BRIER CITY COUNCIL MINUTES

December 13, 2011


Mayor Colinas called the regular Brier City Council Meeting to order at 7:31:17 PM  and the flag salute was given.

 

Roll Call:                 

PRESENT:                                  Mayor Colinas; Councilmember Corpron-Smith, Kaemingk, Krienke, Steele, Gallagher, Joplin and Olson.

STAFF:                                       Clerk-Treasurer Swisher; City Planner Gaudette.

 

Public Requests & Oral Communications: None.

 

Reports of Committees & City Officials:

Councilmember Krienke attended the November 30th RFA meeting and the RFA Level of Service meeting on December 8th.

Councilmember Steele reviewed the claim checks on December 11th.

 

Approval of Minutes:

Mayor Colinas opened for consideration approval of the Brier City Council Minutes of November 22, 2011. Councilmember Kaemingk made a MOTION to approve the Brier City Council Minutes of November 22, 2011. Councilmember Olson SECONDED. Motion Carried. Councilmember Joplin abstained.

 

Hearings:

Clerk-Treasurer Swisher gave a brief overview of the amendment. Mayor Colinas opened the Public Hearing on Ordinance No. 386.A amending the 2011 Operating Budget at 7:36:00 PM.   Mayor Colinas closed the Public Hearing at 7:36:44 PM.

 

Mayor Colinas opened for discussion the Public Hearing on Ordinance No. 391 amending Business Licensing. City Planner Gaudette gave a brief overview. Mayor Colinas opened the Public Hearing at 7:39:03 PM. Mayor Colinas closed the Public Hearing at 7:39:45 PM.

 

Mayor Colinas opened for discussion the Public Hearing on Ordinance No. 395 amending Stormwater Charges at 7:41:26 PM. Dave Johnson 2711 236th St SW, how long did it take the State Auditor to catch that we had this practice. Mayor Colinas closed the Public Hearing at 7:42:31 PM .

 

Mayor Colinas opened the Public Hearing on Ordinance No. 396 amending Sewer Charges at 7:43:33 PM. Mayor Colinas closed the Public Hearing at 7:44:11 PM.

 

Mayor Colinas opened for discussion the Public Hearing on Ordinance No. 397 regarding the Allview Annexation Zoning. City Planner Gaudette gave a brief overview. Mayor Colinas opened the Public Hearing at 7:51:17 PM.

 

Vladan Milosavljevic 23005 27th Ave W, stated that he represents a whole list of investors that do not want to be annexed into the City of Brier; he claims that he was not informed of the hearing and none of the other investors were notified as well.

Karen Burfet 22928 25th Ave W, wanted to confirm that this ordinance would set the zoning at 12,500 sq ft lots.

Dave Johnson 2711 236th St SW his perception is that there is a density problem in Brier.

John Borga 22928 wants to thank us for keeping the larger lot sizes and keeping the character of the neighborhood the same.

Tom Mohle 22907 25th Ave W, he bought into Brier because it was a rural community and did not have high density.

Theodore Cox 22929  , wanted to know what the reasoning for the larger lot sizes were, he’s been there a long time and would like things to stay the way they are.

Tim Nesseth 2210 Allview Way, he is for the larger lot size and he likes the way things are and keeps the traffic flow down.

Mayor Colinas closed the Public Hearing at 8:00:09 PM.

 

Ordinances, Resolutions & Orders:

Mayor Colinas opened for consideration the decision regarding Ordinance No. 386.A amending the 2011 Operating Budget. Councilmember Krienke made a MOTION to approve Ordinance No. 386.A amending the 2011 Operating Budget. Councilmember Steele SECONDED. Motion Carried

 

Mayor Colinas opened for consideration the decision regarding Ordinance No. 391 amending Business Licensing. Councilmember Steele made a MOTION to approve Ordinance No. 391 amending Business Licensing. Councilmember Gallagher SECONDED. Motion Carried

 

Mayor Colinas opened for consideration the decision regarding Ordinance No. 395 amending Stormwater Charges. Councilmember Gallagher made a MOTION to approve Ordinance No. 395 amending Stormwater Charges. Councilmember Krienke SECONDED. Motion Carried

 

Mayor Colinas opened for consideration the decision regarding Ordinance No. 396 amending Sewer Charges. Councilmember Krienke made a MOTION to approve Ordinance No. 396 amending Sewer Charges. Councilmember Corpron-Smith SECONDED. Motion Carried.

 

Mayor Colinas opened for consideration the decision regarding Ordinance No. 397 regarding the Allview Annexation Zoning. Councilmember Corpron-Smith made a MOTION to approve Ordinance No. 397 regarding the Allview Annexation Zoning. Councilmember Steele SECONDED. Motion Carried. Councilmember Gallagher recused himself as he is a property owner in the area.

 

Mayor Colinas opened for consideration the decision regarding Resolution No. 531 for the Wynbrook Subdivision Preliminary Plat. City Planner Gaudette gave a brief overview of the project. Councilmember Krienke made a MOTION to approve Ordinance No. 531 for the Wynbrook Subdivision Preliminary Plat. Councilmember Corpron-Smith SECONDED. There was Council discussion. Mayor Colinas called for a 5 minute recess at 8:17:40 PM. The Council meeting resumed at 8:23:55 PM. Motion Carried.

 

Miscellaneous Business by Call of Councilmembers & City Officials:

Councilmember Olson noted that Councilmember Elect Nick was in the audience tonight.

Councilmember Kaemingk was approached by Councilman Terry Ryan of Mill Creek requesting that our Interlocal Agreement for representation to the Snohomish County Health Board with Mill Creek and Bothell be changed to make Mill Creek the next representative to the Snohomish County Health Board.

Councilmember Steele asked if anyone knew what PUD was doing in front of her home with all the big trucks. It appears to others that it was a pole change out.

Councilmember Corpron-Smith respectfully resigned her seat as of today December 13, 2011 to allow for continuity by having Councilmember Elect Dennis Nick take the seat.

Councilmember Olson made a MOTION to appoint Councilman Elect Dennis Nick to finish the term for postion #6 through the remainder of this year. Councilmember Joplin SECONDED. Motion Carried.

Councilmember Steele wanted to state for the record that all of the compliments that Councilmember Corpron-Smith paid to the City can be turned right back to her as she was a part of that success.

 

Auditing of Accounts:

Mayor Colinas opened for consideration approval of the 2011 Payroll Warrants. Councilmember Steele made a MOTION to approve the November 2011 Payroll Warrants No. 18085 through No. 18139 in the amount of $133,746.53. Councilmember Gallagher SECONDED. Motion Carried.

 

Mayor Colinas opened for consideration approval of the November 2011 Claim Warrants.  Councilmember Steele made a MOTION to approve the November 2011 Claim Warrants No.22578 through No. 22641 in the amount of $128,065.34, with Check No. 22472 being voided. Councilmember Corpron-Smith SECONDED. Motion Carried.

 

Mayor Colinas opened for consideration approval of the November 2011 Checks. Councilmember Steele made a MOTION to approve 2011 Checks No. 10020 through No. 10026 in the amount of $56,010.38, with Check no. 10023 being voided. Councilmember Corpron-Smith SECONDED. Motion Carried.

 

Mayor Colinas declared the meeting adjourned to Executive Session with Attorney Carol Morris Pursuit to RCW 42.30 110(1)(i) to discuss potential litigation via telephone for approximately 15 minutes at 9:09:28 PM; there will be no action taken afterwards.
