BRIER PLANNING COMMISSION MINUTES
October 20, 2004
Chairman Lavoie called the
Brier Planning Commission meeting to order at 7:08 PM.
ROLL
CALL:
Present: Commissioners Michael Lavoie, Sue
Wahlgren, David Marley, and Allyn Chrisman.
Absent: Commissioners Gene Funk, Jim Hodgen
and Brandon Brock.
APPROVAL OF MINUTES:
Chairman Lavoie
opened for consideration approval of the September 15, 2004 Planning Commission
minutes. Commissioner Marley stated that the comment made on page 2, line 11
should read Commissioner Hodgen rather than Commissioner Marley.

moved and Commissioner Chrisman
seconded to approve the September 15, 2004 Planning Commission minutes as
corrected. Motion Carried.
OLD BUSINESS – PUBLIC HEARING -
CONTINUED:
LOT LINE ADJUSTMENT #LL04-01 AT 2805
216TH ST SW, BY DOUGLAS SIMPSON.
Chairman Lavoie opened for
consideration Lot Line Adjustment #LL04-01 at 2805 216th St SW, by
Douglas Simpson. Mr. Albert Williams Public Works Director explained that the
Lot Line Adjustment request is being continued until the applicant has
submitted requests made by the Planning Commission meeting of September 15,
2004.

BUSINESS - PUBLIC HEARING:
SHORTPLAT
APPLICATION #SP02-01 AND VARIANCE #V02-006, BY ESMAEEL JAHED AT 24023 BRIER WAY.
Chairman
Lavoie opened for consideration Shortplat application #SP02-01 and Variance
application #V02-006, by Esmaeel Jahed at 24023 Brier Way.
Mr. Ty Peterson, 616 213th
ST SW, Bothell, 98021 stated he is here representing the applicants for their
Shortplat and Variance request. Mr. Peterson explained the Shortplat
application. He went on to ask for frontage improvement relief, sidewalks
specifically and talked about the issue of the Accessory dwelling unit. The
Applicant will vacate the use of the ADU at the time construction will start.
The applicant is also requesting that the requirement for a 20-foot minimum
width for driveway easement be reduced to 15 feet.
Mr. Albert Williams gave a brief
explanation of the City Staff recommendations.
Chairman Lavoie opened the Public
Hearing for Shortplat Application #SP02-01 and Variance application #V02-006 by
Esmaeel Jahed at 24023 Brier Way at 7:27 PM.
The
Planning Commission received a letter from Mr. Wayne Kaske regarding the
Shortplat and Variance application.
There
were no comments.
Chairman
Lavoie closed the Public Hearing for Shortplat Application #SP02-01 and
Variance #V02-006 by Esmaeel Jahed at 24023 Brier Way at 7:28 PM.
There was discussion.
Commissioner
Marley
moved and Commissioner Wahlgren
seconded to recommend to the Brier City Council approval of Variance #V02-006
by Esmaeel Jahed at 24023 Brier Way with the following conditions that the
sidewalks and frontage improvements are installed as per Item #16, and the
ingress/egress be expanded to 20 feet to the property line from Brier Way and
tapered to 15 feet afterwards.
Motion Carried with Commissioner Lavoie
voting no, because he does not agree with installing of the sidewalks.
Commissioner
Wahlgren moved and Commissioner
Chrisman seconded to recommend approval of Shortplat Application
#SP02-01 with the following conditions:
To include all of the recommendations
of City Staff, allow one off street parking space plus the garage, Item #23 of
the City Staff report which deals with the oil tank will be clarified to say
decommissioned or removed and to discontinue the ADU until a Conditional Use
Application is approved.
Motion Carried.
MISCELLANEOUS BUSINESS:
INFORMATION DISCUSSION OF JOINT
PLANNING COMMISSION AND SNOHOMISH COUNTY MEETING.
Commissioner Wahlgren
will be the Brier Planning Commission representative for the Joint meeting with
Snohomish County on November 9th regarding the Subarea 10-year
Update Working Session.
ADJOURNMENT:
Commissioner Lavoie moved and Commissioner Wahlgren seconded
to adjourn. Motion Carried and the meeting adjourned at 8:20PM.
