PLANNING COMMISSION MINUTES

MARCH 27, 2002


 

Chairman Protem Friesen called the Brier Planning Commission meeting to order at 7:32 PM.

 

ROLL CALL:

Present:      Commissioners George Neilson, Corey Friesen, Eugene Funk, and Jim Hodgen.

Absent:      Commissioners Michael Lavoie, Sue Wahlgren, and Brandon Brock.

 

APPROVAL OF MINUTES:

Chairman Protem Friesen opened for consideration approval of the February 27, 2002 Planning Commission Minutes. Commissioner Neilson moved and Commissioner Funk seconded to approve the Planning Commission Minutes as written. Motion Carried.

 

COMMITTEE REPORTS: None.

 

PUBLIC REQUESTS AND ORAL COMMUNICATIONS:  Dick Russell introduced Nolan West, City of Brier Permit Specialist Building Official to the Planning Commission.

 

NEW BUSINESS: None.

 

OLD BUSINESS – CONTINUATION - PUBLIC HEARING:

PRELIMINARY SHORT PLAT APPLICATION #SP01-01 BY TIMOTHY ZILVERBERG AT 21908 36TH AVENUE WEST, WITH FILL AND GRADING #FG01-012, VARIANCE #V01-006, AND DRAFT RESOLUTION #464.

Chairman Protem Friesen opened for consideration Short Plat Application #SP01-01 by Timothy Zilverberg at 21908 36th Avenue West, with Fill and Grading #FG01-012, Variance #v01-006, and Draft Resolution #464.

Chairman Protem Friesen opened the Public Hearing at 7:35 PM.

The Planning Commission has an e-mail from Mike Lavoie addressing the Short Plat application, which was read into the record, and copies of the SEPA MDNS.

*Mr. Eric Davido, Consulting Group, Civil Engineers for the project, explained the new information that was submitted for this meeting. One is a new cover sheet that has the utility Companies correctly identified and the revised tree preservation plan.

There were no other comments.

Chairman Protem Friesen closed the Public Hearing at 7:43 PM.

Commissioner Neilson moved, and Commissioner Hodgen seconded to recommend to the Brier City Council approval of Short Plat Application #SP01-01, Fill and Grading #FG01-012, the Petition for Vacation of Right of Way Application, Variance #V01-006, and Draft Resolution #464, by Mr. Timothy Zilverberg at 21908 36th Avenue West, subject to inclusion of all the comments and recommendations by City Staff, City Engineer, SEPA Official and Mountlake Terrace Fire Department. Motion Carried.

 

MISCELLANEOUS BUSINESS:

Commissioner Friesen stated that for the best interests of the Planning Commission and due to circumstances beyond his control, he will not be able to attend the meetings on a regular basis.  Because of this Commissioner Friesen stated that he has to step down as Commissioner Protem, and he nominated Commissioner Neilson as Chairman Protem.

Commissioner Friesen moved and Commissioner Funk seconded to elect Commissioner Neilson as Chairman Protem.  Motion Carried.

Commissioner Funk stated that due to his wife’s illness he may not be able to attend the Planning Commission meetings on a regular basis.

Commissioner Neilson asked questions regarding Peggy Dares complaints about the way the Murphy/Lamb subdivision was being developed. Commissioner Neilson asked Mr. Russell if those questions had been addressed by his Department.  Mr. Russell stated that yes they have looked into them.  Mr. Russell stated that the Army Corp of Engineers have been out, the Department of Ecology has been out, the Forest Practices permit from Department of Natural Resources and they are all satisfied and have no complaints. Mr. Russell stated that there was nothing there that any of those organizations felt was an area of concern.  Mr. Russell stated that in so far as the change in design, it was a requirement by the City. He stated that the City requires that all cut slopes be a maximum of 2 to 1 and fill slope be a maximum of 3 to 1, which is in the sensitive areas Ordinance, Section 18.      Mr. Russell stated that in order to provide or accommodate the requirement of the 3 to 1 fill slope it was necessary to move the berm to the north as far as it can go and then change the area on the south side. There was not a change in design, but a change in slopes. Mr. Russell stated that the Landscape Wetland Mitigation Plan has been met. Commissioner Neilson asked if what Ms. Dare wrote is a condition as part of the project. She had stated: “that approved wetland sensitive area mitigation street placement landscape planning will be required for preliminary plat review by the City’s Planning Commission”.  Mr. Dick Russell stated that it is not a requirement. Mr. Russell stated that the City listens to the citizen complaints and takes them seriously.

Commissioner Neilson stated that he would like to postpone action on Title 17 to the next Planning Commission meeting.

 

Nolan West gave the Planning Commissioners a packet containing correspondence and pictures regarding whether or not tent structures should be subject to permitting. There was discussion.

 

The Planning Commission postponed Title 17 and the tent structures to the April 24, 2002 Planning Commission meeting.

 

ADJOURNMENT:

Commissioner Hodgen moved and Commissioner Funk seconded to adjourn. The meeting adjourned at 9:30 PM.
