BRIER CITY COUNCIL MINUTES
August 25, 2026
Mayor Kaemingk called the regular Brier City
Council Meeting to order at 7:00 PM and flag salute was given.
Roll Call:
Present: Mayor Kaemingk, Councilmembers Allen, Gallagher, Krienke,
Lockhart, Marley, Othman and Parsons.
Staff: Clerk-Treasurer Swisher, Planner Michaelis and Deputy Clerk
Treasurer Snowden.
Public
Requests & Oral Communications:
Jim Miller, Brier - Radio testing for Emergency
Services will be happening this Saturday, August 29th.
South County Fire and Rescue Chief Maxwell
introduced himself and all the Fire Department staff present. Presentation to
discuss their upcoming bond levy given by Chief Maxwell, Director of
Communications Christie Veley, Logistics Chief James Curtis and Commissioner David
Chan.
Reports of
Committees & City Officials:
Mayor Kaemingk attended his normal meetings and
attended a special meeting with Snohomish County Sheriff Johnson regarding projected
jail costs.
Councilmember Gallagher reviewed claims checks.
Councilmember Parsons mentioned that the SeaScare event went well and that the Brier Park Restroom
design preliminary permit drawings have been submitted for review by City
staff.
Councilmember Othman attended the Planning
Commission meeting on August 19th.
Approval
of Minutes:
Mayor Kaemingk opened for consideration approval of the Brier City
Council Minutes of August 11, 2026. Motion: Approve
the Brier City Council Minutes of August 11, 2026.
Moved by Councilmember Parsons, Seconded by Councilmember Gallagher. Councilmember
Othman stated a correction in the minutes was needed relating to Ordinance
513. The second motion in the minutes
should remove "as Class 1 devices". All council members agreed. Motion Carried.
Hearings:
Mayor Kaemingk opened for Public Hearing and consideration of Home
Occupation Business No. 606199780, located at 2818 228th St SW by
Zhao Wang for AI Gardens, LLC. Mayor Kaemingk opened the public hearing at 8:01
PM and asked for public comment.
Jim Miller stated that he read through the documentation and he approves
of this business.
The public hearing was closed at 8:02 PM.

Business No. 606199780, located at 2818 228th St SW by Zhao Wang for
AI Gardens, LLC. Moved by
Councilmember Gallagher, Seconded by
Councilmember Allen. Motion Carried.
New
Business, Petitions, Communications, Application Appeals:
Mayor Kaemingk opened for consideration release of
Performance Assurances for Prime Homes for Major Tree Removal permit TR25-13
(3500 Alaska Rd) in the amount of $21,000.00, Land Disturbing Activity permit
LDA25-05 (3502 Alaska Rd) in the amount of $16,470.00 and Land Disturbing
Activity permit LDA25-06 (3504 Alaska Rd) in the amount of $15,930.00. Motion: Approve release of Performance
Assurances for Prime Homes for Major Tree Removal permit TR25-13 (3500 Alaska
Rd) in the amount of $21,000.00, Land Disturbing Activity permit LDA25-05 (3502
Alaska Rd) in the amount of $16,470.00 and Land Disturbing Activity permit
LDA25-06 (3504 Alaska Rd) in the amount of $15,930.00. City Planner Lee
Michaelis gave brief review. Moved by
Councilmember Allen, Seconded by
Councilmember Gallagher. Motion Carried.
Miscellaneous
Business by Call of Councilmembers & City Officials:
Mayor Kaemingk wanted to bring to the council's
attention that a topic of conversation at the September 15th
workshop meeting will be his concern regarding the workload of City Planner Lee
Michaelis. Currently he has 126 items/projects
along with code enforcement issues that he is working on. There will be a discussion
as to what can be done to help with the load.
City Clerk Treasurer Swisher mentioned that a
possibility would be increasing the dollar amount authority that the Mayor can authorize release of the bonds or allowing the Mayor to sign to release all bonds no matter the amount.
This would save time for the City Planner in preparing the additional paperwork
it takes to bring these items to council. There was Council discussion
pertaining to the due-diligence of future planners and
Mayors.
Mayor Kaemingk opened for consideration to cancel
the September 1st council workshop meeting. Motion: Approve to cancel the September 1st council
workshop meeting. Moved by
Councilmember Gallagher, Seconded by
Councilmember Krienke. Motion Carried
Auditing
of Accounts:
Mayor Kaemingk opened for consideration approval of the August 2026
Claims Checks.
August Claims Checks No. 47862, Check No. 47867 through 47897, totaling
$109,287.05. Motion: Approve August

the amount of the re-issued check included on the agenda due to not knowing
what the correct amount is. Moved by
