BRIER CITY COUNCIL MINUTES

April 12, 2011

Mayor Pro-Tem Krienke called the regular Brier City Council Meeting to order at 7:30:10 PM and the flag salute was given.

 

Roll Call:                 

PRESENT:                                  Councilmember Kaemingk, Krienke, Gallagher, Olson and Nick. Councilmember Corpron-Smith arrived at 7:32:17 PM.

ABSENT:                                    Mayor Colinas and Councilmember Steele.

STAFF:                                       Clerk-Treasurer Swisher; City Planner Gaudette.

 

Public Requests & Oral Communications:

Julie O’Donnell 3404 Russet Road, is here for the Brier Wildlife Habitat Team working toward getting Brier certified as a Wildlife Habitat Community.

 

Peggy Dare 22320 Hickory Way feels that you need to be heard before a public hearing to have your comments effect the change in an ordinance. Doesn’t like what the changes in the proposed ordinance for animals is being changed to and believes we should keep the purpose section that is in the current code.

 

Gus Dorati 2805 216th St SW he encouraged the council to educate themselves by going on the internet and look at how things are changing all over the world in the care and stabling for horses.

 

Joyce Bell 21500 Poplar Way has lived here since Brier began and is so proud that her family helped begin Brier to preserve the rural atmosphere. She hopes we can be different here to keep it rural and not over populated.

 

Carol Lavelle 3020 Russet Road stated wouldn’t it be great if we could limit the size of houses on our lots instead of limiting the size of the animals allowed per lot. She is concerned about how our changes will affect Brier’s future. Please keep our rural setting.

 

Janelle Berkman 21809 Vine Road grew up here and moved back here to raise their daughter because they didn’t like Everett or Edmonds and they hope it doesn’t change.

 

Gail DiBernardo 22613 23rd Pl W moved here because of the horses for the rural feel; doesn’t have horses but has met a ton of people because of the horses and they unite the community. She hopes that the people who live here will have a say in the character of this community and not people who don’t even live here.

 

Barbara Podeszwik 23504 29th Ave W concerned about the proposal for the livestock code and believes the code is outdated for urban areas today. She believes that the code is based on a lack of education. She offered to take anyone from the City on a tour of where her horses are housed and share her knowledge on the subject. She was asked about a list of people in the Brier Horse Network and stated she would get a list together and send it to us by the end of the week.

 

Jim Dare 22320 Hickory Way first time coming to a council meeting. The big difference he feels is that the new animal code eliminates the ability for exceptions to the requirements. Anything that limits homes for horses is a detriment to the horses. He would like to see the City have another workshop to give the public the opportunity to address their concerns.

 

Angela Acheson 23009 Brier Rd is not a horse owner but had a neighbor who was and she never had an issue with them. She would rather live next to a horse than one of the homes with six cars and garbage out front. Loves where she lives and hopes it stays the way it is.

 

Reports of Committees & City Officials:

Councilmember Olson participated in Police negotiations on March 24th.

 

Approval of Minutes:

Mayor Pro-Tem Krienke opened for consideration approval of the Brier City Council Minutes of March 22, 2011. Councilmember Nick made a MOTION to approve the Brier City Council Minutes of March 22, 2011. Councilmember Corpron-Smith SECONDED. Motion Carried.

 

Mayor Pro-Tem Krienke opened for consideration approval of the Brier City Council Workshop Minutes of April 5, 2011. Councilmember Olson made a MOTION to approve Brier City Council Workshop Minutes of April 5, 2011. Councilmember Kaemingk SECONDED. Motion Carried. Councilmember Nick abstained.

 

Consent Agenda:

Mayor Pro-Tem Krienke opened for consideration approval of the Pre-Interlocal agreement with WCIA. Councilmember Nick made a MOTION to approve Pre-Interlocal agreement with WCIA. Councilmember Olson SECONDED. Motion Carried.

 

Hearings:

Mayor Pro-Tem Krienke opened the initial discussion for the public hearing on Business License #BR11-031 for Diana’s Daycare located at 23916 29th Ave W, Brier, by Tatyana Klimenko. City Planner Nicole Gaudette gave a brief overview of the application and recommended approval. Mayor Pro-Tem Krienke opened the Public Hearing at 8:16:39 PM. Councilmember Olson made a MOTION to close the Public Hearing at 8:17:04 PM. Councilmember Nick SECONDED. Motion Carried. Councilmember Corpron-Smith made a MOTION to approve Business License #BR11-031 for Diana’s Daycare located at 23916 29th Ave W, Brier, by Tatyana Klimenko. Councilmember Kaemingk SECONDED.  There was Council discussion. Motion Carried.

 

Mayor Pro-Tem Krienke opened the initial discussion for the public hearing on Business License #BR11-032 for Coram Theo Corporation located at 21355 Poplar Way, Brier, by Han Kyu Choi. City Planner Nicole Gaudette gave a brief overview of the application and recommended approval. Mayor Pro-Tem Krienke opened the Public Hearing at 8:22:09 PM. Councilmember Corpron-Smith made a MOTION to close the Public Hearing at 8:22:51 PM. Councilmember Gallagher SECONDED. Motion Carried. Councilmember Gallagher made a MOTION to approve Business License #BR11-032 for Coram Theo Corporation located at 21355 Poplar Way, Brier, by Han Kyu Choi. Councilmember Corpron-Smith SECONDED. Motion Carried.

 

 

Miscellaneous Business by Call of Councilmembers & City Officials:

Councilmember Olson made a MOTION to authorize the Mayor’s signature on the 2011-2012 Snohomish Regional Drug & Gang Task Force Interlocal Agreement. Councilmember Nick SECONDED. Motion Carried.

 

Councilmember Nick made a MOTION to cancel the April 19, 2011 workshop meeting. Councilmember Olson SECONDED. Motion Carried.

 

Mayor Pro-Tem Krienke reminded everyone that the annual egg hunt is April 23rd.

 

Councilmember Olson thanked Nicole he thinks she gets an unfair rap and things she says are misrepresented by others and he appreciates her efforts.

 

Councilmember Kaemingk gave an update on the Regional Fire Authority. The Mayor Councilmember Krienke and he have all been assigned to subcommittees.

 

Councilmember Gallagher will be absent on April 26th.

 

Auditing of Accounts:

Mayor Pro-Tem Krienke opened for consideration approval of the March 2011 Payroll Checks. Councilmember Nick made a MOTION to approve the March 2011 Payroll Checks No. 17630 through No. 17682 in the amount of $121,899.05. Councilmember Corpron-Smith SECONDED. Motion Carried.

 

Mayor Pro-Tem Krienke opened for consideration approval of the March 2011 Claim Checks.  Councilmember Nick made a MOTION to approve the March 2011 Claim Checks No. 22109 through No. 22184 in the amount of $392,856.43. Councilmember Olson SECONDED. Motion Carried.

 

Mayor Pro-Tem Krienke opened for consideration approval of the March 2011 Checks. Councilmember Nick made a MOTION to approve March 2011 Checks No. 9946 through No. 9952 in the amount of $8,259.91 with Check No. 9948 being voided. Councilmember Gallagher SECONDED. Motion Carried.

 

Adjournment:

Councilmember Corpron-Smith made a MOTION to adjourn. Councilmember Olson SECONDED. Mayor Pro-Tem Krienke adjourned the meeting at 8:39:09 PM.
