Mayor Colinas called the regular Brier City Council Meeting to order at 7:00:25 PM and the flag salute was given.

Roll Call:                 

PRESENT:                                  Mayor Colinas, Councilmember Kaemingk, Steele, Gallagher, Olson and Nick. Councilmember Krienke arrived at 7:04:58 PM.

ABSENT:                                    Councilmember Joplin.

STAFF:                                       Clerk-Treasurer Swisher.

Reports of Committees & City Officials:

Councilmember Steele reviewed the Claim checks on January 6^th.

Approval of Minutes:

Mayor Colinas opened for consideration approval of the Brier City Council Minutes of December 11, 2012. Councilmember Nick made a MOTION to approve the Brier City Council Minutes of December 11, 2012. Councilmember Olson SECONDED. Motion Carried.

Mayor Colinas opened for consideration approval of the Brier City Council Workshop Minutes of December 18, 2012. Councilmember Steele made a MOTION to approve Brier City Council Workshop Minutes of December 18, 2012. Councilmember Gallagher SECONDED. Motion Carried.

Hearings:

Mayor Colinas opened the initial discussion for the Business License #BR12-095 for Intensity Fastpitch, Inc., located at 3416 238^th St SW Brier, by Randell Seidlitz. Randell Seidlitz gave a brief description of his business. Mayor Colinas opened the Public Hearing at 7:10:23 PM.

Barbara Ramey 24003 34^th Pl W, lives directly behind the home and opposes the business for three reasons; it interferes with her husband’s sleep as he goes to work at 4am; they cannot enjoy their backyard and have to close their windows and doors in the evenings to try to block out the persistent noise; finally they believe it will effect the resale value of their home.

Kelly Vedders 3412 238^th St, requested that specific guidelines be set for the business and that the parking issue be kept under control with clients kept on the West side of the easement driveway if there is overflow from the allotted parking spaces.

Mayor Colinas closed the Public Hearing at 7:16:19 PM. There was Council discussion. Councilmember Kaemingk made a MOTION to deny Business License #BR12-095 for Intensity Fastpitch, Inc., located at 3416 238^th St SW Brier, by Randell Seidlitz. Councilmember Olson SECONDED. Motion Carried.

Councilmember Steele made a MOTION to have Mr. Seidlitz rework his application with City Planner Gaudette and resubmit with no fees to him. Councilmember Krienke SECONDED. Motion Carried.

New Business, Petitions, Communications, Applications & Appeals:

Mayor Colinas opened for consideration the review of the Fuel Storage Tank Liability Insurance renewal and authorization of the Mayor’s signature and payment for the two year premium in the amount of $1,128.00. Councilmember Krienke made a MOTION to approve the Fuel Storage Tank Liability Insurance renewal and authorization of the Mayor’s signature and payment for the two year premium in the amount of $1,128.00. Councilmember Nick SECONDED. Motion Carried.

Consideration of BIDS, L.I.D.S & Related Matters:

Mayor Colinas opened for consideration the review of the contract and scope of work with Pace Engineering for the Scriber Creek Bridge replacement project. Councilmember Kaemingk made a MOTION to approve the contract and scope of work with Pace Engineering for the Scriber Creek Bridge replacement project with an amount not to exceed $100,000. Councilmember Olson SECONDED. Motion Carried.

Miscellaneous Business by Call of Councilmembers & City Officials:

Councilmember Nick made a MOTION to appoint Martin Krienke as Mayor Pro-Tem for the year 2013. Councilmember Gallagher SECONDED. Motion Carried.

Mayor Colinas informed the Council that he and Chief Lane are in the process of hiring a sixth officer.

Mayor Colinas reported that we are still in interest arbitration with the Police Union.

Auditing of Accounts:

Mayor Colinas opened for consideration approval of the December 2012 Payroll Checks. Councilmember Steele made a MOTION to approve the December 2012 Payroll Checks No. 25095 through No. 25148 in the amount of $114,013.02 with Check No. 25139 being voided. Councilmember Gallagher SECONDED. Motion Carried.

Mayor Colinas opened for consideration approval of the December 2012 Claim Checks.  Councilmember Steele made a MOTION to approve the December 2012 Claim Checks No. 25150 through No. 25199 in the amount of $93,343.80. Councilmember Krienke SECONDED. Motion Carried.

Mayor Colinas opened for consideration approval of the December 2012 Checks. Councilmember Steele made a MOTION to approve December 2012 Checks No. 10119 through No. 10122 in the amount of $5,602.88 with Check No. 10118 being voided. Councilmember Nick SECONDED. Motion Carried.
