BRIER CITY COUNCIL MINUTES

October 24, 2023

Mayor Kaemingk called the regular Brier City Council Meeting to order at 7:01 PM and flag salute was given.

 

Roll Call.

Present: Mayor Kaemingk, Councilmembers Gallagher, Krienke, Lockhart, Marley, Moran, Nick and Rosman.

Staff: Clerk-Treasurer Swisher, Interim City Planner Michaelis, Deputy Clerk Snowden.

 

Public Requests & Oral Communications:  None

 

Reports of Committees & City Officials:

Mayor Kaemingk gave an update on the Police Department, Chief Hawley, 3 officers and 2 lateral officers in the background process.

Councilmember Marley reviewed claims checks on October 20th.

Councilmember Lockhart attended the police negotiations.

Councilmember Moran attended the Sno Isle Library board and friends meeting.

Councilmember Rosman attended the Parks Board meeting on October 10th, attended the Snohomish County City Officials meeting with Councilmember Marley and Councilmember Gallagher, Dog-O-Ween is on Saturday, October 28th.

Councilmember Gallagher met with the Public Works Department and sat in the radio room.

 

Approval of Minutes:

Mayor Kaemingk opened for consideration approval of the Brier City Council Minutes of October 10, 2023. Motion: Approve the Brier City Council Minutes of October 10, 2023. Moved by Councilmember Nick, Seconded by Councilmember Gallagher. Motion Carried.

 

New Business:

Mayor Kaemingk opened for consideration approval of the agreement with Darrel Johnson for Prosecutor Services. Motion: Approve the agreement with Darrel Johnson for Prosecutor Services. Moved by Councilmember Marley, Seconded by Councilmember Krienke. Motion Carried.

 

Mayor Kaemingk opened for consideration approval of the agreement with Pace Engineers for Engineer of Record Services. Motion: Approve the agreement with Pace Engineers for Engineer of Record Services. Moved by Councilmember Nick, Seconded by Councilmember Lockhart.

Motion Carried.

 

Mayor Kaemingk opened for consideration approval to renew the Interlocal Agreement with Everett Animal Shelter. Motion: Approve the renewal of the Interlocal Agreement with Everett Animal Shelter. Moved by Councilmember Lockhart, Seconded by Councilmember Rosman. Motion Carried.

 

Mayor Kaemingk opened for consideration the release of the Tree Protection/Maintenance Bonds for Neava LLLC, Plat SP08-06 located at 22411 Old Poplar Way, the amounts of $6,300.00, $8,400.00 and $31,735.00. Motion: Approve the release of the Tree Protection/Maintenance Bonds for Neava LLLC, Plat SP08-06 located at 22411 Old Poplar Way, the amounts of $6,300.00, $8,400.00 and $31,735.00. Moved by Councilmember Gallagher, Seconded by Councilmember Nick. Motion Carried.

 

Mayor Kaemingk opened for consideration the release of the Tree Protection/Maintenance Bonds for Seatown Development Plat SP15-03 located at 22317 Old Poplar Way in the amounts of $6,300.00, $18,000.00 and $39,645.00. Motion: Approve the release of the Tree Protection/Maintenance Bonds for Seatown Development Plat SP15-03 located at 22317 Old Poplar Way in the amounts of $6,300.00, $18,000.00 and $39,645.00. Moved by Councilmember Marley, Seconded by Councilmember Gallagher Motion Carried.

 

Mayor Kaemingk opened for consideration approval of the Interlocal Agreement with Snohomish County to adjust the Brier City Limits as part of the Swamp Creek Bridge 503 Replacement Project. Moved by Councilmember Krienke, Seconded by Councilmember Moran. Motion Carried.

 

Mayor Kaemingk opened for consideration the release of the Walker Construction Land Disturbing Performance Bond Permit LDA20-14, Located at 22825 24th Ave W in the amount of $21,750.00. Motion: Approve the release of the Walker Construction Land Disturbing Performance Bond Permit LDA20-14, Located at 22825 24th Ave W in the amount of $21,750.00. Moved by Councilmember Rosman, Seconded by Councilmember Marley. Motion Carried.

 

Mayor Kaemingk opened for consideration approval of CUP23-06 for Septic System Replacement for the Johnson Property Located at 2520 228th St SW. Motion: Approve CUP23-06 for Septic System Replacement for the Johnson Property Located at 2520 228th St SW. Moved by Councilmember Gallagher, Seconded by Councilmember Marley. Motion Carried.

 

Mayor Kaemingk opened for consideration approval of the Labor Agreement with Teamsters Local 117 for Police Officers for years 2024-2026. Motion: Approve the Labor Agreement with Teamsters Local 117 for Police Officers for years 2024-2026. Moved by Councilmember Lockhart, Seconded by Councilmember Gallagher. Motion Carried.

 

Ordinances, Resolutions & Orders:

Mayor Kaemingk opened for consideration approval of Ordinance No. 495, adopting the Stormwater Management Plan Update. Motion: Approve Ordinance No. 495, adopting the Stormwater Management Plan Update. Moved by Councilmember Rosman, Seconded by Councilmember Gallagher. Motion Carried.


Miscellaneous Business by Call of Councilmembers & City Officials:

Councilmember Rosman has received questions from residents regarding pedestrian visibility on 228th and Brier Rd. Council discussion.  She also asked Interim City Planning Michaelis if there is a better process of keeping track of the bonds and when they need to be released.

 

Councilmember Nick stated the hanging light in front of City Hall needs to be changed

 

Mayor Kaemingk stated the Council needs to recess into an Executive Session regarding the Laborers Union contract negotiations. Motion: At 7:36 PM move to recess to Executive Session pursuant to RCW 42.30.110(D) regarding the Laborers Union contract negotiations for 15 minutes, no action will be taken. Moved by Councilmember Marley, Seconded by Councilmember Krienke. Motion Carried. At 7:55 PM, the council reconvened.

 

Auditing of Accounts:

Mayor Kaemingk opened for consideration approval of the October 2023 Claim Checks. Motion: Approve the October 2023 Claim Checks No. 45080 through No. 45082, Checks No. 45087 through No. 45119 and EFT Transaction in the amount of $460,378.66. Moved by Councilmember Marley, Seconded by Councilmember Gallagher. Motion Carried.

 

Adjournment

Mayor Kaemingk declared the regular meeting adjourned to move into a Workshop meeting at 7:56 PM.
