BRIER PLANNING COMMISSION MINUTES

July 19, 2006
7:00 PM




Chairman Lavoie called the Brier Planning Commission meeting to order at 7:01PM.

 

ROLL CALL:

Present:            Commissioners Gene Funk, Keith Maw, Michael Lavoie, Kerin Steele, David Marley, and Scott Warner.  Commissioner Allyn Chrisman arrived at 7:18 PM.

                        Councilman Krienke, Planning Commission liaison.

 

APPROVAL OF MINUTES:

Chairman Lavoie opened for consideration approval of the June 21, 2006 regular Planning Commission Meeting minutes. Commissioner Warner moved and Commissioner Steele seconded to approve the June 21, 2006 regular Planning Commission Meeting minutes as corrected and add “Chairman Lavoie abstained to the approval of the May 17, 2006 regular Planning Commission Meeting minutes due to him not being present.” Motion Carried.

 

Commissioner Warner moved and Commissioner Steele seconded to move items A and B to be discussed first. Motion carried.

 

NEW BUSINESS – PUBLIC HEARING:

A. PUBLIC HEARING ON CONDITIONAL USE PERMIT #CU06-001 BY JIM & JERRI LILLEY AT 21228 POPLAR WAY FOR AN ADULT FAMILY HOME.

Jim Cutts, Director of Community Development and Planning, explained the application and provided more information.

Jim and Jeri Lilley 21228 Poplar Way stated that they have been in business for twenty-five years and have lived in their home for a year. Mrs. Lilley stated that they would like to have a small group home of three to four elderly and handicap patients.

Chairman Lavoie opened the Public Hearing at 7:15 PM.

Ed Walker 21206 Poplar Way stated that he supports this application.

Chairman Lavoie closed the Public Hearing at 7:16 PM.

Commissioner Steele moved and Commissioner Warner seconded to send Conditional Use Permit #CU06-001 by Jim & Jerri Lilley at 21228 Poplar Way for an Adult Family Home onto the City Council with the recommendation to approve the Conditional Use Permit with the conditions as amended, which are posting of their State and City of Brier Business Licenses, place fire extinguishers as required by the fire department and to include all items remaining on the City Staff Correspondence. Motion carried. Commissioner Chrisman abstained.

 

 

B. PUBLIC HEARING ON CONDITIONAL USE PERMIT #CU06-003 BY RICHARD ARNESON AT 23226 32ND AVE W FOR A SECONDARY DWELLING UNIT.

Jim Cutts, Director of Community Development and Planning, explained the application and provided more information. 

Richard and Alice Arneson 23226 32nd Ave W stated that they want to build a secondary dwelling unit so they could be closer to their parents.

Chairman Lavoie opened the Public Hearing at 7:25 PM.

Ed Walker 21206 Poplar Way, stated that he supports this application.

Chairman Lavoie closed the Public Hearing at 7:26 PM.

Commissioner Maw moved and Commissioner Funk seconded to send Conditional Use Permit #CU06-003 by Richard Arneson at 23226 32ND Ave W for a secondary dwelling unit onto the City Council with the recommendation to approve. Motion carried.

 

C. PUBLIC HEARING ON CONDITIONAL USE PERMIT #CU06-002 BY CINGULAR WIRELESS AT 3732 235TH PL SW FOR AN AMENDMENT.

Chairman Lavoie stated that this item has been cancelled due to it being handled by staff.

 

OLD BUSINESS – CONTINUATION – PUBLIC HEARING:

Chairman Lavoie opened for consideration McClenny Meadows Subdivision #05-001 located at 3515 214th ST. SW, Brier by Dr. Lindsay McClenny, Public Hearing.

Jim Cutts, Director of Community Development and Planning, explained the application and provided more information. Mr. Cutts announced that Jason Henry and Jorge Garcia, Hammond Collier Wade, were here to answer questions about engineering.

There was commissioner discussion about the sewer.

Ed McClenny 3609 214th St. SW., stated that he would like to understand what the process is of the public hearing and how it will unfold.

