BRIER CITY COUNCIL MINUTES

June 14, 2016

Mayor Colinas called the regular Brier City Council Meeting to order at  7:00:30 PM and the flag salute was given.

 

Roll Call:

PRESENT:                                  Mayor Colinas; Councilmember Gallagher, Joplin, Kaemingk, Krienke, Nick, Olson and Steele.

STAFF:                                       City Clerk-Treasurer Swisher.

 

Public Requests & Oral Communications:

Rick Crosby, Northend Holdings LLC, representing the Fisken Short Plat – stated that he asked City staff to request the Council to change how far back a few of the houses in the plat are set back to reduce the length of the driveway and keep the homes more in-line with the current homes; one of the properties driveway is 90’ long; he is asking that the Council reconsider the building requirements that would place the homes that far back.

 

Austin Davis, Brier –has some concerns about safety at an intersection near his home and would like to have the speed reduced from 25 MPH because they have a lot of children that play in their neighborhood; he’d also like to see more enforcement.

 

Reports of Committees & City Officials:

Councilmember Nick attended the Parks Board meeting on June 8th.

Councilmember Steele reviewed the claim checks on June 12th.

 

Approval of Minutes:

Mayor Colinas opened for consideration approval of the Brier City Council Minutes of June 7, 2016. Councilmember Nick made a MOTION to approve the Brier City Council Minutes of June 7, 2016. Councilmember Joplin SECONDED. Motion Carried.

 

Consent Agenda:

Mayor Colinas opened for consideration the release of the $1000 performance bond for Ann Polin. Councilmember Gallagher made a MOTION to approve the release of the $1000 performance bond for Ann Polin. Councilmember Steele SECONDED. Motion Carried.

 

New Business, Petitions, Communication, Application Appeals:

Mayor Colinas opened for consideration to authorize the Clerk-Treasurer to move forward on the 22 delinquent sewer/stormwater accounts. Councilmember Krienke made a MOTION to authorize the Clerk-Treasurer to move forward on the 22 delinquent sewer/stormwater accounts as outlined in exhibit A. Councilmember Olson SECONDED. Motion Carried.

Ordinances, Resolutions & Orders:

Mayor Colinas opened for consideration approval of Ordinance No. 436, banning fireworks.  

 

Tonia Dresher, Brier – she asks that the Council keep Brier unique by allowing the residents one day a year to celebrate the 4th of July with fireworks.

 

Lynn Wycoff, Brier – her family was happy to see the advisory ballot last fall and hopes that the Council will uphold the vote that was in favor of banning fireworks.

 

Jan Doran-Faulds, Brier – she loves Brier but she hates 4th of July, her animals are all affected by the noise, flashes and smoke, as are people with PTSD; she feels that fireworks are damaging to her, her animals and other people in Brier and encourages the Council to follow the advisory vote from November and ban fireworks.

 

Margaret Bianco, Brier – asks that you keep fireworks in Brier; this is how we celebrate the 4th of July and we have had no fires; people who are already using illegal fireworks will continue to do so. She stated that less than a third of the residents of Brier voted to ban the fireworks.

 

Terry Muriekes, Brier – he showed his dad’s naval jacket from WWII and stated that this is why we really celebrate 4th of July, he would like the Council to keep fireworks.

 

Jacob Boucher, Brier – he asked if this will be voted on by the Council or if the community will be able to have a real vote on this issue. He thinks it is a terrible idea to criminalize America by banning fireworks on 4th of July.

 

Hunter Davis, Brier – has lived in Brier for 10 years and they have celebrated 4th of July with fireworks every year and he would like us to keep celebrating and not ban fireworks.

 

Rodney Clark, Brier – has lived here for 30 years, he still loves fireworks and this is once a year and he hopes that the Council will vote to keep them.

 

Dee Williamson, Brier – she loves Brier and loves this country, she is a veteran herself, it is not one day a year, it is New Years, it is every Seahawks game, Mariner game, and weeks surrounding the 4th of July. She has asthma and cannot go outside on 4th of July and asks that the Council please ban fireworks.

 

Zachary Clark, Brier – he knocked on about 100 doors asking how many people knew about the vote for the advisory ballot and only found 1 person who knew; he also asked how many people knew about this meeting and no one was aware. He believes that this is what our military fights for and that children should be able to experience this celebration. He likes that we are unique and he wants us to keep fireworks.

 

Elaine Schnurle, Brier – don’t take away our fireworks, we need a day to celebrate our American rights; each year she sets off fireworks in memory of her son who died.

 

Trevor Clark, Brier – stated that there haven’t been any real serious issues with the fireworks and wants to see us keep them in Brier.

 

John Chalenor, Brier – would like to keep fireworks in Brier, he stated it is one day a year.

 

Jackie Seagul, Brier – there was a general election and there were signs all around the city stating that there was a vote happening; she does not believe that there are any safe and sane fireworks. She would like to see fireworks banned in Brier.

 

Maryann Baltich, Brier – her dad fought in WWII and it gives her the right to vote, she voted during the election and she voted to ban fireworks. She noticed that not everyone voted for the council members but 2,000 people voted on the fireworks issue.

 

Rodney Clark, Brier – he stated that the issue is in Brier not what is happening in Seattle or around the country but in Brier; it is most of the older people who are against the fireworks and they have had their time with fireworks and now it is our time.

