Mayor Colinas called the regular Brier City Council Meeting to order at 7:00:35 PM and the flag salute was given.

ABSENT:                                    Councilmember Joplin.

STAFF:                                       Clerk-Treasurer Swisher.

Reports of Committees & City Officials:

Councilmember Kaemingk will be attending the RFA meeting tomorrow evening in Lynnwood.

Councilmember Steele came in on September 9^th to review the claims and attended a Budget committee meeting for the ESCA board today.

Approval of Minutes:

Mayor Colinas opened for consideration approval of the Brier City Council Minutes of August 28, 2012. Councilmember Gallagher made a MOTION to approve the Brier City Council Minutes of August 28, 2012. Councilmember Kaemingk SECONDED. Motion Carried.

Mayor Colinas opened for consideration approval of the Brier City Council Workshop Minutes of September 4, 2012. Councilmember Nick made a MOTION to approve the Brier City Council Workshop Minutes of September 4, 2012. Councilmember Gallagher SECONDED. Motion Carried. Councilmembers Steele and Olson abstained.

Consent Agenda:

Mayor Colinas opened for consideration the authorization of Storm Sewer Basin cleaning in an amount not to exceed $10,000.00 to Innovac. Councilmember Gallagher made a MOTION to approve authorization of Storm Sewer Basin cleaning in an amount not to exceed $10,000.00 to Innovac. Councilmember Steele SECONDED. Motion Carried.

Miscellaneous Business by Call of Councilmembers & City Officials:

Mayor Colinas opened for discussion the refund request from New Cingular Wireless for utility tax overpayment. Councilmember Gallagher made a MOTION to authorize the City Attorney to enter into settlement negotiations with New Cingular Wireless in an amount not to exceed $12,267.48 and work to have the amount refunded as a credit to future payments. Councilmember Steele SECONDED. Motion Carried.

Mayor Colinas opened for discussion the expiring agreement with PAWS.

Mayor Colinas opened for discussion the font change proposal from Code Publishing. The Council direction was to ask a representative from Code Publishing to come speak to the issue at a future meeting.

Mayor Colinas opened for discussion the draft Ordinance 394.A to amend the 2012 budget.

Mayor Colinas discussed the upcoming RFA meeting and the issues that he felt would be of concern to the Council.

Councilmember Gallagher made a MOTION to cancel the Brier City Council Workshop meeting of September 18, 2012. Councilmember Nick SECONDED. Motion Carried.

Councilmember Nick has a Park Board meeting tomorrow evening and had a few questions about the Locust Creek Park project and the trenching for the new holiday lighting for the tree in Brier Park.

Councilmember Gallagher asked if the City had anything to add to the Library time capsule.

Auditing of Accounts:

Mayor Colinas opened for consideration approval of the August 2012 Payroll Checks. Councilmember Steele made a MOTION to approve the August 2012 Payroll Checks No. 18620 through No. 18677 in the amount of $124,207.00 with Checks No. 18630 thru No. 18635 being voided. Councilmember Nick SECONDED. Motion Carried.

Mayor Colinas opened for consideration approval of the August 2012 Claim Checks.  Councilmember Steele made a MOTION to approve the August 2012 Claim Checks No. 23129 through No. 23179 in the amount of $97,565.48. Councilmember Krienke SECONDED. Motion Carried.

Mayor Colinas opened for consideration approval of the August 2012 Checks. Councilmember Steele made a MOTION to approve August 2012 Checks No. 10084 through No. 10092 in the amount of $12,385.55. Councilmember Gallagher SECONDED. Motion Carried.
