BRIER CITY COUNCIL MINUTES

April 28, 2015

Mayor Colinas called the regular Brier City Council Meeting to order at 7:00:27 PM and the flag salute was given.

 

Roll Call:

PRESENT:                                  Mayor Colinas; Councilmember Gallagher, Joplin, Kaemingk, Krienke, Nick, Olson and Steele.

STAFF:                                       City Clerk-Treasurer Swisher; City Planner Gaudette.

  

Public Requests & Oral Communications: None.

 

Reports of Committees & City Officials:

Councilmember Steele attended the ESCA meeting on April 23rd.

 

Approval of Minutes:

Mayor Colinas opened for consideration approval of the Brier City Council Minutes of April 14, 2015. Councilmember Nick made a MOTION to approve the Brier City Council Minutes of April 14, 2015. Councilmember Olson SECONDED. Motion Carried.

 

Public Hearings:

Mayor Colinas opened discussion regarding the business license #BR15-010 for Brier Small Engine Repair by John Holt located at 23000 35th Ave W. Mayor Colinas asked City Planner Gaudette to give a brief overview of the business license application. City Planner Gaudette recommended approval with the conditions listed in the staff report.  Mayor Colinas opened the public hearing at 7:08:59 PM.

 

Elaine Sivey, Brier, has concerns about the exterior evidence of the business being conducted, wants the additional mowers contained within the business portion of the home and she’s also concerned about additional traffic.

 

Sonya Joudi, Brier, has concerns about the noise and traffic, and how often will the city inspect the business; she feels that the burden to document and call in with complaints is put on the neighbors; this is a residence and a residential neighborhood; what kind of signage will be allowed and how this might affect her property value if a business is evident.

 

Louis Coy, Brier, he is favor of the business license. He feels that if you drive around the town that there are other houses that look worse than this home. He thinks this town needs a small business like this.

 

Mark Cortezzo, Brier, he has some of the same concerns as the other people. He feels it is the wrong type of business in a residential zone and would be better suited in the business zone. There is exterior evidence of the business. It increases traffic and is close to the school.

 

Pete Wickstrom, Brier, he is for the business. He has driven this community and seen lots of places with broken down mowers, rusted play sets, old cars etc. he thinks this is a positive thing for this community.

 

Alex Desharnais, Brier, his father has run a small business out of their home for 15 years and he is in favor of the business and likes being able to have their equipment worked on right down the street.

 

Dan Sivey, Brier, he is for small business but his biggest concern is that it is in a residential area. He is concerned about having lawn mowers, blowers etc. being lined up in the front yard for sale and it will become an eyesore.

 

Mayor Colinas closed the public hearing at 7:23:17 PM.

 

There was Council discussion. Councilmember Kaemingk made a MOTION to approve business license #BR15-010 for Brier Small Engine Repair with the conditions as stated in the staff report. Councilmember Steele SECONDED. Motion Carried.

Councilmember Steele made a MOTION to amend the original motion and add a condition #6 no outside storage or evidence of the business from the street. Councilmember Kaemingk SECONDED. Motion Carried.

Councilmember Joplin suggested that a change to condition #5 be made to state a 365 day period to clear up confusion.

 

Mayor Colinas called for a two minute recess to give the people here for the business license hearing an opportunity to exit if they did not wish to hang around for the rest of the meeting. Mayor Colinas called the meeting back to order at 7:40:57 PM.

 

Mayor Colinas began the discussion on Ordinance #423 and asked City Planner Gaudette to give a brief report on the issue. Mayor Colinas opened the public hearing for Ordinance #423 annexing the area known as the North Castle Way Annexation Area and setting an effective date at 7:46:13 PM.

 

Tom Hansen, North Castle Way, is happy their taxes are going down, they are getting better fire and police coverage.

 

Mayor Colinas closed the public hearing at 7:47:15 PM.


New Business

Mayor Colinas called for an Executive Session pursuit to RCW 42.30.110(1)(d) to discuss the labor update for collective bargaining of the SEIU laborers contract for approximately 20 minutes at 7:55 PM. The meeting resumed at 8:15:14 PM.

 

Councilmember Gallagher made a MOTION to approve the SEIU laborers contract and authorize the Mayor’s signature. Councilmember Joplin SECONDED. Motion Carried.

 

Ordinances, Resolutions & Orders

Mayor Colinas opened for consideration Ordinance #423 adopting the North Castle Way annexation area. Councilmember Nick made a MOTION to approve Ordinance #423 adopting the North Castle Way annexation area and setting an effective date. Councilmember Joplin SECONDED. Motion Carried.

 

Miscellaneous Business by Call of Councilmembers & City Officials

Councilmember Gallagher will be absent the next two weeks for personal reasons. He would like us to consider enhancing our business zone.

 

Councilmember Steele reported that ESCA board members are negotiating with Snohomish County DEM for emergency services.
