BRIER CITY COUNCIL MINUTES

June 8, 2021

Mayor Pro-Tem Nick called the regular Brier City Council Meeting to order at 7:00 PM.

 

Roll Call:

Present: Mayor Pro-Tem Nick, Councilmembers Gallagher, Joplin, Krienke, Lockhart, Marley and Rosman.

Absent: Mayor Kaemingk.

Staff: Clerk-Treasurer Swisher, Deputy Clerk-Treasurer Snowden, Building Official Beverly and

City Attorney Dawn Reitan.


Public Requests & Oral Communications: None.

 

Reports of Committees & City Officials:

Councilmember Marley attended a meeting with Public Works two weeks ago and gave an overview of the stormwater inspections, sewer inspection project and the potential cracking sealing project for this summer.

 

Councilmember Gallagher attended the June 3rd Community Transit meeting, he reported that they are still on track for the opening in October of the Northgate transit center.

 

Mayor Pro-Tem Nick came in on June 7th and reviewed the Claim checks.

 

Approval of Minutes:

Mayor Pro-Tem Nick opened for consideration approval of the Brier City Council Minutes of May 25, 2021 as revised. Motion: Approve the Brier City Council Minutes of May 25, 2021 as revised, Moved by Councilmember Marley, Seconded by Councilmember Gallagher. Motion Carried.

 

Mayor Pro-Tem Nick opened for consideration approval of the Brier City Council Workshop Minutes of June 1, 2021. Motion: Approve the Brier City Council Workshop Minutes of June 1, 2021, Moved by Councilmember Gallagher, Seconded by Councilmember Marley. Motion Carried.

 

Consent Agenda:

Mayor Pro-Tem Nick opened for consideration of the Professional Services Agreement with Pace Engineers for the Stormwater Management Plan update in an amount not to exceed $113,512.00. 7:09 PM Motion: Approve the Professional Services Agreement with Pace Engineers for the Stormwater Management Plan update in an amount not to exceed $113,512.00, Moved by Councilmember Gallagher, Seconded by Councilmember Lockhart. Motion Carried.


Hearings:

Mayor Pro-Tem Nick opened for consideration the renewal of Home Occupation Business License, #601116712 located at 23825 35th Ave W, by Forrest Lemme for Evergreen Landscape Management, Inc. Deputy Clerk Snowden gave an overview of the application renewal and stated that the purpose of the hearing is for guidance regarding the dumping of debris at a satellite location.

Forrest Lemme of ELM, Inc., Brier resident for 17 years, he states that he is not using the home at 3120 236th St SW for a satellite location for his business he is composting at the site to help amend the soils for future yard growth as he intends to build a retirement home on that property in the future for he and his family.

Mayor Pro-Tem Nick opened the Public Hearing at 7:19 PM.

Glen Eggebraten, Brier, stated he is the neighbor across the street and that Mr. Lemme is a great neighbor and has had no problem with him or his business.

Mike Koplitz, Brier, his property backs to the property that Mr. Lemme’s business is licensed and he too supports the business.

Closed the Public Hearing at 7:24 PM.

Motion: Approve the renewal of Home Occupation Business License, #601116712 located at 23825 35th Ave W, by Forrest Lemme for Evergreen Landscape Management, Inc. on the condition that no dumping of debris associated with Evergreen Landscape Management, Inc. business functions at any satellite locations within the City of Brier, Moved by Councilmember Krienke, Seconded by Councilmember Gallagher. Motion Failed.

 

There was lengthy discussion by Council with the input of City Attorney Reitan, Building Official Beverly and Clerk-Treasurer Swisher regarding the satellite locations and possible scenarios.

 

Motion: Approve the renewal of Home Occupation Business License, #601116712 located at 23825 35th Ave W, by Forrest Lemme for Evergreen Landscape Management, Inc. with no conditions, Moved by Councilmember Krienke, Seconded by Councilmember Lockhart. Motion Carried.


Miscellaneous Business by Call of Councilmembers & City Officials: None.


Auditing of Accounts:

Mayor Pro-Tem Nick opened for consideration approval of the May 2021 Payroll Checks. Motion: Approve the May 2021 Payroll Checks No. 42652 through No. 42656 and EFT transactions in the amount of $142,841.31, Moved by Councilmember Gallagher, Seconded by Councilmember Marley. Motion Carried.

 

Mayor Pro-Tem Nick opened for consideration approval of the May 2021 Claim Checks. Motion: Approve the May 2021 Claim Check No. 42685, Checks No. 42687 through No. 42714 in the amount of $459,325.36, Moved by Councilmember Gallagher, Seconded by Councilmember Joplin. Motion Carried.

 

Adjournment

Mayor Pro-Tem Nick asked for a motion to adjourn. Motion: To adjourn the meeting, Moved by Councilmember Krienke, Seconded by Councilmember Marley. Motion Carried.

Mayor Pro-Tem Nick declared the meeting adjourned at 8:09 PM.
