BRIER CITY COUNCIL MINUTES

August 10, 2021

Mayor Kaemingk called the regular Brier City Council Meeting to order at 7:01 PM.

 

Roll Call:

Present: Mayor Kaemingk, Councilmembers Gallagher, Joplin, Krienke, Lockhart, Marley, Nick and Rosman.

Staff: Clerk-Treasurer Swisher and Deputy Clerk-Treasurer Snowden.


Public Requests & Oral Communications:

Kristin Ficker, Brier, the Parks Board is really excited about the Covid friendly SeaScare scavenger hunt that starts tomorrow. She encourages the Council to come out and participate and send pictures to Ken. Winners will be announced at the Music in the Park night on September 8th.

 

Reports of Committees & City Officials:

Councilmember Gallagher attended the Community Transit board meeting on August 5th, they are working feverishly to get ready for the opening at the Northgate station.

Councilmember Nick reviewed claim checks on August 6th.

Councilmember Rosman attended the MRSC emergent issues session regarding housing and homelessness on August 5th.

 

Approval of Minutes:

Mayor Kaemingk opened for consideration approval of the Brier City Council Minutes of July 27, 2021. Motion: Approve the Brier City Council Minutes of July 27, 2021, Moved by Councilmember Nick, Seconded by Councilmember Marley. Motion Carried.

 

Mayor Kaemingk opened for consideration approval of the Brier City Council Workshop Minutes of August 3, 2021. Motion: Approve the Brier City Council Workshop Minutes of August 3, 2021, Moved by Councilmember Gallagher, Seconded by Councilmember Lockhart.

Motion Carried.

 

Hearings:

Mayor Kaemingk opened the Public Hearing and Consideration of Home Occupation Business License No. 604602328 located at 22526 Hickory Way, by Tyler Morse for Brier Patch Farms, LLC. Deputy Clerk-Treasurer Snowden gave a brief overview of the application and recommended approval. Applicant Tyler Morse was in attendance for any questions and didn't have anything additional to add. Mayor Kaemingk opened the Public Hearing at 7:15 PM.

Kristin Ficker, Brier, is in favor of the business and has tried the products, she feels this business is perfect for Brier.

Denise Ibrahim, Brier, lives across from this business and thinks this is fabulous and is happy to see the property being used for something other than development.

Tawnya Flyberg, Brier, she agrees with everything everyone has already said and she thinks this would be a great benefit to Brier.

Gabrielle Higson, Brier, avid supporter of Brier Patch Farms and doesn't anticipate an issue with traffic and parking at the property.

Scott Higson, Brier, this is a gem of an opportunity for Brier to have this business.

Jennifer Davidson, Brier, lives across from the farm and agrees with everything else everyone has said. This is awesome for our community.

Hal Collins, Brier, their back fence is directly adjacent to the driveway of the farm. They are in opposition of the business and see that it violates several portions of the code such as selling of stocks, merchandise in a residential neighborhood, no exterior evidence of the business and they have concerns about the traffic as it will affect them enjoying their backyard.

Katherine Slettve, Brier, supports the business and doesn't anticipate the traffic being an issue and looks forward to having them in the neighborhood.

Teasha Corrado, Brier, support for the business but it is not concerned about the traffic. It would be great to have access to such a business and fresh produce.

Angela Daly, Brier, she walks this neighborhood constantly and feels the business is a bonus for the community and a welcome opportunity for them and the people that surround them in this community.

The Public Hearing was closed at 7:30 PM.

Councilmember Marley commented that he is within 300 feet of the subject property. Motion: Approve the Home Occupation Business License No. 604602328 located at 22526 Hickory Way, by Tyler Morse for Brier Patch Farms, LLC. Moved by Councilmember Marley, Seconded by Councilmember Lockhart. There was Council discussion. Motion Carried.

 

Consideration of BIDS, LIDS & Related Matters:

Mayor Kaemingk opened for consideration the Nugget Park Sidewalk BID award to Kamin's Construction in an amount not to exceed $295,000.00. 7:37 PM Motion: Approve the Nugget Park Sidewalk BID award to Kamin's Construction in an amount not to exceed $295,000.00, Moved by Councilmember Marley, Seconded by Councilmember Gallagher. Motion Carried.


Miscellaneous Business by Call of Councilmembers & City Officials:

Mayor Kaemingk informed Council that we have met with the Prothman staff in our search for a new Police Chief there's a lot to the process. He stated that Sergeant Alanis is doing a great job finding training to send our officers to and things that we need to make the department run smoothly. We have the Department of Corrections people working in the city again. Our inspections to our stormwater ponds and vaults are coming along well.


Mayor Kaemingk opened for consideration approval of the July 2021 Payroll Checks. Motion: Approve the July 2021 Payroll Checks No. 42829 through No. 42833 and EFT transactions in the amount of $141,163.93, Moved by Councilmember Nick, Seconded by Councilmember Gallagher. Motion Carried.

 

Mayor Kaemingk opened for consideration approval of the July 2021 Claim Checks Motion: Approve the July 2021 Claim Checks No. 42828 Checks No. 42834 through No. 42865 in the amount of $25,195.20, Moved by Councilmember Nick, Seconded by Councilmember Gallagher. Motion Carried.


Executive Session:

Mayor Kaemingk stated that Council will move to Executive Session pursuant to RCW 42.30.110(d) to review negotiations on a publicly bid contract and RCW 42.30.110(g) to review performance of a public employee. Motion: Move to Executive Session pursuant to RCW 42.30.110(d) to review negotiations on a publicly bid contract and RCW 42.30.110(g) to review performance of a public employee for approximately 60 minutes and no action to be taken afterwards. Moved by Councilmember Krienke, Seconded by Councilmember Gallagher. Motion Carried. Mayor Kaemingk declared recess to Executive Session at 7:44 PM.
