BRIER CITY COUNCIL MINUTES
January 28, 2025
Mayor Kaemingk called the regular Brier City
Council Meeting to order at 7:00 PM and the flag salute was given.
Roll Call:
Present: Mayor Kaemingk,
Councilmembers Allen, Gallagher, Krienke, Othman,
Marley, Lockhart, and
Rosman.
Staff: City Planner Michaelis and
City Attorney Dawn Reitan.
Public
Requests & Oral Communications:
Kimberly Guadalupe, Brier-wanted to discuss the
email she sent to Council regarding short term rentals
in Brier. She would like to know how the decision was made on not allowing
short term rentals in 2019.
Steve DeKoekkoek, Brier-wanted to thank the
city on all the work it did on the Comprehensive Plan last year and would like
to know if there is anything new to watch for in 2025.
Dave Johnson, Brier- He was unable to attend
tonight's meeting and asked to have Mayor Kaemingk read his email into the
record for the Public Hearing on the Levy Lid Lift Resolution.
Mayor Kaemingk read into the record at 7:12 PM:
NOTICE IS HEREBY GIVEN that the City of Brier is now accepting requests
to consider suggested amendments to the City of Brier Comprehensive Plan. This
is the annual opportunity for the public to propose amendments to the
Comprehensive Plan. By State law, amendments or revisions to the Plan generally
may be considered only once a year. Applications are due by 5:00 PM on March
31, 2025.
Brier's Comprehensive Plan is the official
public policy document to guide the City's growth and development over the
coming years. Adopted by the City Council, the plan contains text, statistics
and maps that are available on the City's website.
Applications for suggested amendments are available
by contacting the City Planner, Lee Michaelis by phone at (425) 775-5440 or by
email at cityplanner@ci.brier.wa.us.
Reports of
Committees & City Officials:
Councilmember/Mayor Pro-Tem
Gallagher announced new liaisons for 2025. Councilmember Othman will be the
Police liaison, Councilmember Krienke will be the Library
liaison, Councilmember Marley will be the Planning liaison, Councilmember
Lockhart will be the Public Works liaison and Councilmember Allen will be the
Parks liaison.
Councilmember Gallagher attended the Community
Transit meeting, Snohomish County Cities meeting and EOC Radio meeting.
Councilmember Allen was appointed the Snohomish
County Community Housing & Development liaison.
Mayor Kaemingk was appointed as the Snohomish
County Board of Health liaison. He also attended the DEM meeting, Mayor's
meeting, Solid Waste meeting and the Regional Cities Meeting.
Councilmember Rosman attended the Legislative
Update meeting.
Approval

Hearings:
Mayor Kaemingk opened the
public hearing on Ordinance No. 501, regarding proposed Zoning Code Amendments
for project review timelines. City Planner Michaelis gave a brief overview of
the Ordinance. Public Hearing was opened at 7:23 PM. There was no one in the
audience who wished to speak. Public Hearing was closed at 7:24 PM.
Mayor Kaemingk opened the
public hearing the for A&V Klimenko Sewer Extension Latecomer Agreement located at 25th
Avenue W. City Planner Michaelis gave a brief overview of the Sewer Extension
Latecomer Agreement and handed out an amended Exhibit B, Reimbursement Charges
for Benefited Properties. Due to Councilmember Gallagher having a property
involved in the Sewer Extension he recused himself and left the room. There was
council discussion. Public Hearing was opened at 7:31 PM
Kimberly Guadalupe, Brier-asked for clarification on
the Latecomer Agreement.
John Borga, Brier-distributed a statement
addressing his concerns regarding the Latecomer Agreement to the council and
audience. Mr. Borga read his statement into the record with some modifications.
There was discussion amongst Council, City Staff and Mr. Borga. Public Hearing
was closed at 8:12 PM.
Consent
Agenda:
Mayor Kaemingk opened for consideration approval of
the Mayor's
signature authorizing the A&V Klimenko Sewer Extension Latecomer Agreement
located at 25th Avenue W. Motion: Approve the A&V Klimenko Sewer Extension Latecomer
Agreement located at 25th Avenue W, as amended, Moved by Councilmember Marley, Seconded
by Councilmember Krienke. There was council discussion. Motion Carried.
New
Business:
Mayor Kaemingk opened for consideration approval of
City of Brier Proposition No. 1 – Brier Seeks Voter Approval for a Levy Lid
Lift to fund Public Safety & Other Governmental Services.
Councilmember Rosman made a motion to amend the agenda
to read City of Brier, Proposition No. 1 -Brier Seeks Voter approval for a Levy
Lid Lift for funding Brier Police & Governmental Services. Motion:
Approve to amend the agenda
to read City of Brier, Proposition No. 1 -Brier Seeks Voter approval for a Levy

was council discussion. Motion Carried.

Mayor Kaemingk moved 9.B
on the agenda before 9.A. Mayor Kaemingk opened for consideration approval of Resolution No. 608, to
place the City's Levy Lid Lift for funding Brier Police & Governmental
Services on the Ballot on April 22, 2025. Motion:
Approve Resolution No. 608, calling for a special election to be held April 25,
2025 to permit submission on the ballot authorizing a Levy
Lid Lift for funding Brier Police & Governmental Services as presented, Moved by Councilmember Gallagher, Seconded by Councilmember Rosman.

Councilmember Gallagher stated that he will likely not
be at the February 25th meeting.
