BRIER CITY COUNCIL MINUTES

November 12, 2024

Mayor Kaemingk called the regular Brier City Council Meeting to order at 7:00 PM and flag salute was given.

 

Roll Call:

Present: Mayor Kaemingk, Councilmembers Allen, Gallagher, Lockhart, Marley, Othman, and Rosman.

Absent: Councilmember Krienke.

Staff: City Planner Michaelis, Clerk-Treasurer Swisher and Deputy Clerk Snowden.

 

Public Requests & Oral Communications:

Steve Dekoekkoek of Brier would like to see the agendas and packets easier to find on the City's website, he had trouble finding the budget information.

 

Reports of Committees & City Officials:

Mayor Kaemingk thanked Councilmember Lockhart for running the meetings in his absence, attended the Snohomish County mayors meetings.

Councilmember Allen attended the Library Board meeting.

Councilmember Lockhart reviewed claims checks.

Councilmember Rosman follow up with the tree group.

Councilmember Gallagher attended the Community Transit meeting.

 

Approval of Minutes:

Mayor Kaemingk opened for consideration approval of the Brier City Council Minutes of October 22, 2024. Motion: Approve the Brier City Council Minutes of October 22, 2024. Moved by Councilmember Allen, Seconded by Councilmember Lockhart. Motion Carried.

 

Mayor Kaemingk opened for consideration approval of the Brier City Council Workshop Minutes of November 5, 2024. Motion: Approve the Brier City Council Workshop Minutes of November 5, 2024. Moved by Councilmember Gallagher, Seconded by Councilmember Allen.

Motion Carried.

 

Hearings:

Mayor Kaemingk opened the Public Hearing on Ordinance 494.A to amend the 2024 Annual Budget at 7:09PM. Clerk-Treasurer Swisher gave a brief overview of the amendment. Mayor Kaemingk closed the Public Hearing at 7:10PM.


Mayor Kaemingk opened the Public Hearing on the Preliminary 2025 Budget at 7:12 PM. Clerk-Treasurer Swisher gave a brief overview and answered questions from Council and public. Closed the Public Hearing at 7:18 PM.

 

Mayor Kaemingk opened the Public Hearing on Ordinance 498 for the purpose of levying Property Taxes for 2025 at 7:20PM. Clerk-Treasurer Swisher gave a brief overview. Mayor Kaemingk closed the Public Hearing at 7:23 PM.


New Business:

Mayor Kaemingk opened for consideration the release of bonds related to Seattle Pacific Homes Estate of Dreams project located at 22215 Brier Road:

a.     Performance Assurance for Right of Way Improvements for $37,797.83.

b.     Performance Assurance for Tree Mitigation for $113,400.00.

c.     Performance Assurance for Erosion Control Measures for $42,600.48.

d.     Performance Assurance for Required Plantings on Lot 1 for $100,629.81.


City Planner Michaelis gave a brief overview and answered questions from Council.

Motion: Approve the bond releases listed above related to Seattle Pacific Homes Estate of Dreams located at 22215 Brier Rd. Moved by Councilmember Gallagher, Seconded by Councilmember Rosman. Motion Carried.


Ordinances, Resolutions & Orders:

Mayor Kaemingk opened for consideration approval of Ordinance 494.A, amending the 2024 Annual Budget. Motion: Approved Ordinance 494.A, amending the 2024 Annual Budget. Moved by Councilmember Allen, Seconded by Councilmember Gallagher. Motion Carried.

 

Mayor Kaemingk opened for consideration approval of Ordinance 498, levying the 2025 Property Taxes. Motion: Approved Ordinance 498, levying the 2025 Property Taxes. Moved by Councilmember Allen, Seconded by Councilmember Marley.  Motion Carried.

 

Miscellaneous Business by Call of Councilmembers & City Officials:

Clerk-Treasurer Swisher mentioned that the State auditors are on-site performing the 2022-2023 audit and said to let her know if anyone on the council is interested in attending the audit entrance conference and also asked for council attendees for the AWC Action Days on February 19th and 20th in Lacey, WA. If interested, let her know as well.

 

City Planner Michaelis mentioned that the full draft of the Comprehensive Plan should be out by the end of this week with the public hearing being held at the Planning Commission meeting on November 20th. The next public hearing will then be held at the regular Council meeting on December 10th for council approval if no changes are needed. If changes need to be made, the public hearing will be moved to the December 17th regular council meeting.

 

Councilmember Lockhart will be unavailable December 1-13.


Auditing of Accounts:

Mayor Kaemingk opened for consideration approval of the October 2024 Payroll Checks.Motion: Approve the October 2024 Payroll Checks No. 46089 through no. 46093 and EFT transactions in the amount of $287,785.96. Moved by Councilmember Lockhart, Seconded by Councilmember Gallagher. Motion Carried.

 

Mayor Kaemingk opened for consideration approval of the October 2024 Claim Checks.

Motion: Approve the October 2024 Claim Checks No. 46116 through No. 46126, Checks No. 46128 through No. 46178 and EFT transaction in the amount of $281,730.90. Voided Check No. 46127, reason: printer malfunction. Reissued with Check No. 46128. Moved by Councilmember Lockhart, Seconded by Councilmember Gallagher. Motion Carried.

Mayor Kaemingk declared the meeting adjourned at 7:41 PM.