Randy Boyer, attorney for the McClennys, stated that he does not know if there has been any conflict, but they would like to have a disclosure of any ex-party contact.

The commissioners stated that they have had no outside discussions with the applicant.  

Chairman Lavoie opened the Public Hearing at 7:45 PM

Ed Walker 21206 Poplar Way, stated that he is concerned because Scott Warner did not disclose that he has had an outside discussion with Ed McClenny. Mr. Walker spoke about the sewer and said that Jason Henry, City Engineer, needs to take responsibility and guarantee the City about the sewer. Mr. Walker gave the Commissioners a response to Jason Henry’s letter from July 13, 2006 and he also spoke about the sewer and issues.

Peggy Dare 22320 Hickory Way stated that the McClenny Meadows Subdivision is proposed to have a vault for storm water. Ms. Dare stated that a wet pond is the best way to do storm water control, because it is a wetland and this will keep the pollution down.

Ed McClenny 3609 214th St. SW stated that his attorney, Randy Boyer, may speak on his behalf. Mr. McClenny handed out “Brier Planning Commission McClenny Meadows Hearing” packet. Mr. McClenny addressed everything that was written in the hand out and explained it.

There was commissioner discussion about driveways and sewer.

Jorge Garcia, Hammond Collier Wade 4010 stone Way N. Ste. 300 Seattle 98103, addressed the sewer issue and spoke about Mr. McClenny’s two roadway options.

Ed Walker 21206 Poplar Way, reminded the commissioners that Mr. McClenny is required by ordinance to pay $8500 per lot for a latecomer fee. Mr. Walker also spoke about his bank and that is eroding away.

Jason Henry, City Engineer, Hammond Collier Wade, 4010 stone Way N. Ste. 300 Seattle 98103, spoke about the transportation report, elevation and requirements. There was commissioner discussion.

Peggy Dare 22320 Hickory Way, stated that she had a chance to look at the drawings and apologized to Mr. McClenny about her previous statement about the houses being really close to the cul-de-sac and having extra space in the back. Ms. Dare stated what designs she would like to see.

Clare McClenny 3607 214th St SW commented on the cotton wood tree on 214th.

George Wilson 3607 214th St. SW, asked if the documents that have been submitted to the Commissioners are part of public record.

Ed Walker 21206 Poplar Way stated that he disagrees with Ed McClenny’s presentation and he addressed the issues about the sewer. 

Chairman Lavoie closed the Public Hearing at 9:49 PM.

There was commissioner discussion.

Commissioner Marley moved and Commissioner Steele seconded to recommend to the City Council the approval of McClenny Meadows Subdivision #05-001 located at 3515 214th ST. SW, Brier by Dr. Lindsay McClenny,  with a condition that the third PUD letter be submitted to the city, that the alternate sewer plans B and A be approved, the parks plan be approved, impose a five year subdivision restriction with city attorney and City Council of lot 9 and explore the feasibility of lowering the sewer line under the creek and to proper depth to Poplar Way. Motion carried.  Commissioner Warner opposed due to the plat makes inappropriate use of the lot potential mitigation and that the parks proposal does not comply with City ordinance. Chairman Lavoie opposes because he does not like the amount of road discharges and the lot potential. 

 

CONTINUE DISCUSSION ON PROPOSED AMENDMENT OF CHAPTER 16.32 “SHORT SUBDIVISIONS”.

Chairman Lavoie opened for consideration the discussion on proposed amendment of chapter 16.32 “Short Subdivisions”.

Councilmember Krienke spoke to the commissioners about changes the City Council made.

Commissioner Warner moved and Commissioner Steele seconded to recommend to the City Council chapter 16.32 “Short Subdivisions” Ordinance for approval. Motion carried.

 

Commissioner Maw moved and Commissioner Warner seconded to amend the previous motion to add the appeal information into the public notice letter. Motion carried.

 

MISCELLANEOUS:

Chairman Lavoie announced that he will not be attending the next Planning Commission Meeting.

Commissioner Maw moved and Commissioner Marley seconded to adjourn. Meeting adjourned at 10:25 PM.
