BRIER CITY COUNCIL MINUTES

April 13, 2021

Mayor Kaemingk called the regular Brier City Council Meeting to order at 7:00 PM.

 

Roll Call:

Present: Mayor Kaemingk, Councilmembers Gallagher, Joplin, Krienke, Lockhart, Marley, Nick and Rosman.

Staff: Clerk-Treasurer Swisher, Building Official Beverly and Planner Flathman.


Public Requests & Oral Communications:

John McMasters - Brier, lives next door to the home that had a two-alarm fire on March 23rd. He is concerned that the home was being used as a rooming house and an illegal automotive repair business. He is also concerned about the number of vehicles parked all over the street because the driveway is always full of cars being worked on.

Christi Davis - Brier, lives across the street from the home that had the fire on March 23rd. She is concerned with the rooming house as well. There are tenants moving in and out all the time, the homeowner is unaware of who actually lives in the house. There are cars parked up and down the street all the time due to the number of people living at the house and the vehicles being worked on at the home.

Andrew Markiel - Brier, he lives across the street from the home that had the fire on March 23rd, and he too is concerned about the parking situation, the illegal business and the tenants coming and going.

Nerissa Hobbs - Brier, lives near the home that had the fire on March 23rd. She is concerned for the safety of the children in this neighborhood in addition to the unlicensed business and the tenants coming and going.

Kathy Rafferty - Brier, lives on the opposite side of the home that had the fire on March 23rd. Her husband Karl joined the conversation as well. They are concerned about the unlicensed business. One of the tenants visited their home the day after the fire and stated that the homeowner had asked him to lie about his leasing of the home.

 

Reports of Committees & City Officials:

Mayor Kaemingk opened the floor to our South County Fire Representative Assistant Fire Marshall Karl Fitterer who gave a description of the two-alarm fire and stated that this is still an ongoing investigation. He stated that the fire has been ruled accidental.

Building Official Beverly addressed the efforts that have been made over several years to deal with the issues related to this property.

Councilmember Gallagher attended the Community Transit meeting on April 8th.

Councilmember Joplin attended the Snohomish County Board of Health meeting on April 13th.

Councilmember Nick reviewed claim checks on April 9th.

Council Rosman has been watching the bills regarding changes to law enforcement issues.

 

Approval of Minutes:

Mayor Kaemingk opened for consideration approval of the Brier City Council Minutes of March 23, 2021.Motion: Approve the Brier City Council Minutes of March 23, 2021, Moved by Councilmember Marley, Seconded by Councilmember Joplin. Motion Carried.

 

Mayor Kaemingk opened for consideration approval of the Brier City Council Workshop Minutes of April 6, 2021. Motion: Approve the Brier City Council Workshop Minutes of April 6, 2021, Moved by Councilmember Gallagher, Seconded by Councilmember Lockhart. Motion Carried.

 

Hearings:

Mayor Kaemingk opened the Public Hearing at 7:48 PM for the 2021 Comprehensive Plan proposed amendments. Planner Flathman gave brief overview of the plan which no public input was submitted, and staff requests just changes to the Capital Facilities element at this time. The Public Hearing was closed at 7:50 PM. There was Council discussion. Motion: Authorize staff to move forward with the updates to the Comprehensive Plan - Capital Facilities element, Moved by Councilmember Krienke, Seconded by Councilmember Joplin. Motion Carried

 

Mayor Kaemingk opened the Public Hearing at 7:52 PM for consideration of Home Occupation Business #604697222, located at 23534 39th Ave W by Zoe Sonoda for Moon Rabbit Pastry, LLC. Clerk-Treasurer Swisher gave a brief overview of the application and the recommendation of approval. The applicant Zoe Sonoda explained that she is just waiting for her Cottage Food Permit to be approved and will then be ready to conduct business. The Public Hearing was closed at 7:57 PM. Motion: Approve Home Occupation Business #604697222, located at 23534 39th Ave W by Zoe Sonoda for Moon Rabbit Pastry, LLC, with the condition that the Cottage Food Permit is approved. Moved by Councilmember Krienke, Seconded by Councilmember Joplin. Motion Carried.


New Business, Petitions, Communications, Application Appeals:

Mayor Kaemingk opened for consideration approval to authorize the Mayor's signature on the Developer Extension Agreement for the McCann Subdivision. Motion: Approve the Mayor's signature on the Developer Extension Agreement for the McCann Subdivision, Moved by Councilmember Marley, Seconded by Councilmember Gallagher. Motion Carried.

 

Mayor Kaemingk opened for consideration approval to authorize the Mayor's signature on the Developer Extension Agreement for the Ghias Single Family Residence. Motion: Approve the Mayor's signature on the Developer Extension Agreement for the Ghias Single Family Residence, Moved by Councilmember Gallagher, Seconded by Councilmember Marley. Motion Carried.

 

Consideration of BIDS, L.I.D.S & Related Matters:

Mayor Kaemingk opened consideration to award the BID for CCTV Inspections by Innovac in an amount not to exceed $375,000.00. Motion: Approve and award the BID for CCTV Inspections by Innovac in an amount not to exceed $375,000.00, Moved by Councilmember Nick, Seconded by Councilmember Rosman. Motion Carried.


Mayor Kaemingk opened for consideration approval of Resolution No. 585 to adopt the Tree Certificate Program. Planner Flathman gave a brief overview of the program. There was Council discussion. Motion: Approve Resolution No. 585 to adopt the Tree Certificate Program, Moved by Councilmember Nick, Seconded by Councilmember Lockhart. Motion Carried.

 

Miscellaneous Business by Call of Councilmembers & City Officials:

Mayor Kaemingk stated there was no business for next week's Council workshop meeting. Motion: Cancel the April 20th Brier City Council Workshop meeting, Moved by Councilmember Joplin, Seconded by Councilmember Gallagher. Motion Carried.


Auditing of Accounts:

Mayor Kaemingk opened for consideration approval of the March 2021 Payroll Checks. Motion: Approve the March 2021 Payroll Checks No. 42522 through No. 42526 and EFT transactions in the amount of $159,302.55, Moved by Councilmember Nick, Seconded by Councilmember Marley. Motion Carried.

 

Mayor Kaemingk opened for consideration approval of the August 2021 Claim Checks. Motion: Approve the August 2021 Claim Checks No.42527 through No. 42578 and EFT transactions in the amount of $140,658.77, Moved by Councilmember Nick, Seconded by Councilmember Gallagher. Motion Carried.
