BRIER CITY COUNCIL MINUTES
March 23, 2010
Mayor Colinas called the regular Brier City Council
Meeting to order at 7:30:14 PM and
the flag salute was given.

PRESENT: Mayor Colinas;
Councilmember Corpron-Smith, Kaemingk, Krienke, Steele, Gallagher, Olson and
Nick.
STAFF: Clerk-Treasurer
Swisher; City Planner Gaudette.

Requests & Oral Communications
Elizabeth Mooney 5934 NE 201st St Kenmore was here
as a representative of PERK in support of the variance for the Sunbrook Plat.
Peggy Dare 22320 Hickory Way commented that she is
excited to see Brier considering LID regulations for stormwater management and
additional new regulations.
Reports of
Committees & City Officials
Councilmember Krienke attended the March 10th
Park Board meeting where the annual Egg Hunt was the main topic of discussion.
Councilmember Steele attended the ESCA meeting on
March 11th and attended a March 10th meeting with the
Mayor and library manager in the morning and the Library Board meeting that
same evening.
Councilmember Kaemingk attended the March 2nd
CT Board meeting honoring our former Councilmember Gipson, on March 4th
he attended the South Snohomish Cities meeting, on March 17th he
attended the Planning Commission meeting and earlier today he attended a police
negotiations meeting.
Approval
of Minutes
Mayor Colinas opened for consideration approval of the Brier City
Council Minutes of March 9, 2010. Councilmember
Kaemingk made a MOTION to approve the Brier City Council Minutes
of March 9, 2010. Councilmember Krienke SECONDED.
Motion Carried.
Mayor Colinas opened for consideration approval of the Brier City
Council Minutes of March 16, 2010. Councilmember Nick
made a MOTION to approve the Brier City Council Minutes of March
16, 2010 as amended. Councilmember Corpron-Smith SECONDED.
Motion Carried.
Mayor Colinas opened for consideration approval of the Brier City Council
Workshop Minutes of March 16, 2010. Councilmember
Steele made a MOTION to approve Brier City Council Workshop
Minutes of March 16, 2010. Councilmember Kaemingk SECONDED.
Motion Carried.
Consent
Agenda
Mayor Colinas opened for consideration approval of the contract with the
Watershed Company for consulting services related to the review and update of
the critical areas ordinance. Councilmember Nick made
a MOTION to approve the contract with the Watershed Company for
consulting services related to the review and update of the critical areas
ordinance. Councilmember Olson SECONDED.
Council recessed for 5 minutes to get the corrected copy of the contract at 7:54:44 PM. The Council returned at 8:02:03 PM. Motion Carried.
Hearings
Mayor Colinas opened discussion of the Ordinance No. 377 relating to
NPDES Stormwater Regulations. City Planner Gaudette
gave an overview of the requirements. Mayor
Colinas opened the public hearing at 8:12:49 PM. Elizabeth Mooney 5934 NE 201st St Kenmore
stated that volunteers in Kenmore have been
working on cross jurisdictional meetings with the neighboring cities and she
volunteered to help with our public outreach. Peggy Dare 22320 Hickory Way she
is glad to see the changes that were made and wonders why this wasn’t put in
Title 12 under the drainage code and thinks it might be confusing, she would
like to see other changes made to Title 16 like the width of streets. Al Ross 3309 214th St SW
stated that the first he ever heard of NPDES was when he received a letter
dated January 4, 2010 requiring that homeowners in short plats of 4 homes or
less be responsible for the inspections of the stormwater system relating to
the NPDES requirements. Councilmember Kaemingk made a MOTION to close
the public hearing at 8:27:53 PM. Councilmember Olson SECONDED. Motion
Carried.
Mayor Colinas opened discussion on Plat Modification for SUB06-001 the Sunbrook
plat. City
Planner Gaudette gave an overview of the modification. Mayor Colinas offered
the applicant a chance to speak on the modification. Courtney Kaylor spoke on
behalf of the PDI. Mayor Colinas
opened the public hearing at 8:34:02 PM. Elizabeth Mooney 5934 NE 201st St Kenmore as a representative of PERK spoke in support of
the modification. Peggy Dare 22320 Hickory Way stated that the only
modification that she would like to see on this subdivision is that the NGPA
areas be made much larger. Councilmember Corpron-Smith made a MOTION to close
the public hearing at 8:40:18 PM. Councilmember Olson SECONDED. Motion
Carried.
New
Business, Petitions, Communications, Applications & Appeals
Mayor Colinas opened for consideration approval of Sunbrook Plat
Variance request. Councilmember Krienke made a MOTION
to approve variance V10-001 located at 24315 Brier Rd for the Sunbrook Plat.
Councilmember Nick SECONDED. There was Council discussion. Motion
Carried.
Mayor Colinas opened for consideration approval of Sunbrook Plat
Modification request. Councilmember Krienke made a MOTION
to approve the Sunbrook Plat Modification SUB06-001 located at 24315 Brier Road.
Councilmember Corpron-Smith SECONDED.
Motion Carried.
Ordinances,
Resolutions & Orders
Mayor Colinas opened for consideration adoption of Resolution No. 521
setting the date and time of the final assessment roll for LID #09-01. Councilmember Krienke made a MOTION to approve
adoption of Resolution No. 521 setting the date and time of the final
assessment roll for LID #09-01 for April 27, 2010 at 7:30 PM. Councilmember Steele SECONDED. There was
Council discussion. Motion Carried.
Mayor Colinas opened for consideration adoption of Ordinance No. 377
relating to NPDES Stormwater Regulations.
Councilmember Gallagher made a MOTION
to approve adoption of Ordinance No. 377 relating to NPDES Stormwater
Regulations. Councilmember Steele SECONDED. There was Council discussion. Councilmember Steele made a MOTION to amend the
original motion by replacing the wording of “director or designee” to “Mayor’s
designee” in all instances. Councilmember Corpron-Smith SECONDED. Motion Carried. The main motion as amended
Carried unanimously.

Councilmember Krienke reminded everyone the Easter
egg hunt is April 3rd.
Executive
Session Pursuant To RCW 42.30.110(1)(I) To Discuss Litigation.
Executive Session was not held.
Adjournment
Councilmember
Corpron-Smith made a MOTION to adjourn. Councilmember
Krienke SECONDED. Mayor Colinas declared the meeting adjourned at
9:01:33 PM.
