BRIER CITY COUNCIL MINUTES

April 26, 2022

Councilmember Krienke called the regular Brier City Council Meeting to order at 7:00 PM.

 

Roll Call:

Present: Councilmembers Gallagher, Krienke, Lockhart, Marley, Moran, Nick, and Rosman.

Absent: Mayor Kaemingk.

Staff: Clerk-Treasurer Swisher, City Attorney Dawn Reitan and Planner Flathman.

Public Requests & Oral Communications: None.

 

Reports of Committees & City Officials:

Councilmember Nick reviewed claims on April 22, 2022. In addition, he had a special mention that yesterday Councilmember Marley played the test suit dummy for the tazer training with our police department.

Councilmember Gallagher attended the Community Transit Board meeting and the groundbreaking of the new Swift Orange Line in Snohomish County.

Councilmember Rosman stated that she observed the Snohomish County Planning Commission meeting this evening.

Councilmember Marley attended the Planning Commission meeting on April 20th.

 

Approval of Minutes:

Councilmember Krienke opened for consideration approval of the Brier City Council Workshop Minutes of April 5, 2022. Motion: Approve the Brier City Council Workshop Minutes of April 5, 2022, Moved by Councilmember Marley, Seconded by Councilmember Lockhart. Motion Carried.

 

Councilmember Krienke opened for consideration approval of the Brier City Council Minutes of April 12, 2022. Motion: Approve the Brier City Council Minutes of April 12, 2022. Moved by Councilmember Marley, Seconded by Councilmember Lockhart. Motion Carried.

 

Councilmember Krienke opened for consideration approval of the Brier City Council Workshop Minutes of April 19, 2022. Motion: Approve the Brier City Council Workshop Minutes of April 19, 2022, Moved by Councilmember Marley, Seconded by Councilmember Nick. Motion Carried.

 

Hearings:

Councilmember Krienke opened discussion on Ordinance No. 482, amending Title 17 Zoning Division 1, File #CA21-02 providing for clarifying terminology, procedures and definitions; repealing Chapter 17.16, Home Animal Agriculture Regulations conflicting with Chapter 6.20 and repealing Chapter 17.28, which regulated the RS 20,000 zone. Planner Flathman gave an overview of the changes and procedures. Councilmember Krienke opened the Public Hearing on Ordinance No. 482 at 7:10 PM. The Public Hearing was closed at 7:13 PM.

 

Councilmember Krienke opened discussion on the Public Hearing on the Annual Comprehensive Plan Amendment Docket. Planner Flathman gave an overview of the suggested amendments and the process. Councilmember Krienke opened the Public Hearing on the Annual Comprehensive Plan Amendment Docket at 7:15 PM. The Public Hearing was closed at 7:16 PM. Motion: Instruct staff to move forward with the Annual Comprehensive Plan Amendment Docket, Moved by Councilmember Marley, Seconded by Councilmember Gallagher. Motion Carried.

 

Ordinances, Resolutions & Orders:

Councilmember Krienke opened for consideration approval of Ordinance No. 482, amending Title 17 Zoning Division 1, File #CA21-02 providing for clarifying terminology, procedures and definitions; repealing Chapter 17.16, Home Animal Agriculture Regulations conflicting with Chapter 6.20 and repealing Chapter 17.28, which regulated the RS 20,000 zone. Motion: Approve Ordinance No. 482, amending Title 17 Zoning Division 1, File #CA21-02 providing for clarifying terminology, procedures and definitions; repealing Chapter 17.16, Home Animal Agriculture Regulations conflicting with Chapter 6.20 and repealing Chapter 17.28, which regulated the RS 20,000 zone with the following changes on line 26 to a change "in occupancy" to "change in occupancy classification"; 310 change "a lot with a lot" to "a lot which"; line 539 replace after the words "dimensional requirements of this part" replace comma with a period and start a new sentence "With in addition other potential effects", Moved by Councilmember Marley, Seconded by Councilmember Gallagher. There was Council discussion regarding setbacks. Motion Carried.

 

Councilmember Krienke opened for consideration approval of Resolution No. 588, granting Preliminary Plat approval for the Phillips Ridge Subdivision, SUB22-02 located at 22015 Old Poplar Way. Planner Flathman gave an overview of the Plat and went over staff and Planning Commission recommendations. City Engineer John Forba gave explanations regarding the stormwater and roadway design.

 

Motion: Approve Resolution No. 588, granting Preliminary Plat approval for the Phillips Ridge Subdivision, SUB22-02 located at 22015 Old Poplar Way, Moved by Councilmember Nick, Seconded by Councilmember Gallagher. There was Council discussion regarding the grinder pumps, slopes, tree removal, the amount of soil that will have to be trucked in, soil testing and delineation of the critical areas. Motion Carried.

 

Motion: Amend the Motion to include in the Resolution language to include the planter strip, Moved by Councilmember Marley, Seconded by Councilmember Rosman. Motion Carried

 

Motion: Amend the Motion to include a condition that the contractor have a signed agreement with a Geotechnical Engineer to perform daily monitoring during excavation, the construction of the site walls and the subsequent grading and weekly reports of this supervision be provided to the city, Moved by Councilmember Rosman, No seconded, motion failed.


Motion: Amend the Motion to include a condition that the contractor have a signed agreement with a Geotechnical Engineer to perform daily monitoring of the construction of the site walls, excavation and grading and bi-weekly reports to be required, Moved by Councilmember Rosman, Seconded. Amendment withdrawn.

 

Motion: Amend the Motion to include a condition that the contractor have a Geotechnical Engineer to perform regular monitoring of the construction of the site walls, excavation, and grading to be required on a regular basis and reports submitted to the City, Moved by Councilmember Rosman, Seconded by Councilmember Marley. Motion Carried.


Councilmember Krienke opened for consideration approval of Ordinance No. 483, amending Title 12.12, relating to Right-of-Way use permit fees. Motion: Approve Ordinance No. 483, amending Title 12.12, relating to Right-of-Way use permit fees, Moved by Councilmember Marley, Seconded by Councilmember Gallagher. Motion Carried.

 

Miscellaneous Business by Call of Councilmembers & City Officials:

Councilmember Rosman stated that more information regarding the urban canopy study that we saw last will be forthcoming.

 

Auditing of Accounts:

Councilmember Krienke opened for consideration approval of the April 2022 Claim Checks. Motion: Approve the April 2022 Claim Checks No. 43626 through No. 43629, Checks No. 43635 through No. 43672 and EFT transactions in the amount of $146,347.84, Moved by Councilmember Nick, Seconded by Councilmember Lockhart. Motion Carried.
