BRIER PLANNING COMMISSION MINUTES

August 28, 2002


Chairman Lavoie called the Brier Planning Commission meeting to order at 7:36 PM.

 

ROLL CALL:

Present: Commissioners Corey Friesen, Michael Lavoie, Gene Funk, and Jim Hodgen.

Absent: Commissioner Sue Wahlgren, and Brandon Brock

 

 

APPROVAL OF MINUTES:

Chairman Lavoie opened for consideration approval of the July 24, 2002 Planning Commission minutes. Commissioner Friesen moved and Commissioner Funk seconded to approve the July 24, 2002 minutes as written. Motion Carried.

 

COMMITTEE REPORTS: None.

 

PUBLIC REQUESTS AND ORAL COMMUNICATIONS:  

None.

 

OLD BUSINESS – NONE:

 

NEW BUSINESS - PUBLIC HEARING

CONDITIONAL USE APPLICATION #CU02-002 by JOHN & ARDELLA ENGSTROM AT 23101 BRIER ROAD.

Chairman Lavoie opened for consideration Conditional Use Application CU02-002 by John & Ardella Engstrom at 23101 Brier Road. Mr. Engstrom explained the reason for requesting an 8-foot fence. Mrs. Engstrom introduced pictures of the area in question.  The Engstrom’s stated the fence would be on their property. There was Planning Commission discussion.

Chairman Lavoie opened the Public Hearing at 7:44 PM.

Mr. Robert Brooks – 23025 Brier Road – stated that he would like to hear what the Planning Commissioners have to say.  He stated that there will be shrubs, a wooden fence and a chain link fence, and the problem that he sees is that there will be weeds between the wooden fence and the chain link fence and is concerned with weed control. Mr. Brooks suggested that the chain link fence be taken down.  He stated that he would like to keep it neighbor friendly.

Mr. John Engstrom – 23101 Brier Road stated he was for it.

Mrs. Ardella Engstrom – 23101 Brier Road state she sees no problem with it.  She said that it would provide for privacy, protection and safety.

There were no other comments.

Chairman Lavoie closed the Public Hearing at 7:50 PM.

There was Planning Commission discussion regarding how the Engstrom’s will contain the weeds between the fences.

The Planning Commission took a 5-minute break at 8:00 PM.

Chairman Lavoie reconvened the meeting at 8:05 PM.

Mr. Brooks explained that he would agree with the wooden fence on his side rather than the chain link fence. He stated he would have to talk to his wife to see how she feels about it.

Commissioner Friesen moved and Commissioner Lavoie seconded to recommend approval of Conditional Use Application #CU02-002 by John and Ardella Engstrom at 23101 Brier Road to the Brier City Council, with the recommendation that the 8 foot fence run on the neighbors side of the cyclone fence, with a letter of acceptance from Mr. and Mrs. Brooks, the neighbor.  Motion died for lack of a second.

Commissioner Friesen moved, and Commissioner Lavoie seconded, to recommend approval of Conditional Use Application #CU02-002 by John and Ardella Engstrom at 23101 Brier Road to the Brier City Council, with the recommendation that the 8 foot wood fence be built good side out and down on, and inside the existing property line, so the shrubs and cyclone fence would be on the applicants side of the wood fence and the applicant get a letter from Mr. & Mrs. Brooks stating that it is ok to temporarily trespass during and for the construction of the fence.  Motion Carried.

 

Commissioner Friesen stated he was submitting a letter to the Mayor saying he will be resigning but not before a replacement is found.

 

Chairman Lavoie left at 8:25 PM.

 

MISCELLANEOUS BUSINESS:

CONTINUE CONSIDERATION OF CHANGES TO TITLE 17, ZONING CODE AND MAKE RECOMMENDATIONS TO THE CITY COUNCIL.

Chairman Protem Hodgen opened for continuation to consider changes to Title 17. The Planning Commission discussed the issue of tent structures.

Title 17 discussion was tabled until the next Planning Commission meeting.

Commissioner Friesen moved and Commissioner Funk seconded to adjourn.
