BRIER PLANNING COMMISSION MINUTES

June 26, 2002


Chairman Lavoie called the Brier Planning Commission meeting to order at 7:35 PM.

 

ROLL CALL:

Present:      Commissioners George Neilson, Michael Lavoie, Corey Friesen, and Sue Wahlgren, Commissioner Brock arrived at 7:42 PM

Absent:       Commissioners Jim Hodgen, and Eugene Funk.

 

APPROVAL OF MINUTES:

Chairman Lavoie opened for consideration approval of the April 24, 2002 Planning Commission minutes. Commissioner Wahlgren moved and Commissioner Neilson seconded to approve the April 24, 2002 minutes as written. Motion Carried with Commissioner Friesen abstaining.

 

COMMITTEE REPORTS: Nolan West answered a few questions from the Planning Commissioners regarding the reception from the citizens to his job.

Councilman Warner gave a brief report to the Planning Commission regarding decriminalization of the 4th of July violators.

 

PUBLIC REQUESTS AND ORAL COMMUNICATIONS:  

*Peggy Dare - 22320 Hickory Way – reported on the Bright Water project.

*Mr. Russell gave a brief report on what Brier’s involvement in Bright water is.

*Peggy Dare – 22320 Hickory Way talked about the Horse Trail and its dedication years ago.  Ms. Dare stated that she will be talking to the City Council on a Trail Design July 2, at their Workshop meeting. Ms. Dare spoke about the landscape plan for the Murphy/Lamb Shortplat and gave suggestions of how to do it differently for the next development. 

*Tim Carrigan – 21904 34TH Avenue W, spoke to the Planning Commission regarding the nature path that was required for the Zilverberg Shortplat. He stated that the path being designed will end up on the other side of his back yard.  He has a 6” cedar  fence and a person sitting on the bench at the end of the path would be able to look into Mr. Carrigan’s neighbor’s back yard. He requested that the Planning Commission consider to not have a park bench put at the end of the path. Planning Commission asked for a copy of the Concomitant Agreement.

NEW BUSINESS - PUBLIC HEARING

CONDITIONAL USE PERMIT APPLICATION #CU02-01 BY DEAN PETERSON @ 2805 216TH ST SW.

Chairman Lavoie opened for consideration Conditional Use Permit Application #CU02-01 by Dean Peterson at 2805 216th Street SW. Mr. Dean Peterson explained his Conditional Use Application. Mr. Peterson is proposing to construct a single family residence at the SE corner of the lot, an accessory dwelling unit for his mother at the North side of the lot and a garage in between.

Chairman Lavoie opened the Public Hearing at 8:07 PM

*Peggy Dare - 22320 Hickory Way – stated she is in favor of a Mother-in-law home but is concerned with the amount of impervious surface.

*Mike Mehrer - 2748 215th Pl. SW – stated he was concerned that the property would be rented out, the size of the lot should not be able to support two homes, and the street is very busy. Mr. Mehrer stated that he and the neighbors do not want a rental in the neighborhood and his is afraid it will become a rental. Mr. Mehrer submitted a signed letter from neighbors objecting to the Conditional Use Application.

*Peggy Dare – 22320 Hickory Way – stated that she thought it would be a good idea not to call it a mother-in-law home. It was clarified that it is called an Accessory Building.

*Dean Peterson – stated that he has taken care with this Conditional Use Application not to offend the neighbors and that it is within the law.

*Tung Doan – 2778 215th Street SW stated that the lights from the cars would shine in his living room in the winter, because the shrubs become bare.

Chairman Lavoie closed the Public Hearing at 8:18 PM.

There was Planning Commission discussion.

Commissioner Neilson moved and Commissioner Brock seconded to recommend approval of Conditional Use Permit Application #CU02-01 by Dean Peterson at 2805 216th Street SW, with the conditions noted on staff memorandum dated June 17, 2002, to the Brier City Council. Motion Carried.

 

VARIANCE USE PERMIT APPLICATION #V02-003 BY JOHN KENNEDY @ 3609 218TH ST SW.

Chairman Lavoie opened for consideration Variance Use Permit Application #V02-003 by John Kennedy at 3609 218th Street SW.

Mr. John Kennedy explained his Variance Use Permit Application #V02-003 to the Planning Commission. He stated that he is requesting a Variance to increase their lot coverage beyond the maximum 45% identified in BMC 17.28.010D.

Chairman Lavoie opened the Public Hearing at 8:43 PM.

*Rick Resseguie 21913 34th Ave W – asked what the Variance request was for.

There were no other comments.

Chairman Lavoie closed the Public Hearing at 8:44 PM.

There was discussion regarding the amount of concrete around the pool.

Commissioner Neilson moved and Commissioner Brock seconded to approve Variance Use Permit Application #V02-003 by John Kennedy at 3609 218th Street SW, as submitted and as noted with Staff Memorandum dated June 11, 2002. Commissioner Brock and Commissioner Neilson voted yes, with Chairman Lavoie, Commissioner Wahlgren, and Commissioner Friesen voted no. The Planning Commission felt that there was too much concrete around the pool and that it could be reduced. Motion Failed.

 

VARIANCE USE PERMIT APPLICATION #V02-004 BY RICK AND KASTLE RESSEGUIE at 21913 34TH AVE W.

Chairman Lavoie opened for consideration Variance Use Permit Application #V02-004 by Rick and Kastle Resseguie at 21913 34th Avenue W. Mr. Resseguie explained that he is requesting a Variance to reduce their rear yard setback to allow construction of an addition to a rear deck. Required rear yard setbacks are 25’ per BMC 17.28.010 C3.

Chairman Lavoie opened the Public Hearing at 9:02 PM

*Tim Carrigan – 21904 34TH Avenue W stated he was in favor of the request.

There were no other comments.

Chairman Lavoie closed the Public Hearing at 9:05 PM

Commissioner Wahlgren moved and Commissioner Brock seconded to recommend approval of Variance Use Permit Application #V02-004 Site Plan #I, by Rick and Kastle Resseguie at 21913 34th Avenue W. Motion Carried.

 

MISCELLANEOUS BUSINESS:

CONTINUE CONSIDERATION OF CHANGES TO TITLE 17, ZONING CODE AND MAKE RECOMMENDATIONS TO THE CITY COUNCIL.

Commissioner Lavoie opened for continuation of the consideration of changes to Title 17. Chairman Lavoie gave a hand out addressing the suggestions that had been brought up during the Planning Commission meetings.  Commissioner Wahlgren reported on some research she had done regarding Building Codes.

 

Chairman Lavoie moved and Commissioner Brock seconded to add to Chapter 17.12.040(p), “One stationary business sign not to exceed 6 square feet”, and remove the part that addresses wood with routed letters. Motion Carried.

 

Chairman Lavoie stated he would like to change chapter 17.36.050 (5), to be renumbered from #5 to #6 and insert “The time frames for filing an appeal by the applicant or representative on a final denial or deferments shall be within 20 days”.

 

Motion was made and seconded to continue discussion on Chapter 17.  Motion Carried.

Commissioner Friesen moved and Commissioner Neilson seconded to adjourn. The meeting adjourned at 10:14 PM.
