BRIER CITY COUNCIL MINUTES
October 22, 2019
Mayor Colinas called the regular Brier City Council
Meeting to order at 7:06 PM and the flag salute was given.
Roll Call:
Present: Mayor Colinas, Councilmembers Gallagher, Joplin,
Kaemingk, Krienke, Nick, Steele and Thorpe.
Staff: Clerk-Treasurer Swisher
and City Engineer John Forba.
Public
Requests & Oral Communications:
Allyson Templeton, Brier, asked that a battery
collection bin be added to our lobby and she offered to handle the sorting and
disposal of them for one year. She had a gripe that there are four council
positions up for re-election and there is nothing listed on our website about
elections. She looked at our neighboring cities and handed out examples of what
those cities have on their websites. She would like us to add this to our
website.
Reports of
Committees & City Officials:
Councilmember Thorpe reported that he attended the
Parks Board meeting on Wednesday, October 9th and reminded everyone
that this Saturday is Dog-o-ween.
Councilmember Steele reviewed the claim checks over
the weekend.
Councilmember Gallagher attended the Planning
Commission meeting on October 16th.
Approval
of Minutes:
Mayor Colinas opened for consideration approval of the Brier City
Council Minutes of October 8, 2019. Motion:
Approve the Brier City Council Minutes of
October 8, 2019. Moved by Councilmember Nick, Seconded
by Councilmember Gallagher. Motion Carried.
Mayor Colinas opened for consideration approval of the Brier City
Council Workshop Minutes of October 8, 2019. Motion: Approve the Brier City
Council Workshop Minutes of October 8, 2019. Moved by Councilmember Nick, Seconded by Councilmember Joplin. Motion Carried.
Hearings:
Mayor Colinas opened the Public Hearing at 7:25 PM
on 231st St SW Sewer Extension Latecomers Reimbursement Agreement.
William Brunsdon, Brier,
he is one of the properties listed as a benefiting party in the agreement and
he does not believe that there is 18 feet of sewer line within his property
line.
Mark Hepplemeir, Brier,
stated that the developer only stubbed out two lots other than the new lot that
where the home was built. He stated that he was never contacted nor was his
neighbor that has the additional stub out regarding the latecomer agreement. In
addition, he stated he was told on two occasions that there would not be a
latecomer agreement for this extension.
Motion: To close the Public
Hearing on the 231st Sewer Extension Latecomer Agreement. Moved by Councilmember Krienke, Seconded by Councilmember Steele. Mayor
Colinas stated the Public Hearing was closed at 7:53 PM. There was Council
discussion and the questions asked by the public were addressed.
Motion: Approve the 231st
Sewer Extension Latecomer Agreement subject to the verification of the final
calculations related to the property listed at 2605 231st St SW. Moved by Councilmember Steele, Seconded by Councilmember Thorpe.
Motion Carried.
Mayor Colinas opened the Public Hearing at 8:19 PM
on Ordinance No. 456.A, amending the 2019 Operating Budget. Mayor Colinas
closed the Public Hearing at 8:20 PM.
Mayor Colinas opened the Public Hearing at 8:22 PM
on Ordinance No. 462, Levying the General Taxes for the Year 2020. Mayor
Colinas closed the Public Hearing at 8:23 PM.
Mayor Colinas opened the Public Hearing at 8:23 PM
on the 2020 Preliminary Budget. Mayor Colinas closed the Public Hearing at 8:24
PM.

Business, Petitions, Communications, Application Appeals:
Mayor Colinas opened for consideration the
release of the Land Disturbing Bond for Arcadia Homes 29th Ave A
& B Short Plat # LD18-08 in the amount of $22,863.75. Motion: Approve the release of the Land
Disturbing Bond for Arcadia Homes 29th Ave A & B Short Plat #
LD18-08 in the amount of $22,863.75. Moved
by Councilmember Krienke, Seconded
by Councilmember Nick. Motion Carried.
Mayor Colinas opened for consideration the release of the
Land Disturbing Bond for Arcadia Homes, 23109 29th Ave W #LD18-09 in
the amount of $17,790.00. Motion: Approve the release of the Land
Disturbing Bond for Arcadia Homes, 23109 29th Ave W #LD18-09 in the
amount of $17,790.00. Moved by

Councilmember Gallagher. Motion Carried.
Mayor Colinas opened for consideration the release of the 25th
Ave Sewer Extension Performance Bond for Arcadia Homes in the amount of
$197,000.00. Motion: Approve the release of the 25th Ave Sewer

Carried.

Mayor Colinas opened for consideration approval of Ordinance No. 456.A,

Mayor Colinas asked if Council would like to have a
workshop on November 5th to discuss budget further and stated otherwise we have no business to discuss that evening. Motion:
Cancel the November 5, 2019 Council Workshop. Moved by Councilmember Gallagher, Seconded by Councilmember Steele. Motion Carried.
Auditing
of Accounts:
Mayor Colinas opened for consideration approval of the October 2019
Claim Checks. Motion: Approve the October 2019
Claim Checks No. 41095 through No. 41129 and voided Check No. 41094 in the
amount of $167,544.20. Moved by Councilmember Steele, Seconded
by Councilmember Joplin. Motion Carried.
