BRIER CITY COUNCIL MINUTES

July 13, 2010

Mayor Colinas called the regular Brier City Council Meeting to order at 7:30:35 PM  and the flag salute was given.

 

Roll Call:                 

PRESENT:                                  Mayor Colinas; Councilmember Corpron-Smith, Kaemingk, Steele, Gallagher, Olson and Nick.

                                                  Councilmember Krienke arrived at 7:32 PM.

STAFF:                                       Clerk-Treasurer Swisher; City Planner Gaudette and City Building Inspector Eric Beverly.

 

Public Requests & Oral Communications:

Patty Fortuna 21905 34th Ave W, she noticed that City Hall needs some art and she is a local artist and would be interested in helping to provide art for the City.

 

Reports of Committees & City Officials:

Marc Olson attended the Police negotiations on July 10, 2010.

Councilmember Steele reviewed the Claims on July 11, 2010; in addition she attended the AWC RMSA board member meeting on June 24th in Olympia.

Councilmember Kaemingk hosted the South Snohomish Cities meeting on July 8th and attended the Police negotiations on July 10, 2010.

Councilmember Gallagher attended the July 8th elected rules and responsibility training in Darrington.

 

Approval of Minutes:

Mayor Colinas opened for consideration approval of the Brier City Council Minutes of June 22, 2010. Councilmember Gallagher made a MOTION to approve the Brier City Council Minutes of June 22, 2010. Councilmember Steele SECONDED. Motion Carried.

 

Mayor Colinas opened for consideration approval of the Brier City Council Workshop Minutes of July 6, 2010. Councilmember Nick made a MOTION to approve Brier City Council Workshop Minutes of July 6, 2010. Councilmember Olson SECONDED.  Motion Carried.

 

Hearings:

Mayor Colinas opened initial discussion for the Public Hearing on Home Occupation Business License BR10-040, for Sitka Services DBA Clara’s gifts by Michael McDade, located at 3503 223rd St SW. Michael McDade informed the Council of the nature of his business. City Planner Gaudette gave a brief overview of the application and her recommendation to approve. 

 

Mayor Colinas opened the Public Hearing at 7:42:12 PM. Councilmember Kaemingk made a MOTION to close the Public Hearing at 7:42:53 PM . Councilmember Steele SECONDED. Motion Carried. Councilmember Corpron-Smith made a MOTION to approve Home Occupation Business License BR10-040, for Sitka Services DBA Clara’s gifts by Michael McDade, located at 3503 223rd St SW. Councilmember Gallagher SECONDED. Motion Carried.

 

 

Mayor Colinas opened initial discussion for Public Hearing on Home Occupation Business License BR10-045, for BNT Sports by Brian Towne, located at 21815 36th Ave W. City Planner Gaudette gave a brief overview of the application and her recommendation to approve. Brian Towne discussed his business.

 

Mayor Colinas opened the Public Hearing at 7:49:37 PM. Councilmember Nick made a MOTION to close the Public Hearing at 7:50:24 PM. Councilmember Corpron-Smith SECONDED. Motion Carried. Councilmember Steele made a MOTION to approve Home Occupation Business License BR10-045, for BNT Sports by Brian Towne, located at 21815 36th Ave W. Councilmember Kaemingk SECONDED. Motion Carried.

City Planner Gaudette gave a brief overview of the application and her recommendation to approve. Patricia Forte Linna discussed her business.

 

Mayor Colinas opened the Public Hearing at 7:55:57 PM. Councilmember Corpron-Smith made a MOTION to close the Public Hearing at 7:56:24 PM. Councilmember Steele SECONDED. Motion Carried. Councilmember Nick made a MOTION to approve Home Occupation Business License BR10-046, Arte Forte by Patricia Forte Linna, located at 21905 34th Ave W. Councilmember Olson SECONDED. Motion Carried.

City Planner Gaudette gave a brief overview of the application and her recommendation to approve. James Linna discussed his commercial photography business.

 

Mayor Colinas opened the Public Hearing at 8:01:31 PM. Councilmember Kaemingk made a MOTION to close the Public Hearing at 8:01:58 PM . Councilmember Gallagher SECONDED. Motion Carried. Councilmember Krienke made a MOTION to approve Home Occupation Business License BR10-047, Linna Photographics, Inc. by James Greg Linna, located at 21905 34th Ave W. Councilmember Gallagher SECONDED. Motion Carried.

 

 

Mayor Colinas opened initial discussion for Public Hearing on Ordinance No. 379 relating to Grinder Pumps and amending sections 13.04.390 & 16.16.032. City Staff gave brief overview of the issue and a recommendation from the Planning Commission for approval.  Mayor Colinas opened the Public Hearing at 8:04:34 PM. Councilmember Krienke made a MOTION to close the Public Hearing at 8:05:15 PM . Councilmember Nick SECONDED. Motion Carried.

