BRIER CITY COUNCIL MINUTES
November 9, 2021
Mayor Kaemingk called the regular Brier City
Council Meeting to order at 7:00 PM.
Roll Call:
Present: Mayor Kaemingk,
Councilmembers Gallagher, Lockhart, Marley, Nick, and Rosman. Councilmember Krienke
arrived at 7:25 PM.
Absent: Councilmember Joplin.
Staff: Clerk-Treasurer Swisher
and Planner Flathman.
Public

Reports of
Committees & City Officials:
Mayor Kaemingk reported that he attended the DEM
meeting November 9th, he has been meeting with other south county mayors
regularly, we have a new police officer beginning November 15th, we
are making positive progress on obtaining a new police chief as well as
additional officers, and the pedestrian bridge is not in as bad of condition as
we had suspected from the initial review.
Councilmember Nick reviewed claim checks on
November 8th.
Councilmember Gallagher attended the November 4th
Community Transit meeting.
Councilmember Rosman attended the November 2nd
rebranding meeting.
Councilmember Krienke attended the November 2nd
rebranding meeting, and met on November 10th
with the mayor to discuss the police department.

Consent
Agenda:
Mayor
Kaemingk opened for consideration the Consent Agenda
which included:
- Release of the Arcadia Homes 231st
St Sewer Main Extension Maintenance Bond in the amount of $43,536.50.
- Release of the Arcadia Homes Tree Maintenance
Assurance Bond for 2526 231st St in the amount of $21,000.00.
- Release of the Performance Bond in the amount
of $30,450.00 and the Tree Protection Bond in the amount of $16,800.00 for Ryan
Grenz at 2333 N. Castle Way.
- Approval of the Agreement with Snohomish
County for Road Maintenance.

Executive
Session Pursuant to RCW 42.30.110(1)(i):
Mayor called for a recess to Executive Session
pursuant to RCW 42.30.110(1)(i). Motion: Recess to Executive Session pursuant to RCW 42.30.110(1)(i) for approximately 30 minutes at 7:10 PM, Moved by Councilmember Marley, Seconded by Councilmember Nick. Motion
Carried. Council returned from executive session at 7:49 PM.
Hearings:
Mayor Kaemingk opened for
consideration the Public Hearing on Ordinance No. 477, for the 2022 Operating
Budget. Mayor Kaemingk opened the Public Hearing at 7:50 PM. Mayor Kaemingk closed
the Public Hearing at 7:50 PM.
Mayor Kaemingk opened the
Public Hearing at 7:51 PM on Ordinance No. 478, amending the Home Occupation
Licensing Code. Planner Flathman gave a brief overview of the amendments. Mayor
Kaemingk closed the Public Hearing at 7:55 PM.
Mayor Kaemingk opened the
Public Hearing at 7:55 PM on Ordinance No. 479, amending the Native Vegetation,
Land Disturbing Activity and Tree Code. Planner Flathman gave a brief overview
of the amendments.
William Bartig, Brier, is concerned about the tree canopy and tree
companies trying to convince people to remove trees that aren’t needing to be
removed.
Janelle & Sam, Brier,
echoed the concerns stated by Mr. Bartig about the
tree canopy.
Mayor Kaemingk closed the
Public Hearing at 8:11 PM.
Ordinances,
Resolutions & Orders:
Mayor Kaemingk opened for
consideration approval of Ordinance No. 477, for the 2022 Operating Budget. Motion:
Approve Ordinance No. 477, for the 2022 Operating Budget, Moved by
Councilmember Marley, Seconded by Councilmember Krienke. Motion Carried.
Mayor Kaemingk opened for
consideration approval of Ordinance No. 478, amending the Home Occupation
Licensing Code. Motion: Approve Ordinance No. 478, amending the Home
Occupation Licensing Code, Moved by Councilmember Gallagher, Seconded
by Councilmember Lockhart. Motion: 17.12.050(A)(1) would like to
strike 30% and increase it to 50%, Action: Approve, Moved by
Councilmember Rosman, Seconded by Councilmember Gallagher. The amended Motion
Carried. The main Motion Carried.
Mayor Kaemingk opened for
consideration approval of Ordinance No. 479, amending the Native Vegetation,
Land Disturbing Activity and Tree Code. Motion: Approve Ordinance No.
479, amending the Native Vegetation, Land Disturbing Activity and Tree Code, Moved
by Councilmember Marley, Seconded by Councilmember Nick. Motion
Carried.
Mayor Kaemingk opened for
consideration approval of Ordinance No. 480, adding New Chapter 9.16 entitled
Use of Public Property. Motion: Approve Ordinance No. 480, adding New

Marley, Seconded by Councilmember Gallagher. Motion Carried.
Miscellaneous
Business by Call of Councilmembers & City Officials:
Mayor Kaemingk stated
that we have a new Planning Commissioner appointment to make. Motion: Confirm the Mayor’s appointment of Chris Campbell to Planning
Commission position # 4 with a term set to expire January 31, 2024, Moved by Councilmember Gallagher, Seconded by Councilmember Marley.

Mayor Kaemingk stated
there is no business for the workshop next week. Motion: Cancel the workshop
meeting of November 16th, Moved by
Councilmember Gallagher, Seconded by
Councilmember Lockhart. Motion Carried.
Auditing
of Accounts:
Mayor Kaemingk opened for consideration approval of the October 2021
Payroll Checks Motion:
Approve the October 2021 Payroll Checks No. 43059 through No. 43063 and
EFT transactions in the amount of $127,318.61, Moved by Councilmember Nick, Seconded by Councilmember Gallagher. Motion
Carried.
Mayor Kaemingk opened for consideration approval of the October 2021
Claim Checks. Motion:
Approve the October 2021 Claim Checks No. 43093 and No. 43094, Checks
No. 43096 through No. 43110, Checks No. 43136 through No. 43163 in the amount
of $131,693.93. Voided Check No. 43095, Reason:
voided check sent to Invoice cloud for E-Pay and voided Checks No. 43111
through No. 43135, Reason: Loaded in the printer incorrectly, Moved by Councilmember Nick, Seconded by Councilmember Gallagher. Motion
