BRIER CITY COUNCIL MINUTES
May 14, 2019
Mayor
Colinas called the regular Brier City Council Meeting to order at 7:00 PM and
the flag salute was given.
Roll Call:
Present: Mayor Colinas, Councilmembers Gallagher, Joplin,
Kaemingk, Krienke, Nick, Steele and Thorpe.
Staff: Clerk-Treasurer Swisher and Planner Flathman.
Public Requests & Oral Communications: None.
Reports of Committees & City Officials:
Councilmember
Thorpe met with the Parks Board on May 8th and they went over the
capital facilities plan and asked for the Tennis Court to be moved up for the
rehabilitation, Brierwood Park to be added for a facelift and the blackberry
bushes near the public works shop be cut back.
Councilmember
Nick met with the Library Board on May 8th.
Councilmember
Steele reviewed the claim checks this weekend and on May 14th she
reviewed the annual report with the Mayor and Clerk-Treasurer Swisher.
Approval of Minutes:
Mayor Colinas opened for consideration approval of the
Brier City Council Minutes of April 23, 2019. Motion: Approve the Brier City Council Minutes of April 23,
2019. Moved by Councilmember Kaemingk, Seconded
by Councilmember Gallagher. Motion Carried.
Mayor Colinas opened for consideration approval of the
Brier City Council Workshop Minutes of May 7, 2019. Motion: Approve the
Brier City Council Workshop Minutes of May 7, 2019.
Moved by Councilmember Nick, Seconded by Councilmember Gallagher.
Motion Carried.
Consent Agenda:
Mayor Colinas opened for consideration to accept the
scope of work from Alderwood Manor Heritage Association for work on the Brier
history book. Motion: Approve the scope of work from Alderwood Manor
Heritage Association for work on the Brier history book. Moved by
Councilmember Steele, Seconded by Councilmember Kaemingk. Motion Carried.
Hearings:
Mayor
Colinas stated that we will have a Public Hearing on Home Occupation License
No. 19-040, Component Fitness by Shawn Martinez, located at 21640 Russet Lane
after a brief description of the application by Planner Flathman. In addition,
Mayor Colinas stated that two of our Councilmembers are within the 300 feet of
the proposed application, Councilmember Kaemingk and Councilmember Krienke both
expressed their willingness to recuse themselves from participating based on
their proximity to the applicant's property. Applicant Shawn Martinez
addressed the Council stating that he would like to give people the ability to
achieve their fitness goals.
Mayor
Colinas opened the Public Hearing on Home Occupation License No. 19-040,
Component Fitness by Shawn Martinez, located at 21640 Russet Lane at 7:16 PM.
The audience was asked if there are any objections to Councilmember Kaemingk
participating in the process. There were no objections. The audience was asked
if there are any objectionsto Councilmember Krienke participating in the
process. Councilmember Thorpe stated he is uncomfortable with Councilmember
Krienke participating because his wife has submitted comments regarding the
application. Councilmember Krienke recused himself and left the room.
Eleanor
Anderson, Brier, she teeters against the business due to noise concerns. She
would also be open to try the fitness training should the application be
approved.
Rod
Rupprecht, Brier, what is the process to make sure that the business stays
within the parameters that the business has to meet.
Stephany
Schneider, Brier, her detailed concerns are the added traffic, added noise, parking
and safety and how will the enforcement of the parameters of this business
going to be handled. She stated that they have a barking dog that is allowed to
bark incessantly and she feels that while he is working in the house with
clients the dog will be left outside to bark and disturb the neighborhood.
Mayor
Colinas closed the Public Hearing at 7:28 PM.
The
Mayor asked Mr. Martinez about the questions posed by the neighbors. He has
gone outside to check the small stereo that he uses when doing his own workouts
and assured everyone that the music cannot be heard out in his front yard. He
has 5 off-street parking spaces so none of his clients will be parking on the
street.
There
was Council discussion. Motion: Approve the Home Occupation License No.
19-040, Component Fitness by Shawn Martinez, located at 21640 Russet Lane with
the conditions set forth in the staff report. Moved by Councilmember
Thorpe, Seconded by Councilmember Joplin. Motion Carried.
Councilmember
Krienke rejoined the meeting at 7:47 PM.
New Business, Petitions, Communications, Application Appeals:
Mayor Colinas opened for consideration the release of
the Bond for the Greben Project BR18-021, for erosion control in the amount of
$18,258.00. Motion: Approve the release of the Bond for the Greben

Councilmember Kaemingk, Seconded by Councilmember Steele. Motion Carried.
Mayor
Colinas opened for consideration approval of the repairs necessary for the 1997
Vactor truck pump system in an amount of $18,076.32. Motion: Approve the
repairs necessary for the 1997 Vactor truck in an amount not to exceed $20,000.00
Moved by Councilmember Krienke, Seconded by Councilmember Nick.
Motion Carried.
Miscellaneous Business by Call of Councilmembers & City Officials:
Councilmember
Nick complimented how quickly Steve Smith, Public Works Supervisor addresses
issues that the Librarian informs him of. The board asked for lighting for the
new signs that were installed on the building and possibly the use of a solar
light. On May 5th Julie O'Donald and the Girl Scout troop planted a pollination
garden.
Councilmember
Gallagher asked if there will be a May 21st workshop meeting. Motion:
Cancel the May 21st workshop meeting. Moved by Councilmember
Gallagher, Seconded by Councilmember Nick. Motion Carried.
Auditing of Accounts:
Mayor Colinas opened for consideration approval of the
April 2019 Payroll Checks. Motion: Approve
the April 2019 Payroll Checks No. 40645 through No. 40649 and EFT transactions
in the amount of $135,545.19. Moved by
Councilmember Steele, Seconded by Councilmember Nick. Motion Carried.
Mayor Colinas opened for consideration approval of the
April 2019 Claim Checks. Motion: Approve
the April 2019 Claim Checks No. 40644 and 40650, Checks No. 40652 through No.
40696 in the amount of $232,812.25 Moved by
Councilmember Steele, Seconded by Councilmember Kaemingk. Motion
Carried.
