BRIER CITY COUNCIL MINUTES
December 14, 2010
Mayor Pro-Tem Krienke called the regular Brier City
Council Meeting to order at 7:30:54 PM and the flag salute was given.
Roll Call:
PRESENT: Councilmember
Kaemingk, Krienke, Steele, Gallagher, Olson and Nick. Councilmember
Corpron-Smith arrived at 7:51:54 PM.
ABSENT: Mayor Colinas.
STAFF: Clerk-Treasurer
Swisher.
Public
Requests & Oral Communications:
Christy Shue 23144 23rd Ave W,
new to Brier and has a small home run business. She feels the process is long
and time consuming and did not feel it should pertain to her business since she
goes to her clients.
Al Ross 3309
214th St SW handed out a diary that he
made of the events of the storm from last Sunday. He gave a brief synopsis of
his letter. He would like the City to consider increasing the size of the drain
pipe to accommodate these types of heavy rainfall.
Anne Peterson 21703 Oak Way is the current
president of board and gave a presentation regarding Concern for Neighbors Food
Bank. She discussed the current happenings at the food bank. They help people
within the Edmonds
School District with
electricity, rent, bus passes and gas cards. They currently have an open
position on their board of directors. In addition their director is retiring at
the end of the year so they are looking for someone to fill the position.
Executive
Session pursuant to RCW 42.30.11(1)(i) to discuss
litigation:
Mayor Pro-Tem Krienke called for an Executive
Session pursuant to RCW 42.30.11(1)(i) to discuss
litigation at 8:03:24 PM for 20 minutes. Council returned from
Executive Session at 8:25:22 PM.
Reports of
Committees & City Officials:
Councilmember Kaemingk attended
the mediation on Friday December 10th.
Councilmember Steele attended the mediation on
Friday December 10th; the Library Board on November 10th,
November 18th attended the AWC/RMSA board meeting and reviewed the
warrants on December 12th.
Councilmember Krienke attended the Parks Board
meeting on December 8th and attended the December 10th
mediation.
Several of the Councilmembers attended the tree
lighting on December 4th as well as the Fire Station grand opening
on December 11th.
Approval
of Minutes:
Mayor Pro-Tem Krienke opened for consideration approval of the Brier
City Council Minutes of November 23, 2010. Councilmember
Nick made a MOTION to approve the Brier City Council Minutes of
November 23, 2010. Councilmember Olson SECONDED.
Councilmembers Corpron-Smith and Steele abstained. Motion Carried.
Mayor Pro-Tem Krienke opened for consideration approval of the Brier
City Council Workshop Minutes of December 7, 2010. Councilmember
Nick made a MOTION to approve Brier City Council Workshop Minutes
of December 7, 2010. Councilmember Gallagher SECONDED.
Motion Carried.
Consent
Agenda:
Mayor Pro-Tem Krienke opened for consideration approval of
the Consent Agenda which includes the purchase of a new Server/Computer
Equipment from Dell in the amount of $9,257.98 and the appointment of Mark Lamb
of the City of Bothell,
to the Snohomish Health District Board for 2011. Councilmember Corpron-Smith
made a MOTION to approve the Consent Agenda as stated. Councilmember
Steele SECONDED. Motion Carried.
New Business:
Mayor Pro-Tem Krienke opened for consideration the
appointment of Linda Granholm-Meyers to position #6
of the Planning Commission with a term set to expire on July 31, 2012. Councilmember
Olson made a MOTION to approve the appointment of Linda Granholm-Meyers to position #6 of the Planning Commission
with a term set to expire on July 31, 2012. Councilmember Corpron-Smith SECONDED.
Motion Carried.
Ordinances,
Resolutions & Orders:
Mayor Pro-Tem Krienke opened for consideration approval of
revised Ordinance #382.A Planning Commission Guidelines. Councilmember Nick
made a MOTION to approve revised Ordinance #382.A Planning Commission
Guidelines. Councilmember Gallagher SECONDED. Motion Carried.
Miscellaneous
Business by Call of Councilmembers & City Officials:
Councilmember Kaemingk made a MOTION to approve the terms and conditions of the memorandum of
settlement entered on December 10, 2010, by the parties in the case of MIR
Enterprises, LLC, et al, vs. City of
Brier, U.S.
District Court case no. C09-1051RSL, and to approve the City contribution
toward the settlement in an amount up to $55, 000. Councilmember Steele SECONDED. Motion Carried.
Auditing
of Accounts:
Mayor Pro-Tem Krienke opened for consideration approval of the November 2010
Payroll Checks. Councilmember Steele made a MOTION
to approve the November 2010 Payroll Checks No. 17418 through No. 17473
in the amount of $128,779.40. Councilmember Gallagher
SECONDED. Motion Carried.
Mayor Pro-Tem Krienke opened for consideration approval of the November 2010
Claim Checks. Councilmember
Steele made a MOTION to approve the November 2010 Claim Checks
No. 21851 through No. 21917 in the amount of $171,037.92. Councilmember Corpron-Smith SECONDED. Motion Carried.
Mayor Pro-Tem Krienke opened for consideration approval of the November 2010
Checks. Councilmember Steele made a MOTION to approve
November 2010 Checks No. 9904 through No. 9912
in the amount of $50,176.69. Councilmember Nick SECONDED. Motion
Carried.
Adjournment:
