BRIER CITY COUNCIL MINUTES
March 23, 2021
Mayor Kaemingk called the regular Brier City
Council Meeting to order at 7:02 PM.
Roll Call:
Present: Mayor Kaemingk,
Councilmembers Gallagher, Joplin, Krienke, Lockhart, Marley, Nick and Rosman.
Staff: Clerk-Treasurer Swisher,
Deputy Clerk Snowden and Planner Flathman.
Public
Requests & Oral Communications: None.
Reports of
Committees & City Officials:
Councilmember Rosman attended the Library Board
meeting on March 10th where lighting for the sign on the building
was discussed, in addition she testified for the Senate Law & Justice
committee regarding HB1054 on March 11th.
Councilmember Gallagher attended the Planning
Commission meeting on March 17th, testified for the Senate Law &
Justice committee HB1054 March 11th.
Councilmember Nick reviewed the claim checks March
22nd and will attend union negotiations tomorrow evening March 24th.
Approval
of Minutes:
Mayor Kaemingk opened for consideration approval of the Brier City
Council Minutes of March 9, 2021. Motion: Approve the
Brier City Council Minutes of March 9, 2021, Moved by Councilmember Nick, Seconded by Councilmember Joplin.
Motion Carried.
Hearings:
Mayor Kaemingk stated there is a Public Hearing consideration of Home Occupation
Business No. 604602328, located at 22526 Hickory Way, by Tyler Morse for Brier
Patch Farms, LLC. He opened the Public Hearing at 7:11 PM. Deputy Clerk Snowden
gave a brief overview of the application and read into the record an email that
was received in opposition to the business. Councilmember Marley stated that he
lives within 300 feet of the property. Mayor Kaemingk asked if anyone had any
objections to Councilmember Marley participating in the hearing, there were no
objections. Motion: Denial of Home
Occupation Business No. 604602328, located at 22526 Hickory Way, by Tyler Morse
for Brier Patch Farms, LLC. Moved by Councilmember Krienke, Seconded by Councilmember Rosman. Motion Carried.
New
Business, Petitions, Communication, Application Appeals:
Mayor Kaemingk opened for consideration approval of Conditional Use Permit CU20-04, located at 22526 Hickory
Way by Gilmore Morse for a Secondary Dwelling Unit. Planner Flathman gave a
brief overview of the application. Councilmember
Marley stated that he lives within 300 feet of the property. Mayor Kaemingk
asked if anyone had any objections to Councilmember Marley participating in the
hearing, there were no objections. Rebecca Gilmore one of the homeowners gave a
brief statement. Motion: Approve Conditional
Use Permit CU20-04, located at 22526 Hickory Way by Gilmore Morse for a
Secondary Dwelling Unit with conditions as stated in the staff report, Moved by Councilmember Marley, Seconded by Councilmember Lockhart. Motion Carried.
Miscellaneous Business by Call of Councilmembers
& City Officials: None.
Auditing
of Accounts:
Mayor Kaemingk opened for consideration approval of the March 2021 Claim
Checks. 7:35 PM Motion:
Approve the March 2021 Claim Checks No. 42478 through No. 42511, Checks
No. 42513 though No. 42521 and EFT transactions in the amount of $82,938.67 and
voided Check No. 42512. Moved by Councilmember Nick, Seconded
by Councilmember Gallagher. Motion Carried.

Mayor Kaemingk
declared the meeting adjourned at 7:35 PM.