 

Bob Thorpe, Brier – you cannot legally purchase a bottle rocket in the State of Washington because they have been outlawed for 30 years, what you are proposing to criminalize is a father lighting off a fountain with his child or allow them to use a sparkler. It will be illegal to have sparklers in Brier. When you pass a law you are impacting the people who follow the laws. Please keep fireworks.

 

Adam Gregorich, Brier – we light off the legal fireworks, we do them during the legal hours allowed, we clean up as much of our mess in the dark and then come back out in the morning and clean up the rest. The same people who are breaking the law today will still break the new law. He feels there are a lot of steps that could be taken before criminalizing residents using fireworks.

 

Mark Schnurle, Brier – very proud of living in Brier because Brier is very different. He is very much in favor of fireworks on the 4th of July and very much opposed to fireworks the other 364 days of the year. He did not hear a single fire or police call on his end of the city last year on the 4th of July. He believes passing the ban will make Brier just like everybody else and we lose a little bit of what makes Brier special.

 

Craig Harris, Brier – this is the third time he has come to Council to ask that you ban fireworks in our community. He believes we should follow the advice of our fire safety personnel and ban fireworks. He would like the Council to pass the ban of fireworks and protect the safety of our community.

 

Julie O’Donald, Brier – the use of loud and illegal fireworks is out of control. The use of fireworks comes at the expense of the rights of everyone else. Her family asks that you ban fireworks on the 4th of July.

 

Carol Batchelor, Brier – 4th of July is a 4 generational event at her house and she would like to encourage you to keep fireworks.

 

Scott Presho, Brier – he would like the Council to honor the majority of voters and Fire District 1’s request to ban fireworks.

 

John Ebel, Brier – he would like to see us keep fireworks and feels it has brought his neighborhood together.

 

Nathan Ediger, Brier – this would be not be banning fireworks it would be banning memories.

 

Kevin Davis, Brier – supports the tradition of fireworks and would urge more enforcement of the violators not the ones who are doing it legally.

 

Lizzy Kilgore, Brier - she would like to see the ban on fireworks but would like to see it done respectfully; she is a burn survivor so flying fireworks terrify her.

 

Clerk-Treasurer Swisher read into the record an email from Richard Rosen, Mr. Rosen is in favor of the ban of fireworks.

 

Jan Doran-Faulds, Brier – she is patriotic, she likes celebrations but the damage it causes to people and animals and how it ruins the paradise in her backyard is not worth the hell that fireworks cause for her on the 4th of July.

 

Elaine Schnurle, Brier – she would like to know what the City will do to bring people together to celebrate and bring the community together in place of the individual neighborhood celebrations.

 

Terry Muriekes, Brier – we have a lot of holidays but nothing seems to bring us out like the 4th of July. We are all out in the streets and the atmosphere here in Brier is incredible. He would like to see if we can find some middle ground to not completely ban fireworks and bring them to the park and light them off.

 

Bob Thorpe, Brier – 99% of the complaints you are hearing about are the fireworks that are already illegal in the state. We are kooky and odd, can we please stay kooky and odd.

 

Rodney Clark, Brier – the majority of people in attendance tonight want to keep the fireworks.

 

Julie O’Donald, Brier – her neighborhood has a block party to bring everyone out.

 

Zachary Clark, Brier – people are still going to light illegal fireworks, you are taking this away from the children, they won’t be able to grow up with fireworks.

 

Hunter Davis, Brier – he would suggest one huge area like Brier Park where everyone could light off fireworks; it brings family and friends together.

 

Austin Davis, Brier – he agrees with having Brier Park to have everyone light off their fireworks, it would be a great social gathering and people could meet new families. It takes away the tradition. We should leave the big huge stuff to the professionals.

 

Councilmember Steele made a MOTION to approve Ordinance No. 436, banning fireworks. There was Council discussion. Councilmember Olson SECONDED. Motion Carried.

 

Mayor Colinas called a 5 minute recess at 8:38:29 PM. The meeting resumed at 8:45:39 PM.

 

Mayor Colinas opened for consideration approval of Resolution No. 560, adopting the 2017-2022 6 Year Street Plan. Councilmember Kaemingk made a MOTION to approve Resolution No. 560, adopting the 2017-2022 6 Year Street Plan. Councilmember Olson SECONDED. Motion Carried.

 

Miscellaneous Business by Call of Councilmembers & City Officials

Councilmember Nick has had five or six neighbors bring to his attention a concern that is being discussed in south Brier about the structure being built at 23824 Brier Road. We have granted a conditional use permit to them twice and the structure is now 3 stories tall with a peaked roof. If you look at the structure it does not look like it adheres to the code for height requirements.

 

Councilmember Krienke will be absent the next two Tuesdays for vacation.

 

Clerk-Treasurer Swisher asked the Mayor to share with the Council her request to be able to run for office for the Washington Municipal Clerks Association.

 

Auditing of Accounts:

Mayor Colinas opened for consideration approval of the May 2016 Payroll Checks. Councilmember Steele made a MOTION to approve the May 2016 Payroll Checks No. 30155 through No. 30173 and No. 30175 through No. 30207 in the amount of $134,095.84. Councilmember Kaemingk SECONDED. Motion Carried.

 

Mayor Colinas opened for consideration approval of the May 2016 Claim Checks.  Councilmember Steele made a MOTION to approve the May 2016 Claim Checks No. 30174  and No. 30228 through No. 30302 and an electronic payment for a safe deposit box rental in the amount of $329,864.06. Councilmember Gallagher SECONDED. Motion Carried.
