BRIER PLANNING COMMISSION MINUTES

December 17, 2003
7:00 pm



Chairman Lavoie called the Brier Planning Commission meeting to order at 7:08 PM.

 

ROLL CALL:

Present:            Commissioners Michael Lavoie, Gene Funk, David Marley, and Jim Hodgen.

Absent:             Commissioners Sue Wahlgren, and Brandon Brock.

 

APPROVAL OF MINUTES:

Chairman Lavoie opened for consideration approval of the October 15, 2003 Planning Commission minutes. There was discussion. Commissioner Lavoie moved and Commissioner Marley seconded to approve the October 15, 2003 Planning Commission minutes as written. Motion Carried with Jim Hodgen abstaining. Chairman Lavoie opened for consideration approval of the November 19, 2003 Planning Commission minutes. Commissioner Lavoie moved and Commissioner Funk seconded to approve the November 19, 2003 Planning Commission minutes as written. Motion Carried with Jim Hodgen abstaining.

 

Commissioner Chrisman arrived at 7:10 PM.

 

COMMITTEE REPORTS: Councilmember Warner reported that there seems to be a problem with Park Mitigation. He reviewed the Ordinance for Park Mitigation and discussed the needs for a revision. Park Mitigation has to relate directly to the property under consideration. There was discussion.

 

MISCELLANEOUS BUSINESS:

REVIEW OF ORDINANCE 25.I, 251.B, 282.B, 294.A, AND 307.

Chairman Lavoie opened for discussion Ordinances 25.I, 251.B, 282.B, 294.A, and 307.  There was discussion.

Commissioner Marley moved and Commissioner Hodgen seconded to send Ordinance 294.A as written to the City Council for consideration, Motion carried with Commissioner Lavoie voting no.

 

Commissioner Marley stated that on Ordinance #251.B Mr. Walker made a comment about “the normal maintenance being allowed within the buffer region only” Commissioner Marley stated he hoped that the City Council would consider that.  There was discussion. Commissioner Lavoie stated he liked excluding your house and accessory buildings that is dealing with a storm retention system inside a buffer area. He stated that normal upkeep should not be restricted by a requirement of a 10 prior notice.

 

Commissioner Hodgen moved and Commissioner Chrisman seconded to recommend to the Brier City Council that they clarify “modification of pre-existing facilities such that those facilities that are in sensitive areas or buffers or have an impact on the same would require review “18.12.070 (e).  Motion carried.

 

 

Commissioner Marley moved and Commissioner Funk seconded to recommend to the Brier City Council and have them look at 18.20.100 Section a, Subsection (1)  where they should require the applicant to provide postage paid envelopes, and addresses within 300’ such as is required under other ordinances. Motion Carried.

 

Commissioner Hodgen and Commissioner Chrisman seconded to recommend to the Brier City Council to consider specific qualifications on best available science to include publication by peer review journals or incorporation to regulation by State or Federal authorities. Motion Carried.

 

Commissioner Lavoie moved and Commissioner Hodgen seconded to send Ordinances  25.I, 251.B, 282.B and 307 to the Brier City Council with the motions and public input for their review and incorporation.  Motion carried.

Commissioner Marley moved and Commissioner Hodgen seconded to adjourn. Meeting adjourned at 8:17 PM
