BRIER CITY COUNCIL MINUTES
July 23, 2024
Mayor Kaemingk called the regular Brier City
Council Meeting to order at 7:00 PM and the flag salute was given.
Roll Call:
Present: Mayor Kaemingk, Councilmembers Gallagher, Krienke,
Lockhart, Marley, Rosman, Allen and Othman.
Staff: Clerk-Treasurer Swisher, Deputy Clerk Snowden, City
Planner Michaelis, City Engineer John Forba and City Attorney Dawn Reitan.
Presentation:
Mayor Kaemingk welcomed Chief Bob Eastman, Asst.
Chief Shawn Maxwell and PIO Leslie Haynes who gave the presentation regarding
the South County Regional Fire Authority ballot measure. Council discussion and
clarification questions were asked.
Mayor Kaemingk opened the floor for any public
comments on the measure either pro or against the benefit charge.
Steve DeKoekkoek of Brier mentioned he found the
RFA charges on his tax statement and asked for clarification regarding the
"voted" and "non-voted" amount showing.
Joel Stuker of Brier, asked if his shop that is
located on his property is counted as part of the total square footage of
property.

Requests & Oral Communications:
Ms. Crumbley of Brier asked about traffic calming
techniques and police enforcement on Brier Rd.
Steve DeKoekkoek asked how often the project of cleaning
the catch basins is done and if we use our own equipment.
Reports of
Committees & City Officials:
Councilmember Lockhart reviewed claims on July 22nd
Mayor Kaemingk attended Snohomish County Mayor's
meeting and committee meetings.
Councilmember Gallagher attended the Community Transit
meeting, sat in the radio room and Snohomish County Cities meeting.
Councilmember Rosman also attended the Snohomish
County Cities meeting, attended the Parks Board meeting, the Music in the Park
event went well and also listened to the Snohomish
County Planning Commission meeting.
Approval
of Minutes:
Mayor Kaemingk opened for consideration approval of the Brier City
Council Minutes of July 9, 2024. Motion: Approve
the Brier City Council Minutes of July 9, 2024. Moved by Councilmember Rosman, Seconded
by Councilmember Marley. Motion Carried.
Mayor Kaemingk opened for consideration approval of
the Brier City Council Workshop Minutes of July 16, 2024. Motion: Approve the Brier City Council Workshop Minutes of
July 16, 2024. Moved by Councilmember Gallagher, Seconded by Councilmember Lockhart. Motion
Carried.
Consent
Agenda:
Mayor Kaemingk opened for consideration approval of
the catch basin cleaning By Whirlwind Clean & Green in an amount not to
exceed $22,266.19. Motion: Approve the catch basin cleaning By Whirlwind Clean &
Green in an amount not to exceed $22,266.19. Moved by Councilmember Marley, Seconded
by Councilmember Krienke. Motion Carried.
Mayor Kaemingk opened the public hearing for Morgan
Management, LLC by Kimberley Guadalupe, located at 21557 35th Pl.
W., for a Home Occupation business license for a private pool rental. Mayor Kaemingk opened the public hearing at 7:52
PM. Mayor Kaemingk and Councilmember
Krienke stated they live within 300 feet of the property but do not have any
ties to the property. Deputy
Clerk-Treasurer Snowden gave a brief overview of the license and gave staff
recommendations to allow the added square footage surrounding the pool for health
and safety reasons and that parking be required to be on her property, not on
the 30 ft. easement/private drive. Ms. Guadalupe responded and stated she did
not feel supported by staff in this process. She addressed the parking issue stating she didn't agree
the cities definition of "Street" with not being able to use the 30ft easement
for her business. She is in support of the size of the usable area of the pool
for health and safety reasons. She also addressed
the letters of opposition and that she had reached out to them before this
hearing. Mayor Kaemingk asked for public comment, hearing none, closed the
public hearing at 8:14 PM. Motion:
Approval of the Home Occupation business license for a private pool located at
21557 35th Pl W. with the recommended conditions as stated in the
staff report. Moved by Councilmember
Krienke, Seconded by Councilmember
Gallagher. Motion Carried. Council
discussion and follow-up questions for Ms. Guadalupe. City Attorney Reitan
clarified the definition of "Street" for the record. Motion Carried.
Consideration Of Bids, L.I.D.S & Related
Matters:
Mayor Kaemingk opened for consideration to accept the
228th St/Old Poplar Way Drainage Improvement Project. City Engineer John Forba reviewed the project
details. Motion: Approve to accept the 228th St/Old Poplar Way
Drainage Improvement Project. Moved by Councilmember Gallagher, Seconded by Councilmember Rosman. Motion Carried.
Miscellaneous
Business by Call of Councilmembers & City Officials:
City Clerk Treasurer Swisher addressed the
accusations made toward staff by Ms. Guadalupe in the Home Occupation business
license approval process.
Councilmember Rosman asked the City Engineer John
Forba about the TIB grant application for replacement of the flashing beacons
on Brier Rd. Council discussion.
Mayor Kaemingk opened for consideration to cancel
August 6th Council workshop meeting. Motion:
Cancel the August 6th Council workshop meeting. Moved by Councilmember Gallagher, Seconded by Councilmember Marley. Motion Carried.
Auditing
of Accounts:
Mayor Kaemingk opened for consideration approval of
the June 2024 Claim Checks. Motion: Approve
the June 2024 claim checks no. 45842 through no. 45873 and eft transactions in
the amount of $90,882.78. Moved by Councilmember Lockhart, Seconded by Councilmember Gallagher. Motion Carried.
