BRIER CITY COUNCIL MINUTES

July 25, 2023

Mayor Pro-Tem Marley called the regular Brier City Council Meeting to order at 7:00 PM and flag salute was given.

 

Roll Call:

Present: Councilmembers Gallagher, Krienke, Lockhart, Marley, Moran, Councilmember Nick and Rosman.

Absent: Mayor Kaemingk.

Staff: Clerk-Treasurer Swisher, Deputy Clerk Snowden, Interim City Planner Michaelis.

 

Public Requests & Oral Communications:

Mayor Pro-Tem Marley stated that the presentation by Snohomish County Councilman, Jared Mead will not be given. He had a family emergency.

 

Hisham Othman, Brier - with all the development in Brier and all the wildlife such as squirrels crossing streets, suggested the city reach out to the Fire Dept. for old fire hoses to help create bridges for the squirrels to cross safely.

 

Reports of Committees & City Officials:

Councilmember Marley reviewed claim checks on July 23.

Councilmember Gallagher attended a Community transit meeting today.

Clerk Treasurer Swisher mentioned that Mrs. Joplin, former Councilmember Joplin's wife dropped off of note inviting the councilmembers and community to the celebration of life that is on August 20, in the Gold room at the Nile Country Club at 2:00pm. Obituary is on Dignity.com.

Councilmember Rosman attended the Parks Board meeting on July 12, attended the Snohomish County Officials dinner with presentations from the County Prosecuting attorney and lobbyists from AWC on July 20 and listened to part of the Snohomish County planning commission meeting today.

 

Approval of Minutes:

Mayor Pro-Tem Marley opened for consideration approval of the Brier City Council Minutes of July 11, 2023. Motion: Approve the Brier City Council Minutes of July11, 2023. Moved by Councilmember Nick, Seconded by Councilmember Krienke. Motion Carried.

 

Mayor Pro-Tem Marley opened for consideration approval of the Brier City Council Workshop Minutes of July 18, 2023. Motion: Approve the Brier City Council Workshop Minutes of July 18, 2023. Moved by Councilmember Gallagher, Seconded by Councilmember Moran. Motion Carried.

 

Consent Agenda:

Mayor Pro-Tem Marley opened for consideration the Park Board's proposal for a new tree for the holiday tree lighting. Motion: Approve the Park Board's proposal for a new tree for the holiday tree lighting. Moved by Councilmember Krienke, Seconded by Councilmember Lockhart. Motion Carried.


Hearings:

Mayor Pro-Tem Marley opened for the Public Hearing and consideration approval of Home Occupation Business No. 603548543, located at 23000 35th Ave W by Audra Holt for The Mower Shop, LLC. The public hearing was opened hearing at 7:07 PM. Deputy Clerk Snowden gave a brief overview of the application.

Brad Schneider, Brier - asked for clarification on if this is a renewal from the previous 2015 business or is this a new application. He stated that the property doesn't seem that bad with clutter, but doesn't want it get worse.

Joan Cole, Brier - her concern is that the business has been messy with the items in front of the house and the noise coming from the garage due to having the garage door open. Would prefer that they clean it up and keep the property nice.

Tom Cullens, Brier - He lives directly across the street. He stated that he thought the noise and traffic is minimal.

Mark Cortezzo, Brier - Been living in Brier for over 25 years and loves living in Brier. His family supports small home based business in Brier but doesn't feel that a small engine repair is suitable for a home based business in a residential zone. He is asking the council to follow and enforce the Brier Municipal Code and deny the application.

At 7:19 PM hearing is closed. Mayor Pro-Tem Marley stated that there is a formal notice of code violation and correction order that has been issued against this property so no action will be taken by Council until the current code violation and correction order is addressed. At which point, the application will come back before Council and action will be taken at that time.


New Business:

Mayor Pro-Tem Marley opened for consideration approval of the A & V short subdivision developer extension agreement for sewer located at 22916 25th Ave W. Councilmember Gallagher asked the council if he should abstain from voting due to being involved in the project and owning an adjacent piece of property. Mayor Pro-Tem Marley asked the public in attendance, no public objection noted. Motion: Approve the A & V short subdivision developer extension agreement for sewer located at 22916 25th Ave W. Moved by Councilmember Moran, Seconded by Councilmember Nick. Motion Carried.


Mayor Pro-Tem Marley opened for consideration approval of the J & S Development septic system replacement Conditional Use Permit CUP23-04 located at 22202 Locust Way. Planner Michaelis gave an overview of project. Motion: Approve the J & S Development septic system replacement Conditional Use Permit CUP23-04 located at 22202 Locust Way. Moved by Councilmember Gallagher, Seconded by Councilmember Rosman. Council discussion. Motion Carried.


Miscellaneous Business by Call of Councilmembers & City Officials:

Mayor Pro-Tem Marley opened for consideration to cancel the August 1st Council workshop meeting. Motion: Approve the cancellation of the August 1st Council workshop meeting. Moved by Councilmember Gallagher, Seconded by Councilmember Moran. Motion Carried.


Auditing of Accounts:

Mayor Pro-tem Marley opened for consideration approval of the July 2023 Claim Checks. Motion: Approve the July 2023 Claim Checks No. 44842 through No. 44848, Checks No. 44850 through No. 44871 and EFT Transaction in the amount of in the amount of $120,356.00 and voided Check No. 44827. Reason: Lost in the mail; reissued with Check No. 48849. Moved by Councilmember Gallagher, Seconded by Councilmember Rosman. Motion Carried.

 

Executive Session:

Mayor Pro-Tem Marley opened for executive session pursuant to RCW 42.30.110(G) to discuss the performance of a public employee at 7:42 PM. Motion: To move into executive session and to return at 7:57 PM. Moved by Councilmember Krienke, Seconded by Councilmember Nick. Motion Carried. At 7:57 PM the Council returned.

Motion: To cancel National Night out on August 1st. Moved by Councilmember Krienke, Seconded by Councilmember Gallagher. Motion Carried.

 

Adjournment:

Mayor Pro-Tem Marley declared the meeting adjourned at 7:58 PM.
