BRIER CITY COUNCIL MINUTES

July 14, 2015



Mayor Colinas called the regular Brier City Council Meeting to order at 7:00:27 PM and the flag salute was given.

 

Roll Call:

PRESENT:                                  Mayor Colinas; Councilmember Gallagher, Joplin, Kaemingk, Krienke, Nick, Olson and Steele.

STAFF:                                       City Clerk-Treasurer Swisher; City Planner Gaudette.

      

Public Requests & Oral Communications:

Bob Thorpe, Brier, stated recently there has been a lot of discussion on the internet community boards that say due to the Interlocal Agreement between Brier and Mountlake Terrace for emergency police services that one of our officers was fired and he wanted to know if this were true. Mayor Colinas stated this was rumor and incorrect.

 

Bill Davidson, Brier, has a concern about the police department and would like to know if the police department would be absorbed into Mountlake Terrace or will continue to operate as it has.

 

Tony Corrado, Brier, wants to know if there will be any future discussion about whether there will be fireworks banned in the future. He also stated his support for our Brier Police.

 

Jackie Hodgen, Brier, she was very concerned about fireworks this year. She would like to propose that the city enlist a permit to light off fireworks and utilize the money to hire additional patrols to monitor the activity. She would like to see us identify the vulnerable population in our area to help them during this activity; including veterans who suffer from PTSD and help get the signs to put in their yards. She would like to see us institute an emergency provision for drought situations like we had this year. She stated that their neighborhood experienced people who do not live here driving into Brier and just setting up on a street and lighting off fireworks.

 

Stephanie McCardle, Brier, agrees with what Jackie Hodgen had to say. She added that she believes that the problems that everyone is experiencing are the things that are already illegal, lighting them off on days other than the 4th of July, using illegal fireworks, setting them off after midnight. She proposes doubling the fines for the illegal activities and utilizing the money to hire more patrols.

 

Jackie Segal, Brier, stated that she does not enjoy the 4th of July in Brier and she believes that the 4th of July is miserable for many people because the fireworks scare their animals.

 

Ken Yohe, Brier, stated he understands the logistics of having fireworks; he believes that if we changed it to where our officers could cite people for possession of illegal fireworks instead of having to see the person light them off that it would help with the issues that everyone is expressing concerns over.

 

Reports of Committees & City Officials:

Councilmember Nick attended the July 8th Park Board meeting.

Councilmember Steele reviewed the claim checks on July 12th and attended the ESCA volunteer picnic on July 11th; she is continuing to look at the idea of a pooch patrol; she is working with an ESCA volunteer who wants to be a certified walking ambassador with Feet First.

Councilmember Joplin attended the July 14th Snohomish Health District Board meeting; they discussed that they are taking a poll about vaping, they also discussed the funding of the Health District in the future.

 

Approval of Minutes:

Mayor Colinas opened for consideration approval of the Brier City Council Minutes of June 23, 2015. Councilmember Nick made a MOTION to approve the Brier City Council Minutes of June 23, 2015. Councilmember Kaemingk SECONDED. Motion Carried.

 

Mayor Colinas opened for consideration approval of the Brier City Council Workshop Minutes of July 7, 2015. Councilmember Steele made a MOTION to approve the Brier City Council Workshop Minutes of July 7, 2015. Councilmember Joplin SECONDED.

Motion Carried.

 

Consent Agenda:

Mayor Colinas opened for consideration the authorization to purchase a John Deere 2025 Tractor not to exceed $22,000. Authorization includes the surplus and trade in of a 1985 Case 580 backhoe. Councilmember Steele made a MOTION to approve the purchase of a John Deere 2025 Tractor not to exceed $22,000. Authorization includes the surplus and trade in of a 1985 Case 580 backhoe. Councilmember Nick SECONDED. Motion Carried.

 

Public Hearings:

Mayor Colinas opened discussion regarding the Public Hearing on Ordinance No. 424, adopting the 2015 Comprehensive Plan. City Planner Gaudette gave a brief overview of the changes to the Comprehensive Plan.

Mayor Colinas opened the Public Hearing on Ordinance No. 424 at 7:45:30 PM.

Mayor Colinas closed the Public Hearing at 7:46:25 PM.

 

Ordinances, Resolutions & Orders

Mayor Colinas asked if the Council would entertain a motion for approval of Ordinance No. 424, adopting the 2015 Comprehensive Plan. Councilmember Kaemingk made a MOTION to approve Ordinance No. 424, adopting the 2015 Comprehensive Plan. Councilmember Gallagher SECONDED. Councilmember Steele thanked the Planning Commission for their hard work on the Comprehensive Plan. Motion Carried.

 

 

Miscellaneous Business by Call of Councilmembers & City Officials

Mayor Colinas informed the Council that an appeal has been received for a code enforcement issue regarding a noise nuisance involving a rooster and they must choose if they wish to hear the issue or appoint a hearing examiner.

 

Mayor Colinas asked for a 5 minute recess to confer with the City Clerk at 7:52:22 PM. The meeting reconvened at 7:58:45 PM.

 

Councilmember Gallagher made a MOTION to have the City Council hear the appeal. Councilmember Steele SECONDED. Motion Carried.

 

Mayor Colinas stated that we could cancel next week’s workshop meeting due to lack of business. Councilmember Olson made a MOTION to cancel the Brier City Council Workshop meeting of July 21, 2015. Councilmember Nick SECONDED. Motion Carried.

 

Councilmember Nick stated that an idea was presented at the Park Board meeting to have a tennis ball exchange program at the tennis courts and the person volunteered to oversee the logistics if the City approved.

 

Auditing of Accounts:

Mayor Colinas opened for consideration approval of the June 2015 Payroll Checks. Councilmember Steele made a MOTION to approve the June 2015 Payroll Checks No. 28814 through No. 28832 and No. 28839 through No. 28873 in the amount of $141,044.99. Councilmember Gallagher SECONDED. Motion Carried.

 

Mayor Colinas opened for consideration approval of the June 2015 Claim Checks.  Councilmember Steele made a MOTION to approve the June 2015 Claim Checks No. 28833 through No. 28838, No. 28874 through No. 28876 and No. 28897 through No. 28970 in the amount of $436,998.72. Councilmember Nick SECONDED. Motion Carried.

Mayor Colinas declared the meeting adjourned to the workshop meeting at 8:06:10 PM .
