PLANNING COMMISSION MINUTES

MAY 18, 2005

 

Chairman Lavoie called the Brier Planning Commission meeting to order at 7:00 PM.

 

ROLL CALL:

Present:          Commissioners Michael Lavoie, Sue Wahlgren, Robert Nelson, Scott Warner, and Gene Funk, Allyn Chrisman arrived at 7:08 PM.

 

Absent:           Commissioner Dave Marley.

 

APPROVAL OF MINUTES:

Commissioner Nelson moved and Commissioner Funk seconded to approve the minutes of April 20, 2005 as written. Motion Carried with Michael Lavoie abstaining.

 

COMMITTEE REPORTS:

Mayor Starks reminded the Planning Commissioners that on May 26, 2005 at 7:00 PM, there will be a Public Hearing before them on the 2004 Draft Comprehensive Plan. There was discussion.

 

PUBLIC REQUESTS & ORAL COMMUNICATIONS:

Mark Burbank 23638 29th Avenue W. stated he and his wife are interested in putting in a small addition and was interested in applying for a Variance. Chairman Lavoie informed Mr. Burbank that he needed to meet with Administration.

 

NEW BUSINESS:

VARIANCE APPLICATION #V05-002 - DOMINIC PANTEL AT 23301 38TH PLACE W.

CONDITIONAL USE PERMIT APPLICATION #CUP 05-003 - DOMINIC PANTEL AT 23301 38TH PLACE W.

Mr. Pantel explained that he was applying for an Adult Family Home and his Variance application is for installing a ramp, the Conditional Use Application is for his Adult Family Home Business License, before he can apply to the State for his Business License.

Chairman Lavoie opened the Public Hearing for Variance Application #V05-002 and Conditional Use Permit Application #CUP05-003 by Dominic Pantel at 23301 38th Place W at 7:17 PM.

Ed Walker – 21206 Poplar Way asked how many clients will be in the home.

Mr. Pantel stated he plans on having 4 clients.

Ed Walker – 21206 Poplar Way commented that Brier is a single family residential community and that the City could probably restrict the amount of people in the home to what the code states.

There were no other comments.

Chairman Lavoie closed the Public Hearing at 7:24 PM.

There was discussion.

Commissioner Warner moved and Commissioner Wahlgren seconded the motion to approve Variance Application #V05-002 and CUP05-003 by Dominic Pantel at 23301 38th Place W, subject to the six conditions recommended by staff, which are (1) provide a copy of the annual State inspections. (2) provide copies of caregiver training as required pursuant to RCW 703128.230, long-term caregiver training. (3) Install smoke detectors in each room where a resident is located. (4) Have a Fire extinguisher on each floor of the house. (5) A six-foot fence shall be placed around the single-family residence from the front of the dwelling unit. The fence can be no higher than three feet high within the front yard setback. (6) Must provide one parking space for the caregiver. Motion Carried.

 

MISCELLANEOUS:

There was discussion regarding the Public Hearing coming up on May 26th

 

ADJOURNMENT:

Commissioner Lavoie moved and Commissioner Nelson seconded to adjourn at 7:35 PM.