 

 

Mayor Colinas opened initial discussion for Public Hearing on Ordinance No. 380 amending title 15 relating to Building & Construction. City Building Inspector Beverly gave an accounting of the changes and the State mandates that governs the need for these changes. Fire Marshall Westfall discussed the fire code changes and updates. Mayor Colinas opened the Public Hearing at 8:09:46 PM .

 

Paul Chrysler 20929 36th Pl W, he is a realtor and is skeptical about the portion of the ordinance requiring sprinklers in 5000+ square foot homes; he believes that it will inevitably continue to be lowered and suggested that the Council reject that portion of the ordinance.

 

Mayor Colinas entered into the record a letter sent to the Council today dated July 13, 2010 from the Master Builders Association.

 

Ryan McIrvin, Government Affairs Director for the Snohomish County – Camano Association of Realtors, 3201 Broadway Suite E, Everett WA, he passed out a survey done by the association he represents and discussed the issues that they have with the inclusion of the portion of this ordinance requiring sprinklers in 5000+ square foot homes.

 

Michael McDade 3503 223rd St SW, he spoke in favor of requiring people who can afford 5000+ square foot homes can afford the additional expense of the fire sprinkler requirement and he is in favor of the passage of the ordinance.

 

Councilmember Corpron-Smith made a MOTION to close the Public Hearing at 8:23:56 PM . Councilmember Steele SECONDED. Motion Carried.

 

 

Mayor Colinas opened initial discussion for Public Hearing on Ordinance No. 381, relating to penalties for civil infractions, and amending section 1.28.030(C) of the Brier Municipal Code. Building Inspector Beverly gave a summary regarding the need for this ordinance.

 

Mayor Colinas opened the Public Hearing at 8:27:49 PM. Councilmember Krienke made a MOTION to close the Public Hearing at 8:28:25 PM. Councilmember Gallagher SECONDED. Motion Carried.

 

Ordinances, Resolutions & Orders:

Mayor Colinas opened for consideration approval of Ordinance No.379 relating to Grinder Pumps and amending sections 13.04.390 & 16.16.032. Councilmember Gallagher made a MOTION to approve Ordinance No.379 relating to Grinder Pumps and amending sections 13.04.390 & 16.16.032. Councilmember Olson SECONDED.

Motion Carried.

 

 

Mayor Colinas opened for consideration approval of Ordinance No. 380 amending Title 15 relating to Building & Construction. Councilmember Krienke made a MOTION to approve Ordinance No. 380 amending Title 15 relating to Building & Construction. Councilmember Nick SECONDED. Councilman Gallagher asked a few questions of the people in opposition to the approval of the ordinance. There was Council discussion. 9:00:37 PM Motion carried.

 

 

Mayor Colinas opened for consideration approval of Ordinance No. 381, relating to penalties for civil infractions, and amending section 1.28.030(C) of the Brier Municipal Code. Councilmember Corpron-Smith made a MOTION to approve Ordinance No. 381, relating to penalties for civil infractions, and amending section 1.28.030(C) of the Brier Municipal Code. Councilmember Steele SECONDED. Motion Carried.

 

 

Miscellaneous Business by Call of Councilmembers & City Officials:

Mayor Colinas questioned the Council as to whether they are interested in changing the processing of home occupation/business licenses. The Council agreed to discuss it in workshop in the near future.

 

Auditing of Accounts:

Mayor Colinas opened for consideration approval of the June 2010 Payroll Checks. Councilmember Steele made a MOTION to approve the June 2010 Payroll Checks No. 17152 through No. 17205 in the amount of $124,251.49 with Checks No. 17043, 16990 & 16937 being voided. Councilmember Olson SECONDED. Motion Carried.

 

Mayor Colinas opened for consideration approval of the June 2010 Claim Checks. Councilmember Steele made a MOTION to approve the June 2010 Claim Checks No. 21545 through No. 21620 in the amount of $447,142.23. Councilmember Nick SECONDED. Motion Carried.

 

Mayor Colinas opened for consideration the approval of the June 2010 Checks. Councilmember Steele made a MOTION to approve June 2010 Checks No. 9848 through No. 9855 in the amount of $11,043.12. Councilmember Gallagher SECONDED. Motion Carried.

 

Adjournment:

Councilmember Gallagher made a MOTION to adjourn. Councilmember Corpron-Smith SECONDED. Mayor Colinas declared the meeting adjourned at 9:10:03 PM.
