Mayor Colinas called the regular Brier City Council Meeting to order at 7:12PM and the flag salute was dispensed with.

ABSENT:                                    Councilmember Joplin.

STAFF:                                       Clerk-Treasurer Swisher.

Reports of Committees & City Officials:

Councilmember Kaemingk attended the RFA meeting on February 6^th.

Councilmember Steele on January 24^th attended the ESCA meeting and on January 31^st attended the Pre-Audit meeting for ESCA. In addition she reviewed the claims on February 9^th.

Councilmember Krienke attended the RFA meeting on February 6^th.

Approval of Minutes:

Mayor Colinas opened for consideration approval of the Brier City Council Minutes of January 22, 2013. Councilmember Steele made a MOTION to approve the Brier City Council Minutes of January 22, 2013. Councilmember Nick SECONDED. Motion Carried with Councilmember Olson abstaining.

Mayor Colinas opened for consideration approval of the Brier City Council Workshop Minutes of February 5, 2013. Councilmember Gallagher made a MOTION to approve Brier City Council Workshop Minutes of February 5, 2013. Councilmember Kaemingk SECONDED. Motion Carried.

Consent Agenda:

Mayor Colinas opened for consideration approval of the Consent Agenda which includes approval of the Snohomish County Regional Drug Task Force Interlocal Agreement, approval of the Interlocal Agreement with Snohomish County for Overlays, and approval of the Interlocal Agreement with the City of Mountlake Terrace for Improvements along 228^th Street. Councilmember Kaemingk made a MOTION to approve the consent agenda as stated. Councilmember Gallagher SECONDED. Motion Carried.

Hearings:

Mayor Colinas opened the Public Hearing on Ordinance No. 409, relating to Athletic Facility Use Regulations and Amending Chapter 12.16 at 7:17:53 PM. There was no public present and with no objection from the Council the Public Hearing was closed at 7:18:16 PM.

New Business, Petitions, Communications, Applications & Appeals:

Mayor Colinas opened for consideration authorization for the Mayor to purchase fuel in an amount not to exceed $40,000.00. Councilmember Olson made a MOTION to approve authorization for the Mayor to purchase fuel in an amount not to exceed $40,000.00. Councilmember Nick SECONDED. Motion Carried.

Mayor Colinas postponed the consideration regarding the purchase of a new replacement police vehicle.

Ordinances, Resolutions & Orders:

Mayor Colinas opened for consideration approval of Ordinance No. 409, relating to Athletic Facility Use Regulations and Amending Chapter 12.16. Councilmember Nick made a MOTION to approve Ordinance No. 409, relating to Athletic Facility Use Regulations and Amending Chapter 12.16. Councilmember Olson SECONDED. Motion Carried.

Miscellaneous Business by Call of Councilmembers & City Officials:

Councilmember Gallagher made a MOTION to cancel the Brier City Council Workshop meeting of February 19, 2013. Councilmember Steele SECONDED. Motion Carried.

Councilmember Nick made a MOTION to approve the expenditure for the Parks Board Easter Egg Hunt in an amount not to exceed $1,000. Councilmember Steele SECONDED. Motion Carried.

Auditing of Accounts:

Mayor Colinas opened for consideration approval of the January 2013 Payroll Checks. Councilmember Steele made a MOTION to approve the January 2013 Payroll Checks No. 25200 through No. 25216 and No. 25224 through No. 25256 in the amount of $119,606.87 with Checks No. 25087 and No. 25143 being voided. Councilmember Krienke SECONDED. Motion Carried.

Mayor Colinas opened for consideration approval of the January 2013 Claim Checks. Councilmember Steele made a MOTION to approve the January 2013 Claim Checks No. 25217 through No. 25223, No. 25257 through No. 25261, and No. 25280 through No. 25361 in the amount of $587,822.20, with Check No. 25362 being voided. Councilmember Gallagher SECONDED. Motion Carried.
