BRIER PLANNING COMMISSION MINUTES
September 25, 2002
Chairman Lavoie called the Brier Planning Commission meeting to
order at 7:30 PM.
ROLL CALL:
Present: Commissioners Michael Lavoie, Gene
Funk, Sue Wahlgren and Jim Hodgen.
Absent: Commissioner Corey Friesen, and
Brandon Brock
APPROVAL OF
MINUTES:
Chairman
Lavoie opened for consideration approval of the August 28, 2002 Planning
Commission minutes. Commissioner
Hodgen moved and Commissioner
Funk seconded to approve the August 28, 2002 Planning Commission
minutes as written. Motion Carried. Commissioner Wahlgren abstained as she was
not in attendance at that meeting.
COMMITTEE REPORTS:
Councilmember Warner gave a report of the City Council action on
Mr. & Mrs. Engstrom’s Conditional Use Application.

CONSIDERATION OF CHANGES TO TITLE 17, ZONING CODE AND MAKE RECOMMENDATIONS TO
THE CITY COUNCIL.
Chairman Lavoie opened
for discussion to consider changes to Title 17. The Planning Commission held
discussion with Nolan West about Building Height.
Commissioner Hodgen moved and Commissioner Wahlgren seconded
to recommend to Brier City Council that they adopt Draft 2, Exhibit A, that
replaces Chapter 17.28.010.E and supercedes all other references to Building
Height, restrictions. Exhibit A reads. “Building Height – Limitation and
Measurement Method”, Building height shall be measured vertically from the
average existing grade to the highest point of the structure. The building
height shall not exceed 30 feet at its highest point. The average existing
grade shall be measured by first enclosing the dwelling in the smallest
possible rectangle and then averaging the existing ground elevations taken at
the midpoint of each side of the rectangle. If the midpoint of the rectangle is
not located on the subject property, the measurement point shall be determined
by establishing the midpoint of the property line, where it intersects the rectangle.
Exceptions: Chimneys, towers, spires and steeples erected as a part of a
building and NOT used for habitation or storage are limited to fifteen (15)
feet above the highest point of the structure provided they are built of
completely non-combustible materials and five (5) feet above the highest point
of the structure if combustible materials are used in the construction. Motion
carried.
Other issues the
Planning Commissioners recommended were section 17.12.040(m) referring to Day
Care hours, changing the hours for allowing children outside to play from 7
A.M. to 9 A.M.
Chapter 17.12.040(p),
“One Stationary business sign not to exceed 6 square feet and to remove the part that addresses wood with
routed letters, to delete from this section and place in the Sign Ordinance
17.38.090, Residential Zones.
There was discussion
regarding Chapter 17.16.030 (g) manure to be removed from premises at least
weekly or cultivated into ground or lawns.
Commissioner Hodgen moved and Commissioner Wahlgren seconded
to recommend to Brier City Council, to replace the second sentence of Chapter
17.16.030(g) with the following sentence: “Manure must be removed from the
premises at least once per week or worked into the soil unless the City
determines that use as fertilizer causes insect, odor, or public hazard”.
Motion carried, with
Commissioners Hodgen, Wahlgren and Funk voting yes and Commissioner Lavoie
voting no.
Chairman Lavoie stated
that Chapter 17.24.010 “Secondary Dwellings” and, “Abutting neighbors”, needs
to be worked on. Chairman Lavoie asked the Planning Commissioners to come to
the October meeting with their ideas.
Chairman Lavoie moved and Commissioner Wahlgren seconded,
to reschedule the October 23, November 27, and December 23, meetings to October
16, November 20, and December 18, due to holidays. Motion Carried.
ADJOURNMENT:
Commissioner Wahlgren moved and Commissioner Funk seconded to adjourn. Meeting adjourned at
8:29 P.M.
