Mayor Colinas called the regular Brier City Council Meeting to order at 7:30:19 PM  and the flag salute was given.

Councilmember Steele reviewed the Warrants on April 11, 2010.

Councilmember Krienke commented on the great crowd that showed up for the Easter Egg Hunt.

Mayor Colinas wanted to let the Council know that Chief Lane is already preparing for National Night Out.

Approval of Minutes

Mayor Colinas opened for consideration approval of the Brier City Council Minutes of March 23, 2010. Councilmember Gallagher made a MOTION to approve the Brier City Council Minutes of March 23, 2010 as amended. Councilmember Steele SECONDED.

Motion Carried.

Mayor Colinas opened for consideration approval of the Brier City Council Workshop Minutes of April 6, 2010. Councilmember Nick made a MOTION to approve Brier City Council Workshop Minutes of April 6, 2010. Councilmember Krienke SECONDED.  Motion Carried.

Hearings

Mayor Colinas opened discussion of Ordinance No. 376 relating to Alcohol Licensing, amending Section 17.30.020.J of the Brier Municipal Code 7:37:25 PM.  City Planner Gaudette handed Council a written public comment from Dave Johnson, 2711 234^th St SW, Brier that stated his concerns with Ordinance No. 376, and an addendum to the City Staff Report. She gave an overview of the Staff Report and replied to the written public comment. Mayor Colinas opened the Public Hearing at 7:44:25 PM. Lori Nick, 23807 31st Pl W, Brier, stated she was in favor of Ordinance No. 376 and does not think it will have a negative impact on the neighborhood. Trisha Risner, 23902 48^th Ave W Mountlake Terrace, WA 98043, Co-Owner of Brier Pizza stated she was in favor of Ordinance No. 376. Shelly Magnuson, 2509 217^th Pl SW, Brier, stated she was in favor of Ordinance No. 376. Ken Overstreet, 24019 34^th PL W, Brier, stated he was in favor of Ordinance No. 376. Karla Woods, 21796 21^st Ave W, Brier stated she was in favor of Ordinance No. 376. Councilmember Steele made a MOTION to close the public hearing at 7:49:00 PM. Councilmember Olson SECONDED. Motion Carried.

Mayor Colinas opened discussion of Ordinance No. 378 relating to the Civil Penalty for violations of the Controlled Substances Act. Chief Lane gave an overview of the Civil Penalty for violations. Mayor Colinas opened the Public Hearing at 7:52:07 PM. Ken Overstreet, 24019 34^th Pl W, Brier spoke in favor of Ordinance No. 378. Councilmember Kaemingk made a MOTION to close the public hearing at 7:53:32 PM. Councilmember Gallagher SECONDED. Motion Carried.

Ordinances, Resolutions & Orders

Mayor Colinas opened for consideration adoption of Ordinance No. 376 relating to Alcohol Licensing, amending Section 17.30.020.J of the Brier Municipal Code. Councilmember Nick made a MOTION to approve adoption of Ordinance No. 376 relating to Alcohol Licensing, amending Section 17.30.020.J of the Brier Municipal Code. Councilmember Gallagher SECONDED. There was Council discussion. Councilmember Nick made a MOTION to amend the original motion by adding the word “spirits” into the language. Councilmember Gallagher SECONDED. Motion Carried. Mayor Colinas opened for consideration adoption of Resolution No. 516 incorporating the Council’s actions of March 23, 2010 modifying the Sunbrook Plat. Councilmember Olson made a MOTION to approve adoption of Resolution No. 516 incorporating the Council’s actions of March 23, 2010 modifying the Sunbrook Plat. Councilmember Nick SECONDED. Motion Carried.

Miscellaneous Business by Call of Councilmembers & City Officials

Councilmember Kaemingk wanted to know if Police Negotiations are moving.

Councilmember Gallagher will not be able to attend April 27^th meeting.

Auditing of Accounts

Mayor Colinas opened for consideration approval of the March 2010 Payroll Checks. Councilmember Steele made a MOTION to approve the March 2010 Payroll Checks No. 16991 through No. 17043 in the amount of $116,461.95.  Councilmember Gallagher SECONDED. Motion Carried.

Mayor Colinas opened for consideration approval of the March 2010 Claim Checks.  Councilmember Steele made a MOTION to approve the March 2010 Claim Checks No. 21384 through No. 21442 in the amount of $321,725.13. Councilmember Nick SECONDED. There was Council discussion. Motion Carried.

Councilmember Steele made a MOTION to approve March 2010 Checks No. 9810 through No. 9818 in the amount of $8,017.36. Councilmember Kaemingk SECONDED.

Executive Session Pursuant To RCW 42.30.110(1)(I) To Discuss Litigation.

Mayor Colinas excused Council for 30 minutes to Executive Session pursuant to RCW 42.30.110(1) (i) to discuss litigation.8:07:10 PM. Council reconvened at 8:43:05 PM. Councilmember Steele made a MOTION to approve the City of Brier to pay $12,000 of the settlement in Case 09-2-01822-5 pertaining to Lori Batiot. Councilmember Krienke SECONDED 8:44:08 PM. Councilmember Olson opposed. Motion Carried.
