopting amendments to Title 3 of the Brier Municipal Code. Councilmember Nick SECONDED. Motion Carried.

 

Mayor Colinas opened for consideration approval of Resolution #511 adopting the new city fee schedule, amending fees and adding new segregation fees for assessments, Public Works equipment use & operation, fire permits, inspections and repealing Resolutions #505, 509 and 510. Councilmember Krienke made a MOTION to approve Resolution #511 adopting the new city fee schedule, amending fees and adding new segregation fees for assessments, Public Works equipment use & operation, fire permits, inspections and repealing Resolutions #505, 509 and 510. Councilmember Kaemingk SECONDED.

Motion Carried. 7:58:20 PM

 

Mayor Colinas opened for consideration approval of Resolution #512 adopting the identity theft prevention program. Councilmember Corpron-Smith made a MOTION to approve Resolution #512 adopting the identity theft prevention program. Councilmember Steele SECONDED. Motion Carried.

 

Mayor Colinas opened for consideration approval of Resolution #513 adopting the 38th LID 09-01. Councilmember Nick made a MOTION to approve Resolution #513 adopting the 38th LID 09-01. Councilmember Gem SECONDED. Motion Carried.

 

 

Miscellaneous Business by Call of Councilmembers & City Officials

Councilmember Krienke made a MOTION to approve the release and settlement agreement pertaining to the Snohomish County Superior Court Cause No. 07-2-03894-7 dated the 10th of March, 2009. Councilmember Steele SECONDED. Motion Carried.

 

Mayor Colinas discussed the email that was sent concerning the Brierwood sidewalks and the Mayor will be responding to the citizen’s concern.

 

Mayor Colinas asked what time the Council would like the dedication and opening of the skate park on April 18th, Council consensus was to have it at 11 AM.

 

Councilmember Kaemingk stated that September 24th will be the joint dinner with South Snohomish Cities & Towns and the main speaker will by Bob Drewel.8:10:41 PM

 

Councilmember Steele will not be in attendance at the next meeting.

 

Auditing of Accounts

Mayor Colinas opened for consideration approval of the February 2009 Payroll Warrants. Councilmember Nick made a MOTION to approve the February2009 Payroll Warrants No. 15334 through No. 15390 in the amount of $121,971.65. Councilmember Gem SECONDED. Motion Carried.

 

Mayor Colinas opened for consideration approval of the February 2009 Claim Warrants.  Councilmember Nick made a MOTION to approve the February 2009 Claim Warrants No. 20342 through No.20402 in the amount of $332,949.48. Councilmember Steele SECONDED. There was Council discussion. Motion Carried.

 

Mayor Colinas opened for consideration approval of the February 2009 Checks. Councilmember Nick made a MOTION to approve February 2009 checks no. 9676 through no. 9690 in the amount of $12,565.14. Councilmember Corpron-Smith SECONDED. Motion Carried.

 

Adjournment

Councilmember Corpron-Smith made a MOTION to adjourn. Councilmember Steele SECONDED. Mayor Colinas declared the meeting adjourned at 8:20:28 PM PM.
