BRIER PLANNING COMMISSION MINUTES

August 20, 2003


Chairman Lavoie called the Brier Planning Commission meeting to order at 7:00 PM.

 

ROLL CALL:

Present:            Commissioners Gene Funk, Michael Lavoie, and Brandon Brock, Sue Wahlgren, David Marley, Allyn Chrisman, and Jim Hodgen.

Absent:             None.

 

APPROVAL OF MINUTES:

Chairman Lavoie opened for consideration approval of the June 18, 2003 Planning Commission minutes.

 Commissioner Wahlgren moved and Commissioner Funk seconded to approve the June 18, 2003 Planning Commission minutes as written. Motion Carried. Commissioner Lavoie, Brock, Marley and Hodgen abstained, they were not at the June meeting.

Chairman Lavoie opened for consideration approval of the July 16, 2003 Planning Commission minutes. Commissioner Brock moved and Commissioner Lavoie seconded to approve the July 16, 2003 minutes. Motion Carried with Commissioner Wahlgren, and Marley abstained, they were not at the meeting.

 

COMMITTEE REPORTS: Councilman Warner gave a report on the Munnis Shortplat Application.

Commissioner Chrisman arrived at 7:04 PM.

 

NEW BUSINESS – PUBLIC HEARINGS:

SHORT PLAT APPLICATION #SP03-04 BY CRITCHLOW HOMES LOCATED AT 22020 BRIER ROAD, BRIER.

Chairman Lavoie opened for consideration Short Plat Application #SP03-04 by Critchlow Homes at 22020 Brier Road, Brier. Mr. McDonald, Civil Engineer, from Western Engineers reviewed the Shortplat Application. He explained the proposed Short Plat is a 2 acre site located at 22020 Brier Road. The proposal is to Shortplat into 4 lots. The City Staff recommendations are accepted by the applicant. The applicant asked for a few minor changes that are not reflected on the plat map. One is requesting a 15 foot building setback on the existing house from 10 feet. The consequence would slightly reduce the calculated areas on lot 3 and lot 2. There is a 35 foot panhandle tract and the applicant wants to return to the statutory 30 feet.

Chairman Lavoie opened the Public Hearing at 7:18 PM. There were no comments. Chairman Lavoie closed the Public Hearing at 7:19 PM.

There was discussion among the Planning Commissioners and City Staff.

Commissioner Wahlgren moved and Commissioner Brock seconded to recommend approval of Shortplat Application #SP03-04 by Critchlow Homes located at 22020 Brier Road to the Brier City Council with the following conditions:

1.       Incorporate City Staff recommendations from the memo dated August 11, 2003, with attachments.

2.       That Resolution #473 Item NN be included stating to install no less than three “no parking” signs on the access road and hammerhead.

3.       That a new set of plans be presented to the Brier City Council with the minor modifications mentioned by Mr. McDonald.

Motion Carried.

 

SHORT PLAT APPLICATION #SP03-02 BY GRACE MOORE/ED WALKER LOCATED AT 21206 POPLAR WAY, BRIER.

Chairman Lavoie opened for consideration Short Plat Application #SP03-02 by Grace Moore/Ed Walker located at 21206 Poplar Way, Brier.

Chairman Lavoie disclosed that he had been appointed to the Planning Commission by Mr. Walker’s wife, and that they were at one time neighbors. There were no objections. Chairman Lavoie stated he will participate but will not vote.

Mr. Walker gave a brief review of his application.

Chairman Lavoie opened the Public Hearing at 8:06 PM. There were no comments.

Chairman Lavoie closed the Public Hearing at 8:07 PM.

There was discussion held. There was a question regarding the date on the Plat maps and which one is the correct date. Chairman Lavoie stated the square footage listed on the plat maps are different. Mr. Walker stated that the date to be using should be 11/16/2002.

The Planning Commissioners were asking what is the square footage of the building envelopes. Planning Commission pointed out several discrepancies on the plat maps.

Mr. Walker stated he was in no hurry to go through the Shortplat process, he stated the Planning Commission could talk all winter long and go through it bit by bit, and that was ok.

Mr. Walker stated that he does have an issue with the use of the 1992 DOE manual and the 2001 DOE manual that regulates the Stormwater detention system standards. He stated he was concerned with the process rather than the plat.

Mr. Walker stated he will not be able to attend a Planning Commission meeting until September 17, 2003. Mr. Walker stated he is willing to waive any rights to any time limits on Subdivision application.

Commissioner Lavoie  moved and Commissioner Wahlgren seconded to continue the Public Hearing for Shortplat Application #SP03-02 by Grace Moore/Ed Walker located at 21206 Poplar Way to the September 17, 2003 Planning Commission meeting. Motion Carried.

 

MISCELLANEOUS BUSINESS:

TITLE 17 REVIEW

Chairman Lavoie opened discussion on Title 17 regarding whether the wording about accessory dwelling was clarified. “The owner of the property or family member consisting of no more than four unrelated persons must reside in the secondary dwelling unit.” There was Commission consensus to hold Title 17 from being forwarded to Council until they can verify the wording regarding Accessory dwelling.

Commissioner Wahlgren stated she will review the tapes and report at the next meeting.

Commissioner Brock moved and Commissioner Hodgen seconded to adjourn. Meeting adjourned at 8:56 P.M.
