BRIER CITY COUNCIL MINUTES
June 28, 2011
Mayor Colinas called the regular Brier City Council
Meeting to order at 7:30:14 PM and the flag salute was given.
Roll Call:
PRESENT: Mayor Colinas;
Councilmember Corpron-Smith, Krienke, Steele, Gallagher, Olson and Nick.
ABSENT: Councilmember
Kaemingk.
STAFF: Clerk-Treasurer
Swisher; City Planner Gaudette.
Public
Requests & Oral Communications:
John Vorga 22928 25th Ave W
lives in the Allview
Heights area, he is
concerned about a rumor going around his neighborhood about the lot sizes for
the potential annexation area. He is concerned about the fact that
Councilmember Gallagher purchased the property next door to him and real estate
people have been going around talking to people stating that cottage housing is
proposed in that area.
Karen Burkett 22928 25th Ave W lives in the Allview
Heights area, she is
concerned that a vote was taken a few weeks ago regarding something to do with
annexation area and they were not informed.

Approval
of Minutes:
Mayor Colinas opened for consideration approval of the Brier City
Council Minutes of June 14, 2011. Councilmember Nick
made a MOTION to approve the Brier City Council Minutes of June
14, 2011. Councilmember Krienke SECONDED. Motion
Carried.
Mayor Colinas opened for consideration approval of the Brier City Council
Workshop Minutes of June 21, 2011. Councilmember Nick
made a MOTION to approve Brier City Council Workshop Minutes of
June 21, 2011. Councilmember Krienke SECONDED.
Motion Carried with Councilmembers Olson & Steele abstaining.
Consent
Agenda:
Mayor Colinas opened for consideration approval of the consent agenda
which includes approval of the Gray & Osborne proposal for the 214th street
culvert replacement design and the amendment to the Interlocal agreement with
the City of Everett and Snohomish County
Cities for in-service
training. Councilmember Steele made a MOTION

Hearings:
Mayor Colinas opened the initial discussion for the Business
License #BR11-049 for Green Forest Quality Finish located at 3509 217th St SW, Brier, by Anatoliy Borenko. City Planner Nicole Gaudette gave a
brief overview of the application and recommended approval. Mayor Colinas
opened the Public Hearing at 7:59:23 PM. Mayor Colinas closed
the Public Hearing at 8:00:16 PM. Councilmember Krienke made a MOTION
to approve Business License #BR11-049 for Green Forest Quality Finish located
at 3509 217th St SW,
Brier, by Anatoliy Borenko.
Councilmember Olson SECONDED. Motion
Carried.
Mayor Colinas opened the initial discussion on Ordinance No.
388 relating to Electric Vehicle Infrastructure and Regulations affecting the
neighborhood business zone amending section 17.04.040 and chapter 17.30 of the
Brier Municipal Code. City Planner Gaudette gave a brief summary of the ordinance changes. Mayor
Colinas opened the Public Hearing at 8:04:04 PM. Mayor Colinas closed
the Public Hearing at 8:05:02 PM.
Mayor Colinas announced that the Public Hearing on Zoning
in the Allview Annexation
area is going to be postponed. Mayor Colinas called a recess at 8:06:48 PM for 10 minutes to pick a date certain for the
continuation of the hearing. At 8:16:34 PM the meeting reconvened. Councilmember Krienke
made a MOTION to move the Public Hearing on the Zoning in the Allview Annexation Area to a date certain of October 11,
2011. Councilmember Nick SECONDED. There was Council discussion. Motion Carried.
New
Business, Petitions, Communications, Applications & Appeals:
Mayor Colinas opened for consideration the Planning
Commission’s recommendation for approval of Variance 11-001 by Seattle Pacific
Homes located at 3055 215th
Pl SW. City Planner Gaudette gave a brief overview
of the variance request. Councilmember Corpron-Smith made a MOTION to approve
the Planning Commission’s recommendation for approval of Variance 11-001 by
Seattle Pacific Homes located at 3055
215th Pl SW. Councilmember Steele SECONDED.
There was Council discussion. Motion Carried.
Ordinances,
Resolutions & Orders:
Mayor Colinas opened for consideration the decision
regarding Ordinance
No. 388 relating to Electric Vehicle Infrastructure and Regulations affecting
the neighborhood business zone and amending section 17.04.040 and chapter 17.30
of the Brier Municipal Code. Councilmember Steele made a MOTION

Miscellaneous
Business by Call of Councilmembers & City Officials:
Mayor Colinas asked the Council to consider cancelling the July 5th
workshop meeting. Councilmember Olson made a MOTION
to cancel the July 5th council workshop meeting. Councilmember
Steele SECONDED. Motion Carried.
Clerk-Treasurer Swisher shared the good news that we
received approval from Genworth Life Insurance that
our LEOFF I retiree has been approved for long term disability insurance. She
asked that the Council authorize the payment of a full year’s premium. Councilmember
Corpron-Smith made a MOTION to authorize the
remainder of the full yearly payment to Genworth Life
Insurance Company for long term disability on our LEOFF I retiree in the amount
of $5,587.15. Councilmember Steele SECONDED. Motion Carried.

Mayor Colinas adjourned the meeting at 8:46:53 PM.
