BRIER CITY COUNCIL MINUTES

August 26, 2025

Mayor Kaemingk called the regular Brier City Council Meeting to order at 7:00 PM and flag salute was given.

 

Roll Call:

Present: Mayor Kaemingk Councilmembers Allen, Gallagher, Krienke, Lockhart, Othman and Parsons.

Absent: Councilmember Marley.

Staff: Clerk-Treasurer Swisher, City Planner Michaelis, City Attorney Reitan, Deputy Clerk Snowden.

 

Public Requests & Oral Communications: None

 

Reports of Committees & City Officials:

Mayor Kaemingk attended his normal meetings such as the Snohomish County Mayors meeting.

Councilmember Gallagher reviewed claims checks.

Councilmember Othman met with Chief Hawley.


Approval of Minutes:

Mayor Kaemingk opened for consideration approval of the Brier City Council Minutes of August 12, 2025. Motion: Approve the Brier City Council Minutes of August 12, 2025.

Moved by Councilmember Gallagher, Seconded by Councilmember Lockhart. Motion Carried.

 

Mayor Kaemingk opened for consideration approval of the Brier City Council Workshop Minutes of August 19, 2025. Motion: Approve the Brier City Council Workshop Minutes of August 19, 2025. Moved by Councilmember Allen, Seconded by Councilmember Parsons.

Motion Carried.

 

Hearings:

Mayor Kaemingk opened for consideration of the Home Occupation Business 604-207-231 located at 3426 Russet Rd, Brier by Nathan Hart and Kyle Hart for Hart and Sons Landscape. Mayor Kaemingk and Councilmember Krienke both disclosed that they within 300 feet from the Hart property. No one objected to their participation. Deputy Clerk Snowden gave an overview of the application and the willingness of the applicants to correct zoning violations. Nathan Hart spoke regarding the business; they are growing as a business, and they are in the process of looking for a commercial space.

Mayor Kaemingk opened the public hearing at 7:11 PM and asked for public comment.

 

Tiffany Austin, Brier - expressed concerns regarding a commercial business being on a residential, busy road. Wants more "guard rails" to make the business more accountable to safety issues.

 

Mayor Kaemingk closed the public hearing at 7:15 PM.

 

Motion: Approve the Home Occupation Business 604-207-231 located at 3426 Russet Rd, Brier by Nathan Hart and Kyle Hart for Hart and Sons Landscape with the conditions stated in staff report. Moved by Councilmember Allen, Seconded by Councilmember Krienke. Council discussion. Motion Carried.

 

Mayor Kaemingk opened for consideration on Ordinance No. 506 for the Formation of the Transportation Benefit District (TBD) for the City of Brier. Mayor Kaemingk mentioned that City Attorney Reitan has been working with staff in this process. City Attorney Reitan gave an overview of the purpose of a TBD. Mayor Kaemingk stated that the revenue stream the Council is considering is the car tab fee option and the funds will go directly to the transportation / street projects needed in Brier. City Attorney Reitan reiterated that the public hearing tonight is only the formation of the TBD board, not for imposing the car tab fee which is only one of revenue sources.

 

Mayor Kaemingk opened the public hearing at 7:32 PM and asked for public comment.

 

Sandra Ames, Brier - asked if there has been a conversation by the board on the amount of a tax that will be imposed and is there information available so the public could have more time to understand what the potential cost will be.

 

Tiffany Austin, Brier - would also like to see more time provided to the citizens to become more educated, get additional information and understand what the TBD is or isn't so the citizens can vote appropriately. She understands that the City is looking for additional resources to create revenue but believes the rushed approach does not bode well for Brier.

 

Ms. Austin asked City Attorney Reitan to clarify the steps to form the TBD and since they are empowered to make decisions, how do the citizens of Brier give input to the board.

 

Steve Dekoekkoek, Brier - stated that there are 3-options for generating revenue and if sufficient funding is reached, can the TBD board stop collecting?

 

Jacqueline Vandivort, Brier - asked what the money is going to specifically pay for and asked if the councilmembers would also be the TBD board members.

 

Ms. Ames asked if the TBD board members are comprised of only the City Councilmembers and if the board could choose to do more than one of the revenue options?

 

Brad Krueger, Brier - he has been attending previous meetings wanted to state that he is impressed with the councilmember discussions and how transparent they are being around this topic and encouraged his follow citizens to get involved and attend the meetings.

 

Mayor Kaemingk closed the public hearing at 7:57 PM.

 

New Business:


Mayor Kaemingk opened for consideration and approval of the Planning Commission recommendation of the Madrid Conditional Use Permit CUP25-01 for the On-Site Septic System Repair located at 2206 227th Pl SW. City Planner Michaelis gave a brief overview of the project. Moved by Councilmember Gallagher, Seconded by Councilmember Allen. Motion Carried.

 

Mayor Kaemingk opened for consideration for approval of Phillips Ridge 2 Partners, LLC Public Right of Way Deed related to Lot Line adjustment application LLA23-01. Motion: Approve Phillips Ridge 2 Partners, LLC Public Right of Way Deed related to Lot Line adjustment application LLA23-01. City Michaelis gave a brief overview of the Right of Way Deed. Moved by Councilmember Allen, Seconded by Councilmember Gallagher. Motion Carried.


Ordinances, Resolutions & Orders:

Mayor Kaemingk opened for consideration approval of Ordinance No. 506, establishing a Transportation Benefit District. Motion: Approve Ordinance No. 506, establishing a Transportation Benefit District. Moved by Councilmember Gallagher, Seconded by Councilmember Krienke. Motion Carried with Councilmember Othman voting Nay.


Miscellaneous Business by Call of Councilmembers & City Officials:

Mayor Kaemingk opened for the consideration of cancelling the September 2nd Council workshop meeting. Motion: Approve to cancel the September 2nd Council workshop meeting.

Moved by Councilmember Gallagher, Seconded by Councilmember Parsons. Motion Carried.


Auditing of Accounts:

Mayor Kaemingk opened for consideration approval of the August 2025 Claim Checks.
