BRIER CITY COUNCIL MINUTES

March 27, 2012

Mayor Colinas called the regular Brier City Council Meeting to order at 7:00:16 PM  and the flag salute was given.

 

Roll Call:                 

PRESENT:                                  Mayor Colinas; Councilmember Kaemingk, Krienke, Steele, Gallagher, Olson, Nick and Joplin.

STAFF:                                       Clerk-Treasurer Swisher; City Planner Gaudette.

 

Public Requests & Oral Communications:

Mayor Colinas introduced a local Girl Scout troop 42215, 41095, 40011 and a proclamation declaring March 2012 Year of the Girl was read into the record.

Mayor Colinas called a 5 minute recess to take photos with the Girl Scouts at 7:08:11 PM. Mayor Colinas returned at 7:11:13 PM.

 

Gail DiBernardo Brier, WA, gave an update on the Brier Wildlife Habitat Project and the upcoming native plant sale.

Julie O’Donnell Brier, WA, discussed some of the new cities certified as wildlife habitats and gave detail about the requirements for getting certified. The native plant sale is from 10AM – 3PM on April 21st.

 

Reports of Committees & City Officials:

Councilmember Nick attended the March 14th Parks Board meeting.

Councilmember Krienke attended the March 7th General RFA committee meeting and the March 14th Library Board meeting. He recommended that we put in the new bathroom floors at the Library that they have been asking for.

Councilmember Steele attended the March 22nd Snohomish County Conservation District Awards Reception and the City of Brier received a partnership award.

Councilmember Kaemingk attended the March 21st RFA Finance meeting and the Planning Commission meeting that same evening.

 

Approval of Minutes:

Mayor Colinas opened for consideration approval of the Brier City Council Minutes of, March 13, 2012. Councilmember Nick made a MOTION to approve the Brier City Council Minutes of March 13, 2012. Councilmember Kaemingk SECONDED. Motion Carried with Councilmember Gallagher abstaining.

 

Hearings:

Mayor Colinas opened the initial discussion for the Business License #BR12-024 for Evergreen Landscape Management, Inc., located at 23825 35th Ave W Brier, by Forrest Lemme. City Planner Nicole Gaudette gave a brief overview of the application and recommended approval. Mr. Lemme gave some background on his reasons for moving his business to Brier. Mayor Colinas opened the Public Hearing at 7:40:50 PM. All public had left prior to the hearing. Mayor Colinas closed the Public Hearing at 7:41:38 PM. Councilmember Steele made a MOTION to approve Business License # BR12-024 for Evergreen Landscape Management, Inc. located at 23825 35th Ave W Brier, by Forrest Lemme. Councilmember Krienke SECONDED. There was Council discussion. Councilmember Olson made a MOTION to table the issue until the dog issue is resolved. None SECONDED. The motion dies for lack of a second. Motion Carried with Councilmember Olson opposed.

 

New Business, Petitions, Communications, Applications & Appeals:

Mayor Colinas opened the discussion on the release of Sunbrook bonds. Councilmember Gallagher made a MOTION to release the Tree Performance Assurance Bond, Tree Protection Assurance Bond and Landscaping, Parks & Wetland Mitigation Bonds for the Sunbrook Plat. Councilmember Kaemingk SECONDED. Motion Carried.

 

Executive Session:

Mayor Colinas adjourned to Executive Session for 25 minutes to conference via phone with special city attorney Dale Kamerrer pursuit to RCW 42.30.110(1)(d) to discuss potential litigation and pursuit to RCW 42.30.140(1)(d) to discuss collective bargaining negotiations at 8:07 PM.  Mayor Colinas extended the Executive Session to 8:50 PM. The Council returned from Executive Session at 8:50:17 PM.

 

Miscellaneous Business by Call of Councilmembers & City Officials:

Mayor Colinas reported that the CJTC sent us letter stating that our Police Department has met the yearly requirements for training. In addition, he discussed the letter that the City of Brier is sending to  the City of Bothell for the changing of the MUGA boundary to put the mobile home park all within one MUGA boundary.

 

The Kenmore/Brier/Watershed Company settlement agreement and the consultant services contract not to exceed $3,685 to be split 50/50 with the City of Kenmore were handed out and reviewed for approval. Councilmember Gallagher made a MOTION to authorize the Mayor’s signature on the settlement agreement with the City of Kenmore and the consultant agreement with the Watershed Company. Councilmember Olson SECONDED. Motion Carried.

 

Councilmember Steele will attend the ESCA meeting on Thursday, March 29th.

 

Adjournment:

Councilmember Olson made a MOTION to adjourn. Councilmember Nick SECONDED. Motion Carried. Mayor Colinas declared the meeting adjourned at 8:57:34 PM.
