BRIER CITY COUNCIL MINUTES

September 8, 2020

Mayor Kaemingk called the regular Brier City Council Meeting to order at 7:03 PM

 

Roll Call:

Present: Mayor Kaemingk, Councilmembers Gallagher, Joplin, Krienke, Marley, Nick and Rosman.

Staff: Clerk-Treasurer Swisher, Planner Flathman.

Public Requests & Oral Communications: None.

 

Reports of Committees & City Officials:

Councilmember Nick on September 3rd had an interview with the State Auditor, Miranda Reddick, to discuss our audit and he reviewed claim checks on September 8th.

Councilmember Gallagher had a Community Transit meeting on September 3rd.

Councilmember Krienke attend a meeting with the Chief and Mayor to discuss police negotiations on September 8th.

Councilmember Joplin attend a Snohomish Health District Board meeting September 8th stating that the peak in the COVID-19 cases has started to come down again.

 

Approval of Minutes:

Mayor Kaemingk opened for consideration approval of the Brier City Council Minutes of September 1, 2020. Motion: Approve the Brier City Council Minutes of September 1, 2020. Moved by Councilmember Nick, Seconded by Councilmember Marley. Motion Carried.

 

Mayor Kaemingk opened for consideration approval of the Brier City Council Workshop Minutes of September 1, 2020. Motion: Approve the Brier City Council Workshop Minutes of September 1, 2020. Moved by Councilmember Gallagher, Seconded by Councilmember Marley. Motion Carried.

 

Consent Agenda:

Mayor Kaemingk opened for consideration approval to purchase the upgrade for the Cues Camera System in an amount not to exceed $23,000. Motion: Approve the purchase the upgrade for the Cues Camera System in an amount not to exceed $23,000.00. Moved by Councilmember Nick, Seconded by Councilmember Krienke. Motion Carried.

 

Mayor Kaemingk opened for consideration approval to authorize Pace Engineers scope & fee for work related to the Allview Sewer Manhole Replacements in an amount not to exceed $24,000.00. 7:11 PM Motion: Approve Pace Engineers scope & fee for work related to the Allview Sewer Manhole Replacements in an amount not to exceed $24,000.00. Moved by Councilmember Krienke, Seconded by Councilmember Nick. Motion Carried


Hearings:

Mayor Kaemingk opened discussion on Home Occupation License BR20-025, Everything Elderberry, LLC by Kristen Flicker located at 22711 Brier Road. A brief overview of the application was given by Planner Flathman. Kristen Flicker discussed her business. Mayor Kaemingk opened the Public Hearing at 7:15 PM. Mayor Kaemingk closed the Public Hearing 7:16 PM. 7:16 PM Motion: Approve Home Occupation License BR20-025, Everything Elderberry, LLC by Kristen Flicker located at 22711 Brier Road. Moved by Councilmember Nick, Seconded by Councilmember Gallagher. Motion Carried.

 

Mayor Kaemingk opened discussion on Home Occupation License BR20-040, Clinical Psychology, Inc. by Enika Bowen located at 2514 241st Pl SW. Planner Flathman gave a brief overview of the application. Enika Bowen discussed her business. Mayor Kaemingk opened the Public Hearing at 7:20 PM. Mayor Kaemingk closed the public hearing at 7:21 PM. 7:21 PM Motion: Approve Home Occupation License BR20-040, Clinical Psychology, Inc. by Enika Bowen located at 2514 241st Pl SW. Moved by Councilmember Nick, Seconded by Councilmember Joplin. Motion Carried.

 

New Business, Petitions, Communications, Application Appeals:

Mayor Kaemingk opened for consideration approval to confirm the Mayor's Re-Appointment of Karla Wood to the Park Board Position No. 3, with a termination date of September 15, 2024. Motion: Approve the Mayor's Re-Appointment of Karla Wood to the Park Board Position No. 3, with a termination date of September 15, 2024. Moved by Councilmember Gallagher, Seconded by Councilmember Nick. Motion Carried.

Ordinances, Resolutions & Orders

Mayor Kaemingk opened for consideration approval of Ordinance No. 466, amending Title 8.08.030 relating to noise. Motion: Approve Ordinance No. 466, amending Title 8.08.030 relating to noise. Moved by Councilmember Marley, Seconded by Councilmember Gallagher. Motion Carried.

 

Miscellaneous Business by Call of Councilmembers & City Officials:

Councilmember Krienke had an idea about asking John Lockhart to come back and speak to the council again because he was so nervous when he interviewed for the Council vacancy. There was Council discussion regarding whether to bring back both candidates or if anyone wished to vote now. Motion: Nominate John Lockhart for the open council vacancy. Moved by Councilmember Joplin, Seconded by Councilmember Gallagher. Vote: Motion passed (summary: Yes = 5, No = 0, Abstain = 1). Yes: Councilmember Gallagher, Councilmember Joplin, Councilmember Marley, Councilmember Nick, Councilmember Rosman. Abstain: Councilmember Krienke. Motion Carried.


Councilmember Gallagher asked if we would be having a workshop meeting next week. Clerk-Treasurer Swisher explained that the items we had planned to talk about were the renewal of the Prosecuting Attorney's contract and to inform the Council that our Public Defender Greg Schrag has given us notice that he is retiring at the end of the year and we will begin a search for a new Public Defender. Council was fine with the Prosecuting Attorney contract being brought forward at the next regular meeting. Motion: Cancel the City Council Workshop meeting of September 15th. Moved by Councilmember Marley, Seconded by Councilmember Gallagher. Motion Carried.


Auditing of Accounts:

Mayor Kaemingk opened for consideration approval of the August 2020 Payroll Checks. Motion: Approve the August 2020 Payroll Checks No. 41915 through No. 41917 and EFT transactions in the amount of $142,546.94. Moved by Councilmember Nick, Seconded by Councilmember Gallagher. Motion Carried.

 

Mayor Kaemingk opened for consideration approval of the August 2020 Claim Checks. Motion: Approve the August 2020 Claim Checks No. 41914, Checks No. 41918 through No. 41966 in the amount of $141,439.78. Moved by Councilmember Nick, Seconded by Councilmember Gallagher. Motion Carried.
