BRIER CITY COUNCIL MINUTES

August 14, 2018

Mayor Colinas called the regular Brier City Council Meeting to order at 7:00 PM and the flag salute was given.

 

Roll Call:

Present: Mayor Colinas, Councilmembers Gallagher, Joplin, Kaemingk, Krienke, Nick, Steele and Thorpe.

Staff: Clerk-Treasurer Swisher and Planner Flathman.

Public Requests & Oral Communications:

Presentation by Jan Link, President of Academy Link Outreach.

 

Reports of Committees & City Officials:

Councilmember Steele reviewed the claim checks this weekend and reviewed the 2017 Annual Report on August 1st.

 

Approval of Minutes:

Mayor Colinas opened for consideration approval of the Brier City Council Minutes of July 24, 2018. Motion: Approve the Brier City Council Minutes of July 24, 2018. Moved by Councilmember Nick, Seconded by Councilmember Gallagher. Motion Carried.

 

Mayor Colinas opened for consideration approval of the Brier City Council Workshop Minutes of August 7, 2018. Motion: Approve the Brier City Council Workshop Minutes of August 7, 2018. Moved by Councilmember Gallagher, Seconded by Councilmember Joplin. Motion Carried.

 

Consent Agenda:

Mayor Colinas opened for consideration approval of the Consent Agenda which includes, confirmation of the Mayor's appointment of Cory Ness to the Civil Service Commission, Position No. 2 with a term set to expire October 31, 2023, appointment of Bill Kolden to the Planning Commission, Position No. 7 with a term set to expire July 31, 2020, re-appointment of M.L. DeMorett to the Planning Commission, Position No. 6 with a term set to expire July 31, 2020 and authorization for Clerk-Treasurer Swisher to proceed with Intent to Foreclose Letters. Motion: Approve the Consent Agenda as stated. Moved by Councilmember Krienke, Seconded by Councilmember Kaemingk. Motion Carried.

 

Hearings:

Mayor Colinas opened discussion regarding the Latecomer's Agreement for the 25th Ave Sewer Extension. City Planner Flathman gave a brief description of the agreement. City Engineer John Forba explained the issue and answered questions regarding the issue.

 

Mayor Colinas opened the Public Hearing regarding the Latecomer's Agreement for the 25th Ave Sewer Extension at 7:27 PM.

Councilmember Gallagher stated that he has property within 300 feet of the effected properties and does anyone have issues with appearance of fairness issues if he participates.

Mark Heffelmire 23030 25th Ave W, was shown plans that had a stub out running to his home and the developer did not install the stub out. He was then told by the developer that an extension would be put in on 231st. He is wondering where he stands now on getting a stub out run to his property line.

Nikolai Klimenko 23014 25th Ave W, feels this is a very late latecomer's agreement. He plans to subdivide his property in the future and feels that this agreement is too late in the process based on the Developer Extension Agreement under 7.7 because the developer has already sold the 3 new properties that were constructed.

Linda Horan 2506 231st, was concerned that she might get charged additional fees even though she has the stub out already in place through a separate agreement with the developer.

Mayor Colinas closed the Public Hearing at 7:54 PM.

 

New Business, Petitions, Communications, Application Appeals:

Mayor Colinas asked the Council for their thoughts on moving forward with the Latecomer's Agreement for the 25th Ave Sewer Extension or if they would like to ask questions to be answered at a future meeting.

Councilmember Thorpe asked if the City is only listening to developers when addressing issues with development within the City of Brier.

Councilmember Steele stated she would prefer to carry it forward because it seems like there are so many things that we don't know and there are so many different answers and people were told different things. She would like to know why changes are being made in the field that are not being communicated to the property owners that will be affected.

 

Miscellaneous Business by Call of Councilmembers & City Officials:

Mayor Colinas stated he was considering cancellation of the workshop meeting next week. Motion: Cancellation of the Brier City Council Workshop of August 21, 2018. Moved by Councilmember Joplin, Seconded by Councilmember Nick. Motion Carried.

Auditing of Accounts:

Mayor Colinas opened for consideration approval of the July 2018 Payroll Checks Motion: Approve the July 2018 Payroll Checks No. 33199 through No. 33201, No. 33256 through No. 33259, No. 33302 through No. 33309, No. 33316 through No. 33321 and EFTs in the amount of $186,837.28 and voided Checks No. 33310 through No. 33315.   Moved by Councilmember Steele, Seconded by Councilmember Nick. Motion Carried.

 

Mayor Colinas opened for consideration approval of the July 2018 Claim Checks Motion: Approve the July 2018 Claim Checks No. 10128, Checks No. 33298, 33299 and 33301, Checks No. 33322 Through No. 33379 in the amount of $158,885.65 and voided Check No. 33300.  Moved by Councilmember Steele, Seconded by Councilmember Kaemingk. Motion Carried.

Mayor Colinas declared the meeting adjourned at 8:03 PM.
